It’s Official: The IRS Will Raid Your Tax Data Through Obamacare

“Surprise, Surprise, Surprise!” as Gomer Pyle used to say… except for those who read the bill… and exactly why they have been working so hard to wake America up.

IRS Obamacare Personal Data

So, it is official, the IRS will be getting personal data from the healthcare exchanges in order to help it implement Obamacare… And as Americans continue to be corralled into a government-mandated healthcare plan, it will be even more difficult to protect personal data.   (AP Photo/J. David Ake, File)

The Blaze: The Internal Revenue Service this week will publish a final rule requiring Obamacare health insurance exchanges to hand over key personal data to the IRS, which will use the information to implement the tax aspects of the controversial health care law.

The IRS rule covers health exchanges that sell insurance to individuals, and it takes effect this year. That means people enrolled in an Obamacare exchange this year will have their information given to the IRS as soon as it’s needed for tax purposes.Information to be handed over from Obamacare exchanges includes names, addresses, taxpayer identification numbers, insurance premium amounts, the name of the insurance issuer, and the insurance plan policy number issued by the exchanges.

The IRS says this data is needed to assess whether people are eligible for a health insurance tax credit. “This tax credit can help make purchasing health insurance coverage more affordable for people with moderate incomes,” according to the IRS.

The rule is being published amid ongoing concerns about data security, and after the troubled launch of the healthcare.gov website that exposed many technical glitches. Those issues have some worried that the personal data people give to the exchanges will be at risk.

House Republicans have passed a few bills aimed at addressing this potential problem. In January, for example, the House passed the Exchange Information Disclosure Act, which would require the government to tell people whenever their personal information has been compromised.

Republicans have also passed legislation requiring weekly updates from the administration on how the law is being implemented, including details about website glitches.

So far, however, only the House has passed these bills, and the Senate has not given any indication it will consider them.

The final IRS rule follows draft regulations that were issued last summer. Those rules were put out for public comment, and the final rules to be published this week were tweaked in some ways in response to those comments.

But the IRS also ignored some requests to alter the rule. For example, the draft rule said exchanges must tell the IRS whether a person enrolled in an Obamacare plan by a taxpayer is that taxpayer’s dependent. The commenter said the IRS should have that information, and that it therefore doesn’t need to be reported.

But the IRS said it would not change this rule.

“The final regulations do not adopt this comment because information the IRS provides as part of the verification process is from the taxpayer’s most recently filed tax return, which may be two years old,” the rule states.

The final IRS rule is due to be published on Wednesday.

If You Vote for Congressmen Who Support Obamacare, You’re Voting for Obamacare

Canceled Policies Senators3

By Jedidiah Noble – Independent Sentinal Originally posted November 13, 2013

Many people were angry with Justice Roberts when he declared Obamacare constitutional and I was one of them. He furthered angered the right with these quotes:

“We do not consider whether the Act embodies sound policies. That judgment is entrusted to the Nation’s elected leaders.”

“Members of this Court are vested with the authority to interpret the law; we possess neither the expertise nor the prerogative to make policy judgments. Those decisions are entrusted to our Nation’s elected leaders, who can be thrown out of office if the people disagree with them. It is not our job to protect the people from the consequences of their political choices.”

Now I have to say that he was right. If we want to change the law, we have to vote the Obamacare politicians out of office. We cannot rely on the Supreme Court of the United States, it is not their job.

We, the American people, voted for Obamacare, not once, but repeatedly by electing and re-electing politicians who support Obamacare. We did it here on Long Island when we re-elected congressmen Tim Bishop, Steve Israel, and Carolyn McCarthy, among others. Virginia did it when they recently elected Governor-elect McAuliffe. In fact, McAuliffe ran on Medicaid expansion and Obamacare. He took the election as a referendum for both.

Debbie Wasserman-Schultz said Democrats will be able to run on Obamacare in 2014.

Will they?

We should be most mindful of the 12 Senators who voted for Obamacare, any one of them could have stopped the law which passed with 60 votes.

We voted for them as Justice Roberts indicated.

Consider the words of Nancy Pelosi, “…but we have to pass the bill so you can find out what’s in it, away from the fog of the controversy”:

Video: Nancy Pelosi Pass the Bill to find out what's in it

Despite this, we voted for Obamacare by electing these politicians who did not read the bill and did not know what was in the bill.

Will we do it again?

The following are the names of the Senators who cast decisive votes for Obamacare. If you vote for them again, you are voting for Obamacare. There is no other way to look at it. If you don’t want Obamacare, you cannot vote for these Senators:

Mark Begich, Alaska; Dick Durbin, Illinois; Al Franken, Minnesota; Kay Hagan, North Carolina; Mary Landrieu, Louisiana; Jeff Merkley, Oregon; Mark Pryor, Arkansas; Jack Reed, Rhode Island; Jeanne Shaheen, New Hampshire; Mark Udall, Colorado; Tom Udall, New Mexico; Mark Warner, Virginia.

These senators are now scrambling for cover and looking for ways to make it appear as if they didn’t support what they wholeheartedly supported – The Affordable Care Act. They were given multiple opportunities by the House to adjust the bill in the past three years and they refused.

Mary Landrieu is putting through a bill now that will supposedly allow people to keep their present coverage as President Obama promised. It is co-sponsored by Obamacare supporter, Dianne Feinstein, whose state now has 1 million people losing their insurance.

Mary Landrieu has been an ardent supporter of Obamacare from day one. She flew on Air Force One with Mr. Obama two weeks ago but made certain she was not photographed with him.

Are you going to fall for their ploys?

These people do not have our best interests at heart. They wanted to support Mr. Obama, not us. They do not deserve to be our representatives.

Make no mistake, a vote for them is a vote for Obamacare.

If you vote for them again, you will get what you deserve and Justice Roberts would agree.

Let’s not forget the representatives in the House who voted for Obamacare? Click here to find out if your congressmen was among them.

As an aside, healthcare.gov won’t be ready by December 1st as promised by Mr. Obama. Jay Carney said it will be ready for a lot of people. They plan to put peoples’ personal and financial information at risk on a site that is somewhat working.

Examiner Editorial: Why does Nancy Pelosi fear an Obamacare inspector general?

“Now that a Democrat works in the Oval Office and is responsible for the biggest federal entitlement program ever created, Pelosi thinks an IG is unnecessary.”

House Minority Leader Nancy Pelosi: " Each of the committees of jurisdiction has oversight, so the congressional oversight is something that I support. Each of the agencies of government that are implementing the law, the Affordable Care Act, have their own inspectors general. I think that the system has enough appropriate oversight. I don't see any reason to go to that point." (AP/Pablo Martinez Monsivais)

Washington Examiner: Among the least-heralded public servants in the nation's capital are the 73 inspectors general established by Congress to root out waste, fraud and inefficiency in the executive branch. With teams of thousands of auditors and inspectors, the IGs issue hundreds of investigative and audit reports that send a steady parade of crooks to jail while saving taxpayers hundreds of billions of dollars every year. Unfortunately, it's doubtful that one out of 100 Americans could name a single IG.

That anonymity is a key to their success, however, because it helps keep the focus on the job at hand and away from political considerations that can derail the pursuit of justice. So it's particularly disappointing to see House Minority Leader Nancy Pelosi blatantly playing politics with the imminently reasonable proposal of Rep. Peter Roskam to create an IG for Obamacare. The Illinois Republican announced his proposal Thursday, and no sooner had he done so that Pelosi made clear her opposition to it.

Asked about the Roskam proposal at her daily news conference, Pelosi said: “No. Each of the committees of jurisdiction has oversight, so the congressional oversight is something that I support. Each of the agencies of government that are implementing the law, the Affordable Care Act, have their own inspectors general. I think that the system has enough appropriate oversight. I don't see any reason to go to that point.”

Of course, there are oversight committees of Congress for all 73 of the departments and agencies that presently have IGs, but none of those federal entities control one-sixth of the U.S. economy or trillions of dollars in federal spending. So why would Pelosi be opposed to an Obamacare IG?

Roskam found the likely answer in Pelosi's position on previous proposals to create IGs. He noted that Pelosi enthusiastically supported creation of IGs for the U.S. war efforts in Iraq and Afghanistan, as well for the Toxic Asset Recovery Program, the federal relief effort to victims of Hurricane Katrina and the intelligence community. Perhaps its merely coincidental, but every one of those IG proposals came when a Republican president was in the White House. Now that a Democrat works in the Oval Office and is responsible for the biggest federal entitlement program ever created, Pelosi thinks an IG is unnecessary.

Pelosi was speaker of the House when Congress approved the $700 billion Wall Street bailout in 2008 with a Special Inspector General for TARP. As Roskam pointed out last week, the SIGTARP has since “identified $5.3 billion in restitution and savings, including $533 million in direct taxpayer savings. In comparison, the healthcare law is estimated to cost $1.8 trillion when fully implemented, dwarfing TARP's cost to taxpayers.”

It was also Pelosi who famously said of Obamacare that “we have to pass it so you can see what’s in it.” Remember, too, that Obamacare was written behind the closed doors of Pelosi’s office. Could it be there’s something in Obamacare that she fears an Obamacare IG will expose?

Harry Reid: Obamacare 'Costs Me About $4,500 More'

Image: Harry Reid: Obamacare 'Costs Me About $4,500 More'

NewsMax: President Barack Obama may have famously promised his signature healthcare plan would cost consumers less money — but Senate Majority Leader Harry Reid, D-Nev., is proof that it's often not true.

"Under Obamacare, my insurance costs me about $4,500 more than it did before," Reid told the Reno Gazette Journal. "Yes, because it is age-related and it wasn't like that before."
Reid, while noting that 150 million families get insurance through their employers, "so should all federal employees."

Reid's comments came while he denied a CNN story claiming he is the only top congressional leader to exempt some of his staff from having to buy coverage through the Obamacare exchanges.

"I followed the Affordable Care Act,” Reid said. “It is the law. The law says that if you have committee staff, leadership staff, they stay where they are. If you have other staff, which is most everyone, they go to the exchanges."

Reid is worth $2.8 to $6.2 million, according to an OpenSecrets.org report, so he would not qualify for subsidies that would lower his Obamacare insurance costs.

But his rate hike is an eye-opener after promises made by people like House Minority Leader Nancy Pelosi, who told Meet the Press last year that "everybody would have lower rates" under Obamacare.

And the healthcare rate increases under ObamaCare have been eye-openers for not only the rich, but for many in the middle class and after all is said and done there will be as many uninsured Americans as before only now the government controls one sixth of the U.S. budget through healthcare as well as everyone’s healthcare options.  Wake-up America, the outcome of the next two elections will be the only chance to change this.  Time to oust the Harry Reids, Nancy Pelosis and Barack Obama’s

Pelosi denied to The Weekly Standard in a later report that she'd made the statement, saying she doesn't "remember saying that everybody in the country would have a lower premium."
But a study earlier this year by two members of the American Academy of Actuaries found that tens of millions will see higher insurance costs, reports Forbes, with or without the subsidies — and just like Harry Reid.

Vatican Court: No Communion For Nancy Pelosi

JoshuaPundit: The Supreme Tribunal of the Apostolic Signatura in Rome, the highest court at the Vatican has ruled that House minority leader Rep.Nancy Pelosi should not receive communion as a Catholic until she changes her advocacy of abortion on demand.

Cardinal Raymond Leo Burke, the prefect of the Supreme Tribunal said that Pelosi should be denied communion because she is not in a state of grace.

The Cardinal cites Canon law 915 which states that Catholics who are continue to openly continue “in manifest grave sin are not to be admitted to Holy Communion.”

Cardinal Burke said Mrs. Pelosi fits the definition.

“Certainly this is a case when Canon 915 must be applied,” he said, the Western Center for Journalism reported. “This is a person who obstinately, after repeated admonitions, persists in a grave sin — cooperating with the crime of procured abortion — and still professes to be a devout Catholic.”

“This is a prime example of what Blessed John Paul II referred to as the situation of Catholics who have divorced their faith from their public life and therefore are not serving their brothers and sisters in the way that they must — in safeguarding and promoting the life of the innocent and defenseless unborn, in safeguarding and promoting the integrity of marriage and the family,” he said.

In other words, Cardinal Burke is calling Rep. Nancy Pelosi a class A hypocrite.

I am not a Catholic, but I can't help but reflect on the justice of this. Not only is Nancy Pelosi an outspoken advocate of abortion on demand, but she also is a strong proponent of taking away the religious freedom of Catholics and Catholic institutions who do follow Church law in this matter by forcing them to subsidize abortions and abortificants under the diktats of ObamaCare. So not only is she involved in what the Catholic Church considers sin itself, but in attempting to force others into sin.

I'm not sure Rep. Pelosi even goes to confession and receives communion, but she has repeatedly referred to herself as a 'devout Catholic'. She's gotten away with that lie for years, unchallenged. This should destroy that, and I would hope that if it continues to persist, the Church would proceed to excommunication.

September 20, 2013 - Nancy Pelosi Very Angry After ObamaCare Defunded in House… Too Bad She Wasn’t This Angry About Fairness, the Constitution and the Role of Congress When She and Harry Reid Forced ObamaCare on America!

And Here’s Nancy just yesterday

Video: Boehner Video 'Mocks' President Obama for Negotiating with Russia, Not Republicans

*The House of Representatives finally listened to the people and passed their stopgap funding bill (today) Friday to keep government open while terminating the new healthcare law, setting up a final showdown next week with Senate Democrats and President Obama who have firmly rejected that.

The 230-189 vote, which split almost exclusively along party lines, is the precursor to the big action next week, when the Senate is expected to strip out the health care provisions and send the bill back to the House — where Republicans will have to decide whether they can accept it at that point.

All sides are racing a Sept. 30 deadline, which is when current government funding runs out. The new measure would fund the government through Dec. 15, essentially at last year’s levels, and would leave the budget sequesters in place.

(Excerpt) Read more at washingtontimes.com ...

Rep. Michele Bachmann:

Washington, D.C. -- Congresswoman Michele Bachmann released the following statement after voting for a continuing resolution to defund ObamaCare and keep the government open.

“Today the House of Representatives listened to the will of the American people and voted to keep the government open while defunding ObamaCare. The President’s health care law is hurting economic growth, causing cutbacks in jobs and hours, and jacking up insurance premiums. We must save the American people from these disastrous consequences of ObamaCare while still keeping the government open. Even President Obama’s Big Labor allies are trying to exempt themselves from ObamaCare, declaring it will hurt the middle class and erase the 40-hour work week. ObamaCare is completely unworkable and deeply unpopular, and I will continue fighting until this train wreck is defunded once and for all so we can start over with free market, patient-centered health care reforms."

###

Please educate yourself and others and don't be fooled by the mainstream media spin that is coming. Former Speaker, Nancy Pelosi, who refused to work with the Republicans during the ObamaCare creation cycle, has already been spinning all afternoon!, actually for two days now!! The House has passed a budget bill 'with funding for everything' that our government needs to function, except ObamaCare, a program that will ultimately bankrupt us and destroy our quality of healthcare. The Administration will do everything to point the finger and push blame for shutting down our government on the Republicans (GOP). Don't be fooled, the only way the government gets shut down is if President Obama and his puppet Harry Reid cause it. The House "and the so-called bad negative Republicans" have passed a full budget bill while creating a way to open discussion on compromise and to make improvements on ObamaCare", not shutdown the government. It will be President Obama and the Democrats who chose to shut down the government, if that happens.

The goal is and always has been to force businesses to dump their employees into the ObamaCare Exchanges; ultimately creating a single payer system… Socialized Medicine! But not for the elite… Congress, Judges, the Executive Branch Employees, federal employees as a whole, friends of the elite and the Progressive system and the rich will have great healthcare, as good or better than they have or had before, but the average American They will be forced into socialized medicine run by government officials where they, and not the doctors  and health professionals, make decisions on treatments and treatment qualification… while 30-Million of the poor will still not have healthcare. But you can bet that illegal aliens and their kids will.

The unions finally figured that out and began speaking up… But last week their leaders left the White House smiling after a private meeting; any guesses as to why?

ObamaCare will guarantee that there will be two classes… and ObamaCare has been written so that the government will be involved in every aspect of American life!  This opportunity, that the House Republicans fought for, might be the last chance for Americans to stand-up and fight against this.

Just this week, both Home Depot and the Cleveland Clinic, that Obama has used as an example for his side, have announced that they will be dumping employees, either into the exchanges or laying people off, to prepare for the implementation of ObamaCare.  So you be the judge~

And the Republicans… they do want to negotiate!!!!

Don't be played!!

52%+ of Americans polled want ObamaCare Defunded completely. 72% are not happy with ObamaCare (and the number is growing) and they want changes if the program remains law. 30-Million Americans will still be without healthcare after this expensive disaster goes into affect. And members of the Federal Government and their friends will not have ObamaCare as their healthcare system; they will retain their Cadillac plans.

Major change coming to Obamacare: Anyone who voted for or supported BO will receive an exemption

Conscience of a Conservative:  Obamacare, officially known as the Affordable Care Act, was written with explicit language that it was to include everyone. No exceptions. Even members of Congress and their staff were mandated to follow the same rules as every other American citizen. This was apparently done to appease the Republicans and get their support for the bill. Then just before the 2012 elections several unions who had endorsed and campaigned for Barack Hussein Obama began to receive exemptions from the mandatory requirements. Then it was disclosed that members of Congress were concerned that their highly paid staff members would be persuaded to leave their cushy jobs if they had to pay for their own health insurance, like everyone else. So our Great Leader issued a decree that made them exempt and the government would continue to provide their insurance. Now we read that 40,000 union members have quit the AFL-CIO because they don’t like the idea of having to pay for their health insurance.

40,000 Longshoreman Quit AFL-CIO Blaming ObamaCare

In what is being reported as a surprise move, the 40,000 members of the International Longshore and Warehouse Union (ILWU) announced that they have formally ended their association with the AFL-CIO, one of the nation’s largest private sector unions. The Longshoremen citied Obamacare and immigration reform as two important causes of their disaffiliation.

In an August 29 letter to AFL-CIO President Richard Trumka, ILWU President Robert McEllrath cited quite a list of grievances as reasons for the disillusion of their affiliation, but prominent among them was the AFL-CIO’s support of ObamaCare.

“We feel the Federation has done a great disservice to the labor movement and all working people by going along to get along,” McEllrath wrote in the letter to Trumka.

The ILWU President made it clear they are for a single-payer, nationalized healthcare policy and are upset with the AFL-CIO for going along with Obama on the confiscatory tax on their “Cadillac” healthcare plan.

What isn’t a surprise is that almost immediately after this announcement, some union leaders asked Obama to also exclude them from the mandatory coverage requirement. And it looks like they will get it. So what it all comes to is that the only people who will be forced to buy health insurance will be people who didn’t support or vote for Obama. In other words, Obamacare is really just a tax on Republicans.

In order to get Obamacare passed through Congress, then Democrat Speaker of the House Nancy Pelosi famously remarked, “You have to pass the bill before you can see what’s in it.” But even when the bill was being written it had parts added for the expressed purpose of persuading certain groups from opposing it. Like the powerful NRA gun lobby. Democrat Senate Majority Leader Harry Reid inserted a clause in ACA that reversed a previous order to have family Physicians inquire if their patients had a gun in their house.

Following the Sandy Hook Elementary School massacre, Obama issued his 23 Executive Orders to formulate Gun Control and one of those orders retracted the clause in Obamacare that Harry Reid inserted and once again, family doctors will be asking their patients if they own a gun. And since all medical records will be electronically stored and accessed by the government, anyone who admits they have a gun will be easily identified.

The true nature of Barack Hussein Obama’s government is becoming clearer and clearer every day. He admits he doesn’t need Congress to pass his laws, he can issue them by Executive Order. The Constitution is just an inconvenient piece of paper to him. He ignores and changes written laws to please himself and his friends and his supporters by issuing his Royal Decrees and Exemptions. It would not be surprising to learn he has a plan to remain in office after the end of his present term. And yes, there is a word for that, its called Dictator.

My name is Nelson Abdullah and I am Oldironsides.

Gun Advocates Celebrate 'Secret' Obamacare Provision Forbidding Exec Order To Regulate Guns And Ammo

Harry_Reid_official_portrait_2009_crop1Forbes -  Cross-Posted at AskMarion: A shot heard ’round the blogosphere, Vice President Joe Biden’s suggestion that the administration might bypass Congressional participation to regulate guns in favor of using the executive order produced the inevitable choirs of “I told ya so” as Biden’s sound bite appeared to provide the proof that Obama was, indeed, coming for your guns.

But this time, the gun advocates were ready with more than just angry recriminations.

Acting with an assist from CNN, right-wing bloggers and gun advocates in the know, let loose with a tidbit of information they have, no doubt, been long chomping at the bit to unleash—the revelation that there is already a law on the books that would prevent the government from making good on Biden’s tantalizing suggestion, a law that would actually prevent the government from collecting data on firearm ownership and more.

And what might that law be?

Obamacare…

That’s right—it turns out that there is, indeed, a provision buried deep in the thousands of pages that is the Affordable Care Act entitled, “Protection of Second Amendment Rights”. You’ll find it in Section 2716 part c of the Affordable Care Act although, to save you the trouble, I have re-printed the provision below for your perusal.

Certainly, one strains to imagine how anything touching on gun ownership, the Second Amendment, etc. could find its way into a health care reform bill just as it confounds the imagination to contemplate who might have been responsible for adding such a clause in the first place. Obamacare is, after all, primarily the creation of a President who gun advocates have long believed is out to strip them of their firearms—not to mention a law written, supported and passed by those in Congress identified as coming from the “far left” of the political spectrum under the leadership of Nancy Pelosi.

So, how did such a strange provision find its way into health care reform?

You might be surprised to learn that the language was offered in a Senate amendment proposed by none other than Senate Majority Leader, Harry Reid. While this news may come as a shock to those who view Reid as a leader of the left, politics will always trump ideology and—in the State of Nevada—politics dictates that running for office as a gun supporter is a way better idea than seeking office as a gun regulator. So, it should shock nobody that Senator Reid is a long-time gun rights advocate who has consistently counted upon the support of the NRA when running for election in his home state.

As for Reid’s reasons for burying a pro-gun measure into the body of the Affordable Care Act, the Majority Leader is said to have been concerned that the NRA planned to take an active position against the passage of Obamacare and decided, no doubt with the permission of Reid’s friend, NRA boss Wayne LaPierre, to head the problem off at the pass by putting language in the bill that would mollify the gun lobby.

Further, there was concern that a conspiracy theory then in circulation among right-wing circles—a meme suggesting that the Obama Administration had cleverly planted language in the ACA that could be used as a tool to get to the guns—would further erode public support for the legislation. For these reasons, Reid determined to insert some cozy language for the gun people into the Senate version of the ACA—language certain to escape public review at a time when the conversation was far more focused on hot button subjects like death panels, taxes and mandates.

For these reasons, the following language did, indeed, become a part of the nation’s controversial health care reform law:

(c) PROTECTION OF SECOND AMENDMENT GUN RIGHTS.—

‘‘(1) WELLNESS AND PREVENTION PROGRAMS.— A wellness and health promotion activity implemented under subsection (a)(1)(D) may not require the disclosure or collection of any information relating to—

‘‘(A) the presence or storage of a lawfully- possessed firearm or ammunition in the residence or on the property of an individual; or

‘‘(B) the lawful use, possession, or storage of a firearm or ammunition by an individual. ‘‘

(2) LIMITATION ON DATA COLLECTION.—None of the authorities provided to the Secretary under the Patient Protection and Affordable Care Act or an amendment made by that Act shall be construed to authorize or may be used for the collection of any in- formation relating to—

‘‘(A) the lawful ownership or possession of a firearm or ammunition;

‘‘(B) the lawful use of a firearm or ammunition; or

‘‘(C) the lawful storage of a firearm or ammunition.

‘‘(3) LIMITATION ON DATABASES OR DATA BANKS.—None of the authorities provided to the Secretary under the Patient Protection and Affordable Care Act or an amendment made by that Act shall be construed to authorize or may be used to maintain records of individual ownership or possession of a firearm or ammunition.

If you count yourself among those who object to any legislation or executive order that could limit or delay your ability to buy a flamethrower at the local gun show, this is certainly language that will put a smile on your face as this provision limits opportunities to collect and keep data on those who own firearms while creating some roadblocks when it comes to government’s ability to track whether or not you keep a weapon in your home, etc.

However, before you fire off a few rounds in celebration, you might want to take a good hard look at the actual draft of this section of the health care reform law because, unless you suspect that the President plans to put any newly proposed controls over firearms under the jurisdiction of the Secretary of Health and Human Services, I’m afraid you don’t really have much to celebrate.

The provision in question bars the HHS Secretary, anyone in the Secretary’s ‘chain of command’, and health professionals covered by this section of the ACA, from engaging in the collection of gun data through the ordinary course of the services they provide. By way of example, were someone to come into the emergency room for treatment of a nasty gunpowder burn, the attending physician would likely ask how the injury took place. When the injured answers by noting that something went wrong when firing his Bushmaster at the target range, this law prevents the physician, hospital or anyone else from feeding the information to a government data base and further prevents the HHS Department from collecting such data.

The law additionally prohibits the government from making the argument that, since guns can be deleterious to the health and wellness of people, it would be within the goals and objectives of the ACA to collect data on who has weapons in the effort to protect the health and wellness of of Americans. In other words, HHS cannot create a data base to collect info on guns under the theory that guns injure people’s health so they need to know where the guns are.

So, the good news for the gun folks is that the ACA is, indeed, prevented from being used as a weapon in the ‘War on Guns’ under the guise that guns are bad for people’s health. They can also take solace in the fact that the law prevents government from collecting any gun data resulting from information obtained in the course of medical providers doing their thing—much as HIPAA prevents such information from being used for a variety of purposes.

Beyond that, if you imagine that this obscure section of the Affordable Care Act is going to block the Administration from exercising whatever legal authority it may have to regulate guns in America, I’m afraid you will be quite disappointed.

I think all would agree that should the President resolve to use his executive powers to create a data base or any other regulatory provision, it is far more likely that such regulation would fall within the ambit of the Justice Department—not Health & Human Services—and nothing in the ACA prevents such data collection, or any other regulatory efforts, which would fall outside the limited jurisdiction created in Obamacare with respect to firearms.

So, to our friends at Breitbart and the others who believe they have discovered gold in their effort to prevent the administration from acting on its desire to bring sanity to our gun laws, I’m afraid you are going to have to reload as Obamacare is just not the magic bullet you are looking for.

The ObamaCare Document Stack Photo: Obamacare’s Regulations in One Giant Stack - 20,000 Pages Already

Any Question as to why we need to support the Paul Ryan Plan and Repeal or Defund ObamaCare?

Senator Mitch McConnell tweeted: #ObamaCare regulations - 828 pages in one day. Overall, there are nearly 20,000 pages – with many more to come… along with the photo of the document stack.

Yes, ObamaCare regulators added more than 800 -pages to an ever-growing document that will govern your healthcare. The bureaucrats’ work product now prints out to 20,000 pages — nearly eight times the length of the infamous original bill:

HotAir: That tower is already taller than Kobe Bryant, and much of the law hasn’t even gone into effect yet. According to the Government Accountability Office, Obamacare is projected to add $6.2 trillion to the nation’s long-term deficits, despite presidential assurances that it wouldn’t add a “single dime” to our red ink:

“This legislation is fully paid for, and will not add one single dime to our deficit.”

We’re also seeing more evidence that the healthcare law is killing jobs, as predicted by the Congressional Budget Office and Obamacare opponents alike:

The Federal Reserve on Wednesday released an edition of its so-called “beige book,” that said the 2010 healthcare law is being cited as a reason for layoffs and a slowdown in hiring. ”Employers in several Districts cited the unknown effects of the Affordable Care Act as reasons for planned layoffs and reluctance to hire more staff,” said the March 6 beige book, which examines economic conditions across various Federal Reserve districts across the country.

A former Obama adviser is now admitting that the law was never intended to be “a jobs program.” Funny, that’s not what Democrats told us while they were jamming it down our throats. I’ll leave you with Nancy Pelosi explaining how Obamacare is really all about creating millions of jobs and, er, reducing the deficit:

Video: Pelosi – “The Biggest Growth in Jobs” This Year…

Time for some common sense!!

Video: Paul Ryan: Our budget repeals Obamacare and the Medicaid ‘expansion’

Tax Prof: ObamaCare Tax Increases Are Double Original Estimate:

The Joint Committee on Taxation recently released a 96 page report on the tax provisions associated with Affordable Care Act. The report describes the 21 tax increases included in ObamaCare, totaling $1.058 trillion – a steep increase from initial assessment, according to the Tax Prof Blog. The summer 2012 estimate is nearly twice the $569 billion estimate produced at the time of the passage of the law in March 2010.

Stunner: ObamaCare-supporting Congressman suddenly not so sure you can keep your insurance after all

HotAir/Cross-posted at AskMarion:  Are you as shocked as Rep. Eliot Engel (D-NY)? Somehow, I rather doubt it, and I don’t think Jason Mattera is as surprised as the front-page pic suggests, either. Confronted with the new CBO analysis that shows more than seven million Americans will lose their present health-insurance coverage from ObamaCare despite his repeated assertions that no one would lose their coverage, Rep. Engel tells Jason in this Andrea Tantaros Show video debuting exclusively at Hot Air that Congress can always go back and fix what’s not working.

Funny — Jason doesn’t recall that being mentioned as an option, and neither do I:

Video: Surprise!  Rep. Eliot Engel Not So Sure About Oba…

Of course, Nancy Pelosi did tell us that we needed to pass the bill to see what was in it. How’s that working out for us? Not so hot, as it turns out, and it’s about to get worse for seniors in Medicare Advantage plans. Avik Roy reminds us that CMS helpfully postponed the deep cuts to the program until after the election so as to remove all of that messy accountability that politicians despise, and “the boom” is coming:

Though Democrats denied it during the 2012 campaign, Obamacare cut Medicare by $716 billion in order to partially fund $1.9 trillion in new entitlement spending over the next ten years. A big chunk of those Medicare cuts came from the market-oriented Medicare Advantage program. Cleverly, the Obama administration postponed the Medicare Advantage cuts until after the election, so as to persuade seniors that everything would be just fine. But the election is over. On Friday, the administration announced that it would be significantly reducing funding for the popular program. Obama’s proposal, according to one analyst, “would turn almost every plan in the industry unprofitable.”

Democrats have long been hostile to the Medicare Advantage program, which allows seniors to get their Medicare coverage through plans administered by private insurers. Today, more than a quarter of retirees get their coverage through Medicare Advantage, and the program has experienced rapid growth over the past decade. Richard Foster, the recently-retired chief actuary of the Medicare program, has projected that Obamacare’s cuts to Medicare Advantage would force half of its current enrollees to switch back to the old, 1965-vintage Medicare program. Robert Book and James Capretta estimate that this will cost enrollees an average of $3,714 in 2017 alone.

The new rates proposed by the Centers for Medicare and Medicaid Services, a.k.a. CMS, will have the net effect of reducing payments to Medicare Advantage plans by 7 to 8 percent in 2014, according to Citi managed care analyst Carl McDonald. “This includes the 2.3% reduction in per capita growth rate announced by CMS on Friday, and estimated 2-3% drop as rates move to parity with fee for service…a 1.5% reduction associated with the change in coding intensity adjustment” and the 2% health insurance premium tax. “These negatives are partially offset by an estimated 1% benefit from improved Star quality ratings, re-basing, better risk scores, and fee for service normalization, resulting in an overall decline of 7-8%,” wrote McDonald yesterday in a note to clients.

Because the typical for-profit managed care plan targets profit margins of only 5 percent, and non-profits even less, the net consequence would “turn almost every plan in the industry unprofitable,” according to McDonald, unless CMS changes its proposal. “If implemented, these rates and the program changes CMS is suggesting would be enormously disruptive to Medicare Advantage, likely forcing a number of smaller plans out of the business and creating disarray for many seniors.”

B-b-b-b-but if you like your plan, you can keep your plan! That’s what Obama and Democrats like Engel told Americans for months, and even years … until Obama was safely re-elected. Eliot Engel has this message for his constituents (NSFW):
