Rep. Paul Ryan (R., Wis.), the ranking member of the House Budget Committee, tells National Review Online that House Democrats are planning to use the budget-reconciliation process in order to pass Obamacare. “They’re meeting with each other THIS WEEKEND to pursue it,” says Ryan. “I’ve spoken with many Democrats and the message is this:" They’re not ready to give up. They’ve waited their entire adult lives for this moment, and they aren’t ready to let 100,000 pesky votes in Massachusetts get in the way of fulfilling their destiny. They’ll look at every option and spend the next four or five days figuring it out.”
If the Democrats pass a health-care bill through reconciliation, it means they would need only 51 votes in the Senate for final passage. To start the process, House Speaker Nancy Pelosi (D., Calif.) would need to bring a new health-care bill to the House Budget Committee with reconciliation instructions, with the Senate doing the same. “They’d have to go back to the beginning of the process,” says Ryan. “They’d need to affix reconciliation instructions to a new bill.” Doing so, he says, wouldn’t be too hard. “There’s nothing we can do to stop this from a technical standpoint, since all they need is a simple majority vote and our ratio on the committee is terrible. What [Republicans] can do on the Budget Committee is pass resolutions for the Rules Committee to insist on certain changes in the bill and create a ‘vote-a-rama’ atmosphere.”
If reconciliation happens, Ryan predicts that the Democrats will still have a hard time pulling it off. “There are Blue Dog Democrats out there who are more survivalist than ideologues. One or two switches could be a game changer. The question is whether Democrats will continue to follow Pelosi off the cliff. After Massachusetts, the Democrats are quickly realizing that even if the president comes in to stump, and you get all the union support you need, it’s still not enough to get you elected.”

Now is the time to finish off the prospects of Obamacare with the Democrats reeling from the defeat in Massachusetts.
We must not trust them. The apparent reluctance of the House Democrats to pass the Senate version will evaporate once Obama puts his weight behind the bill and Pelosi starts to twist arms. Moderate Democrats cannot be counted upon.
Who's to Blame for America's Economic Crisis – Vote Here! So we need to target Democrats in swing districts who voted for the health care legislation in its first go-round in the House and convince them of the error of their ways. Nancy Pelosi's strategy is to delay and let the impact of the Brown win in Massachusetts be blunted by time. Meanwhile, she will propose amendments to the Senate bill and submit her proposed changes to the upper chamber. Harry Reid will tell her that such a bill is dead on arrival but she will demand a vote. When the measure is rejected (or fails of closure), she will go back to her caucus and say, "I tried, but the Senate would not accept any of our amendments."
Then the question is: What happens then? If we have prepared the way by influencing the districts of the marginal members who voted for the bill, we can assure that the centrist Democrats do not support the new legislation. We can peel away some of the 220 votes (with 215 against) by which the bill passed the House.

Bipartisan? Transparent? Dems Merging Health Bills in Secret Without GOP
House and Senate Democrats intend to bypass traditional procedures when they negotiate a final compromise on health care legislation, officials said Monday, a move that will exclude Republican lawmakers and reduce their ability to delay or force politically troubling votes in both houses.
The unofficial timetable calls for final passage of the measure to remake the nation's health care system by the time President Barack Obama delivers his State of the Union address, probably in early February.
Democratic aides said the final compromise talks would essentially be a three-way negotiation involving top Democrats in the House and Senate and the White House, a structure that gives unusual latitude to Senate Majority Leader Harry Reid of Nevada and Speaker Nancy Pelosi of California.
These officials said there are no plans to appoint a formal House-Senate conference committee, the method Congress most often uses to reconcile differing bills. Under that customary format, a committee chairman is appointed to preside, and other senior lawmakers from both parties and houses participate in typically perfunctory public meetings while the meaningful negotiations occur behind closed doors.
In this case, the plan is to skip the formal meetings, reach an agreement, then have the two houses vote as quickly as possible. A 60-vote Senate majority would be required in advance of final passage.
"I look forward to working with members of the House, the Senate and President Obama to reconcile our bills and send the final legislation to the president's desk as soon as possible," Pelosi said late last year as the Senate approved its version of the legislation.
"We hope to get a bill done as soon as possible," said Jim Manley, a spokesman for Reid.
The issue is so partisan that only one Republican, Rep. Anh "Joseph" Cao of Louisiana, has cast a vote in favor of the legislation.
GOP leaders have vowed to try and block a final bill from reaching Obama's desk. "This fight isn't over. My colleagues and I will work to stop this bill from becoming law," Sen. Mitch McConnell, R-Ky., the Republican leader, said shortly before the Senate cleared its version of the bill last month.
Both houses have already passed legislation to remake the health care system, extending coverage to millions who lack it while cracking down on industry practices such as denying insurance on the basis of pre-existing medical conditions.
There are literally hundreds of differences between the two bills, a House measure that ran to 1,990 pages and a Senate version of 2,074, not counting 383 pages of last-minute changes. The biggest differences involve a dispute over a government-run insurance option — the House wants one, but the Senate bill omitted it — as well as the size and extent of federal subsidies to help lower-income families afford coverage.
Bypassing a formal conference committee enables Democrats to omit time-consuming procedural steps in the Senate and prevents Republicans from trying to delay the final negotiations.
Under Senate rules, three separate votes are required before negotiators for the two houses may hold a formal meeting. While the three normally are agreed to within seconds, each may be filibustered, and Democrats would then have to produce 60 votes to cut off debate.
Additionally, Republicans would have the right to demand votes on nonbinding proposals once negotiators for the two houses were appointed. That could, in turn, require Democrats to vote on political controversies such as wiping out the legislation's proposed cuts in Medicare, the type of issue that could easily be turned into attack ads in next fall's campaign.
Congress plans no formal sessions until Jan. 19, but Pelosi intends to meet this week with key committee chairmen and other leaders, and a separate meeting is also planned for members of the rank and file.

House Democratic leaders forbade debate on all but one amendment not authored by themselves. The Senate Finance Committee killed a GOP amendment that would have required Demcare to be available online for 72 hours before the committee voted. Reid and his Volterra-style henchmen cut last-minute cash-for-cloture deals behind closed doors.

First, in case you haven't heard, Nebraska Democrat, Senator Ben Nelson has caved in his opposition to the Senate Health Care bill. Nelson's surrender paves the way for Senate passage of the bill sometime this week. Tomorrow morning I am headed to Omaha, Nebraska to headline a rally later in the day demanding Senator Nelson switch his vote back to NO.
The rally will be held at the Omaha Music Hall, 17th and Capitol. Doors open at 2 PM. Rally starts at 3 PM.

DeMint Promises to Delay Health Bill, Force Christmas Eve Vote
Any with even a shred of common sense realizes that if you have to force Senators to stay in Washington DC to twist their arms and bribe them… before they can go home to their constituents knows this ObamaCare Bill that Harry is pushing is another fraud and theft bill against the American People.
STOP REID and SUPPORT DeMint – Contact your Republican Senators and ask them to do whatever it takes to delay this vote. Have the entire bill read on the floor and then ask for it read again by quested sections. And then thank them for giving up their Christmas with their families. And then contact every Democratic Senator and keep contacting them to VOTE NO on ObamaCare or just go home before the vote. Sen. Jim DeMint said Thursday he is prepared to use every procedural tool to delay a vote on the Democratic healthcare legislation.
Senate Majority Leader Harry Reid (D-Nev.) is planning to schedule votes around the clock over the next week to meet a deadline of passing the bill by Christmas. Without the cooperation of Republicans, the marathon schedule would end with a vote on Christmas Eve.
Reid hopes that Republicans will waive some of the procedural formalities so senators are not forced to spend the evening before Christmas milling about the Senate floor.
But DeMint (R-S.C.), chairman of the Senate Republican Steering Committee and a leader of the conservative opposition, told The Hill he will not yield back any time.
DeMint also said he would force the Senate to return to Washington after Christmas to vote on a $290 billion increase to the federal debt limit. Treasury officials told lawmakers that they need an increase of borrowing authority to keep the government solvent beyond Dec. 31
“I’m not going to waive any time,” DeMint said in an interview, when asked whether he would force Reid to go late into Christmas Eve to pass healthcare legislation. “I think it’s our responsibility to stretch this out because every day we do we have time to tell Americans what’s in it."
DeMint said Democrats hope “they can pass it before Americans know what’s in it, while people are thinking about Christmas and being with their families.”
Senate Democrats concede that they will have to return to Washington between Christmas and New Year’s Day to pass the increase in the federal debt limit if a single GOP member objects to expediting that vote. DeMint made clear he will not cooperate. “We’ll be back here the day after Christmas if Democrats want it,” said DeMint.
Reid is just as adamant about passing the healthcare bill before Christmas, a deadline Senate Democrats have talked about for weeks.
“We’re going to finish this healthcare bill before we leave here for the holidays,” Reid said on the Senate floor Thursday.
To meet that goal, Reid has tentatively scheduled a 1 a.m. vote Friday to cut off debate on the defense-spending bill, which also includes an extension of unemployment benefits and COBRA subsidies for people who have lost their jobs. If the Senate votes to quash the filibuster, lawmakers would proceed to final passage after 30 hours of post-cloture debate, or at 7 a.m. Saturday, according to Democratic sources briefed on the plan.
For the Senate to pass healthcare reform by Christmas, as Reid has pledged, the Senate leader would then have to file take a series of necessary procedural steps that would force votes all week at odd hours.
Reid must file motions to end debate on: the manager’s amendment, which includes all the final-hour changes made to win the support of 60 Democratic senators; the 2,074-page healthcare bill, which lawmakers have been debating on the floor; and on the underlying legislative vehicle, the Service Members Home Ownership Tax Act.
Republicans may force Senate clerks to read the entire manager’s amendment but that will not disrupt the schedule. That’s because reading the amendment, which will be shorter than the 2,074-page healthcare bill, is not expected to take more than eight hours.
Reid could offer the manager’s amendment on Saturday morning and keep to his schedule as long as he files cloture sometime before midnight.
Cloture motions need one day to ripen, so the earliest the Senate could vote to end debate on Reid’s manager’s amendment would be 1 a.m. Monday.
Democrats would have to allow 30 hours of post-cloture debate to elapse before voting to approve the manager’s amendment. A second cloture vote to end debate on the initial healthcare bill would happen as early as 7 a.m. Tuesday, followed by another 30 hours of post-cloture debate before a vote to adopt that amendment to the underlying bill.
Democrats would then have to repeat the same process on the third motion to end debate on the underlying bill, setting up a cloture vote at 1 p.m. Wednesday.
At any time, the chamber could move up a final vote if every senator agrees. But if a single senator objects, the earliest a final vote on the final package could take place would be 7 p.m. on Christmas Eve.
And if Republicans object to fast-tracking the increase in the federal debt limit, as DeMint has threatened, the Senate would be forced to return the following week.
Senate Budget Committee Chairman Kent Conrad (D-N.D.) said Treasury Department officials have informed him that the administration needs new borrowing authority by Dec. 31. Conrad said the administration may be able to extend the deadline for a short time because of loan repayments it has received from Citigroup and other banks.
Conrad said Thursday he expected a Christmas Eve vote to pass the healthcare bill.

The Senate began debating President Obama's health care takeover plan this week. Most of the attention has been placed on several swing-vote Democrats who might oppose the bill. But with the exception of Sen. Joe Lieberman (D-CT), these Democrats will likely find an excuse to support it.
Senators Ben Nelson (D-NE), Mary Landrieu (D-LA), andBlanche Lincoln (D-AR) cannot be counted on to do the right thing. They have made up their minds to vote for the bill if necessary and just need an excuse. If Sen. Lieberman holds firm, President Obama will need one Republican to cross the aisle to provide the 60th vote needed to invoke cloture, cut off debate, and pass the bill.
Sen. Olympia Snowe (R-ME) is the Republican most likely to support the bill. She voted for it in committee and is currently working to make small changes that could be used to justify her support. Sen. Snowe voted against the bill before Thanksgiving so it's very important for Americans to thank her for that vote and encourage her to be strong.

We have just learned that Senate Democrats are in final preparations to unveil their healthcare "hammer" to get ObamaCare passed.
The "hammer" is the new public option compromise being worked out -- again behind closed doors -- that puts the government-run public option plan under the direction of a "non-governmental board."
As if we are to believe this is an improvement! The "hammer public option" would be imposed immediately in every state that does not meet the ObamaCare guidelines. In addition, Reid and the Democrats have gotten so desperate to pass ObamaCare prior to Christmas that we now have positive confirmation that the "nuclear option" is still a looming threat. (The "nuclear option" would only require 50 votes to pass ObamaCare instead of the 60 votes now needed to end debate on the Senate floor.)
Sen. Ben Nelson acknowledged that in an op-ed. He feared failure to cast a vote to proceed would move Reid to use the "budget reconciliation" nuclear option.
With the "hammer" coming and the very real threat of the nuclear option on the table, we are almost guaranteed a vote on ObamaCare in the Senate before Christmas.

The "health-care reform" bills in Congress would hit 39 states hard with new expenses, by raising Medicaid eligibility above the cur rent income cutoffs.
The only states that won't have to raise eligibility because of the Senate bill are Connecticut, Illinois, Maine, Massachusetts, Minnesota, New Jersey, New York, Rhode Island, Tennessee, Vermont and Wisconsin (plus the District of Columbia). And the House bill would force even Massachusetts and Vermont to pay more.
Hardest hit would be Texas ($2,750 million a year in extra state spending under the Senate bill), Pennsylvania ($1,450 million), California ($1,428 million) and Florida ($909 million). Who knows if Florida could avoid imposing an income tax if it has to meet so high an unfunded mandate?
The required increases in state spending are likely to be quite high in some states whose senators are swing votes on ObamaCare:
* In Arkansas, home to swing Sens. Mark Pryor and Blanche Lincoln, the annual increased state spending would come to $402 million (not counting the federal share) -- about a 10 percent increase in the state budget, which is now $4 billion a year.
* In Louisiana, whose Sen. Marie Landrieu sold her vote on a key procedural motion in return for more Medicaid funding, the increase would come to $432 million (a 5 percent hike in state spending) -- more than wiping out the extra funds she got in return for her vote.
* In Sen. Evan Bayh's Indiana, spending would go up by $586 million a year, a rise of 4 percent.
* In Sen. Ben Nelson's Nebraska, the added state spending would be $81 million a year, a 2 percent increase.
The Sebate ObamaCare bill would cost North Dakota, home of Sens. Kent Conrad and Byron Dorgan, $14 million. South Dakota, represented by Sen. Tim Johnson, would have to boost Medicaid spending by $33 million.
The Medicaid-expansion provisions of the Senate bill are complex. In the first year of the program (2013), states must enroll anyone who earns less than 133 percent of the poverty level in their programs.
For a family of four, the national average poverty level in 2009 is $22,000 a year. So any family that size that makes less than $29,000 would be eligible for Medicaid.
Many states, particularly in the South, actually have Medicaid cutoffs below the poverty level. Arkansas, for example, cuts off its Medicaid eligibility at only 17 percent of poverty level, and in Louisiana it goes up to only 26 percent. For these states, the spending increase required by the new bill is huge.
For the first three years of the program (2013-15) the federal government would pay for all of the costs of the Medicaid expansion. But, starting in the fourth year of operation -- 2016 -- the average state would be obliged to pay 10 percent of the extra cost.
For Democratic governors, this provision means sudden death. Particularly in states with limited Medicaid coverage, it would require huge tax increases.
Harry, Pelosi, Obama... the Dems are lying to you. The price, overall cost to you and amount added to America's debt if ObamaCare passes, in any form, will be outrageous and your quality of care will go down!!
If deals have to made behind closed doors, if addendums, deals and amendments have to be hidden from the citizens and if Senators are allowed to be bought off and bribed for their votes with millions and billions of our, your, tax payer money... there is something wrong with the system, the government, the leadership and the bill.

Should senate pass $849 Billion health care reform package?
Harry Reid unveiled his $849 billion health-care bill tonight. It weighs in at 2,074 pages. Keith Hennessey runs through the tax hikes in the bill:
The following is from the Joint Tax Committee estimate of the revenue effects of the Reid bill. I have listed provisions with major revenue effects (+$20 B / 10 years) and a few others that have significant policy or political impacts. There are some smaller changes as well, which you can see for yourself in the 3-page document. All revenue figures are revenues raised over the ten-year period 2010-2019.
1. 40% excise tax on health coverage in excess of $8,500 (individuals) / $23,000 (families). Amounts are indexed for inflation by CPI-U + 1% – begins in 2013 – $149 B tax increase
2. Additional 0.5% Medicare (Hospital Insurance) tax on wages in excess of $200,000 ($250,000 for joint filers) – begins in 2013 – $54 B tax increase
3. Impose annual fee on manufacturers and importers of branded drugs – begins in 2010 – $22 B tax increases
4. Impose annual fee on manufacturers and importers of certain medical devices – begins in 2010 – $19 B tax increase
5. Cut in half (to $500K) the amount of an executive’s compensation that a health plan can deduct from its corporate income taxes – begins in 2013 – $600 million tax increase
6. Impose 5% excise tax on cosmetic surgery and similar procedures – begins for surgery in 2010 – $6 B tax increase!
In total the bill would raise taxes by $370 B over ten years.
Analysis on the tax hikes from Hennessey at the link. Reid has decided to raise the Medicare payroll tax on individuals making more than $106,800; perhaps not the smartest way to boost employment.
The CBO report says the bill would save $127 billion over 10 years--but as Allahpundit notes "$127 billion over 10 years sounds like a lot until you remember that $176 billion was October’s monthly deficit." We still haven't gotten a look at the CBO report to see just how bad the Medicare cuts will be [Update: The CBO (download here) reports Medicare will be cut by $491 billion over 10 years], but tell grandma and grandpa not to worry: Under this bill they'll get $500 in 2010 when Harry Reid just so happens to be up for reelection.
The bill also allows taxpayer-funding for abortions through the public health insurance plan and the health insurance exchanges; the language is similar to the Capps amendment that tried to conceal federal funding of abortion through an accounting gimmick (see here). National Right to Life Committee calls the amendment "completely unacceptable."
Senator Mitch McConnell said in a statement: “This bill has been behind closed doors for weeks. Now, it’s America’s turn, and this will not be a short debate. Higher premiums, tax increases and Medicare cuts to pay for more government—the American people know that is not reform.”

Do not let anyone tell you that ObamaCare in inevitable!! Yesterday’s wins for Republicans in New Jersey and Virginia and narrow loss, only due to technicalities for the Conservative Independent in the NY-23 Congressional Race prove it and put the program in ever greater peril.
Chris Christie's gutsy win in New Jersey puts the arrogant big spender Jon Corzine in his place. But it is the election in Virginia that probably has more to say to marginal Democratic congressmen considering how to vote on health-care reform.
Obviously, Christie's victory is a body blow to Obama after Corzine outspent the Republican by five-to-one and the president put on a serious push for the incumbent. Corzine's defeat sends a message that the nation is moving sharply against Obama.
But Virginia results are the most important. More than 80 Democratic congressmen and 20 senators come from states that John McCain carried in 2008. For them, the sudden switch in Virginia, a swing state that Obama actually carried, heralds tough political times ahead.
New Jersey is the quintessential blue state. If it goes Republican, blue state congressmen needn't worry. Their districts are likely still safe. But when a Republican in Virginia wins by 20 points, it sends a message to red-state Democratic congressmen to take cover.
Polls indicate a declining level of popular approval of the Obama policies (Rasmussen shows his job approval at 46 percent), but to see actual Democrats losing or barely squeaking out victories in solidly blue states sends a far clearer message to the Democrats in Congress.
Until last night, Democratic moderates, the so-called blue dogs, could bask in the light of their candidate's success in 2008. But now they must hear hoof beats behind them. The party discipline on which Obama depends to pass a health-care program that Americans reject by 42 percent for, 55 percent against (Rasmussen again) will only work if beleaguered Democratic incumbents can wrap themselves in Obama's cloak and tough out the popular criticism. But the limits of Obama's drawing power are readily apparent in the Republicans' 20-point victory in Virginia and the race in New Jersey.
In the coming weeks, House Speaker Nancy Pelosi and Senate Majority Leader Harry Reid will be asking their troops to cast potentially career-ending votes for health-care changes, Medicare cuts, higher taxes and fines on the uninsured. Whether they take that risk depends on their faith in Obama's drawing power.
But the votes in Virginia, in particular, show the limits of Obama's appeal. The winner, Bob McDonnell, won the attorney general's race in the last election by a few tenths of a percent over the same opponent. That he coasted to so huge a victory in the swing state of Virginia now has to send a message to red-state Democratic congressmen: Obama may be able to survive in the deep water into which he is leading his party, but you can't.
There were a coupe great interviews by Judge Napolitano and a surgeon and author (The Awakening of a Surgeon), David H. Janda, a representative from the Heritage Foundation earlier today, as well as with Rep Michele Bachmann… will update this when those become available.

In a new survey 45% of physicians say they will leave medicine if ObamaCare passes… add that to between 15 and 30 million additionally insured and you have doctor and quality of healthcare shortages and resources… which means inferior healthcare, rationing (death panels by another name) and there will be cost and tax increases.

A Federal Coordinating Council (presently 15 members) and a National Coordinator having access to mandatory records or everyone’s health and financial records and having the power to give the final word on your healthcare (death panels) is already in place. It was planned for and snuck into the Stimulus Bill. No conspiracy? No larger takeover agenda? Transparency?
3. Obama still has hundreds of open government positions that he has never filled; some because they have chosen to appoint radical czars instead that require no confirmation and answer to no one… but partly, they say, because of lack of time… But there has been time to appoint these 16 people to a council that nobody knew existed and will only come into play if allow ObamaCare (or any form of government controlled healthcare) to pass.
4. Why are so many doctor planning on leaving medicine if this passes? Because this plan and withholding care is against their Hippocratic oath.
5. ObamaCare/PelosiCare/HarryCare will require everyone to purchase health insurance (ultimately from the government); which is unconstitutional.
6. There are rumblings that energy legislation and student loan legislation will be attached (snuck through) with ObamaCare… both power grab and tax measures!!!
7. AARP just openly supported the PelosiCare Bill. For any seniors who were still hanging onto some crazy belief that AARP was supporting you… this should be the final sign you need!
8. Everything they kept telling us all summer that wasn't in the bill is in there... or has already been put in place.
9. Every Democratic President(American Progressivism) has tried to put though or extend some form of government HC. To help the American People?? Think Again!!
Get to Washington DC tomorrow at noon or anytime this week and confront your congressman, Senator and Nancy Pelosi and Harry Reid. If you can’t get there, rally at your representative’s local office and flood Congress and reps and Sen local offices with calls all week and especially between noon and 1PM. Follow up with faxes, emails and snail mail letters!! Tell them: "Keep you hands off my healthcare and uphold the Constitution".

America has 3-days to figure out that there is nothing about ObamaCare (PelosiCare or HarryCare) that has anything to do with healthcare reform or anything to do with helping the American people, cutting costs, improving care or in insuring everyone. It is all about controlling more of the American Economy that used to pretty much be part of the private sector and grabbing power… Please, wake up America… this bill is one of those Liberty or Tyranny moments as Rep Bachmann said and as the House Minority Leader, John Boehner is warning us about.
If you can possible do it… get to Washington D.C. Thursday and meet at the Capital steps at noon… or go for Wednesday and Thursday November 4th & 5th.
Did you know that approx 800 additional pages in pork and amendments will be added to that bill before the vote?
Did you know that the GOP has present 50-alternative healthcare bills that were not even considered; the Dems have locked out the GOP from and any deliberation on this bill and the White House has refused to meet with any Republicans, even the trained doctors in the House and Senate, since last Thursday? Then, over the weekend they were told they could now present an alternative before the vote…? Yah Right…

The HC Bill has been online since last Thursday nite and reviews of what is in that bill are everywhere… and it isn’t good for America, for you or your family.
See you in Washington DC on Thursday… If you can’t, gather in protest at your representative or Senator’s local office and/or please flood the capital switchboard all week and especially between 11:45 and 1:00PM on Thursday. Then back up those calls with calls to your Congress people’s local offices and emails and faxes to both offices.
The only people who are telling you that there are good things in this bill or program are people who haven’t read the bill or have drunk from the Progressive Liberal Kool Aid…
Message to Congress:
“Hands off our Healthcare! We will work to unseat or impeach everyone who votes for ObamaCare!!
Junk this entire bill and we will start over after the 2010 or 2012 Elections with bipartisan and real reform!!
Stand-up America. Someday your children, grandchildren and great-grandchildren will ask you what you were doing when this was going!?!

Today’s edition of the Wall Street Journal has a scathing editorial of the legislation introduced by Speaker Pelosi. It notes the creation of a new ‘Health Choices Commissioner’ that will decide “essential benefits” which all insurers will have to offer. This sounds like something straight out of Aldous Huxley’s, A Brave New World or George Orwell’s, 1984.
