Court Rules Feds Can Vaccinate Kids Without Consent Under Public Health Emergency

New Yorker Jennifer Parker was alarmed when she found out that a public health nurse vaccinated her 5-year-old daughter, Madison, against her wishes.

This was during a flu outbreak in late 2009. Jennifer fought the action, citing negligence and battery and sued both the school district and health department in St. Lawrence County Supreme Court.

The school district was let off the hook.

Matters seemed resolved as that court ruled in her favor saying that the Public Readiness and Emergency Preparedness Act (PREP) couldn’t extend to just any situation where government workers could administer drugs without consent. But that ruling was short lived.

The health department appealed and it was the Third Judicial Appellate Court that overturned the previous ruling, deciding on November 21st this year, that PREP trumps, or rather, preempts state laws regarding that matter.

Did you know that we are apparently in an unending state of public health emergency?

The emergency in the situation above? H1N1 flu…

Madison Parker was given a Peramivir inoculation for H1N1 flu virus.

But this ruling was based on an assumed intention of Congress and the assumption of public health emergency:

we conclude that Congress intended to preempt all state law tort claims arising from the administration of covered countermeasures by a qualified person pursuant to a declaration by the Secretary [of Health and Human Services].

So because of this ruling, at least in New York, PREP’s arbitrary mandates override state laws that allow exemption from seasonal flu vaccines. Health workers can vaccinate children without their parents’ permission or knowledge because they deemed it a public health emergency and that it was Congressional intention.

According to Courthouse News, Justice Karen Peters wrote a statement for the five-judge panel:

We must presume that Congress fully understood that errors in administering a vaccination program may have physical as well as emotional consequences, and determined that such potential tort liability must give way to the need to promptly and efficiently respond to a pandemic or other public health emergency…

So, mistakes happen…but it’s best for the public good.

The Justices were “unpersuaded” by Parker’s argument that immunity under these circumstances didn’t mean any deemed qualified person could administer drugs against her will.

And we wouldn’t want to let a good government contract go to waste. Peters also wrote:

The immunity provisions of the PREP Act are triggered where, as here, the vaccines are purchased pursuant to a federal contract or agreement.

Peters said that because there are “exclusive federal remedies” (the Federal Government’s just cause under PREP), that reason further supports preemption.

Therefore, the decision concluded “the complaint must be dismissed for lack of subject matter jurisdiction.”

And what have we here? Another compensation program! That should make everything all better, right?

Courthouse News wrote:

PREP also created the Countermeasures Injury Compensation Program, which handles claims by individuals who suffer adverse reactions to devices, medications or therapies that have been recommended for use in public health emergencies, the decision notes.

Peters further noted that separate federal causes of action exist for wrongful death or serious physical injury resulting from misconduct by licensed health professionals.

So, not only is PREP admitting and setting up funds for very possible injuries upon administering vaccinations, but they themselves are immunized from liability in civil liberties violations – administering drugs against a person’s will. Great swerve guys – same MO every time.

Brian Shilhavy over at Health Impact News made some great points about the case:

Points like these, civil liberties, and state exemptions for religious, philosophical, and medical reasons exist but are not often upheld.

Especially when the Federal Government can arbitrarily declare “state of emergency” and trump state rulings.

It also seems like for anyone in this type of situation it might be better to sue only individuals involved, not governmental departments – what do you think?

Researchers Develop New Pain-Free Ways to Make Sure You Are Vaccinated

Dr. Erin Giudice, a pediatrician at the University of Maryland School of Medicine, proposed a new way to coerce parents into giving their children vaccinations: a clear, dissolvable patch that will elevate fears associated with needles.

Pharmaceutical corporations, the US government and researchers at state-sponsored universities are focused on more sophisticated ways of ensuring the general population worldwide succumbs to vaccinations now have a new option .

MIT researchers have invented a device that administers a minuscule, yet high pressured jet of “medicine” directly through the skin without the use of a syringe. The device can be programed to administer a wide range of immunizations at multiple depths within the body.

MIT says this device will eliminate the transfer of disease by misuse and reuse of needles. According to the Centers for Disease Control and Prevention (CDC) healthcare workers accidently prick themselves with needles over 385,000 annually.

“If you are afraid of needles and have to frequently self-inject, compliance can be an issue,” says Catherine Hogan, a research scientist in MIT’s Department of Mechanical Engineering and a participant of the research team. “We think this kind of technology … gets around some of the phobias that people may have about needles.”

The Infectious Disease Research Institute (IDRI) is collaborating with the drug corporation Medicago in development of vaccines that have nanoparticles which are virus-like in manufacturing.

This nanotechnology is touted as an immune-booster. NanoPress, an Israeli corporation, has invented micro-needles as a delivery device for these nanoparticles.

Dr. Steven Reed, founder and president of IDRI claims that since his product is pain-free, the device will become a popular way to administer vaccines directly into the dendritic or immune cells to be redistributed throughout the human body.

Reed explains: “Our main motivation, frankly, was to get superior efficacy by targeting the dendritic cells.”

The National Institute for Allergy and Infectious Diseases, part of the National Institutes of Health (NIH) is funding studies into proficient ways of making sure the vast majority of the population is inoculated while maximizing the effects of the vaccines with a focus on biodefense.

Oral vaccines are also within NIH’s ideology with the manufacturing of a pill to protect against Anthrax by PaxVax. A pill would be more favorable to military personnel and give the US Armed Forces the ability to inoculate on a grand scale.

The NIH is also involved in the development of a nasal vaccine liken to FluMist that would focus on the human immune system through influence of the immune cells in the sinuses, throat and lungs. By developing nanotherapies that are inhaled, any vaccine could be more easily administered.

Of late, health officials and government agencies are pushing the vaccine agenda in the mainstream media (MSM) through numerous articles placing the idea of immunizations for health purposes into the social meme.

The CDC has recently recommended that all Baby Boomers (people born between 1945 and 1965) be tested for the hepatitis C virus and subsequently vaccinated. They say this “generational epidemic” will claim more Baby Boomers unless they are vaccinated.

And nearly simultaneously, the CDC has not been forthcoming about the dangers of vaccines.

They have edited out scientific evidence from a Danish study that was published in the Journal of Pediatrics, which stated that after Denmark stopped using thimerasol in their vaccines that they saw a significant reduction in the incidents of autism in children.

A new study to be published in the journal Proceedings of the National Academy of Sciences, says that those who were vaccinated with the swine flu vaccine have developed antibodies against many other strains of flu; including the H1N1 strain.

The researchers of the study hope that this discovery will lead to the development of a universal vaccine to be administered to everyone. They were attempting to protect a broad range of flu strains and viruses, say Rafi Ahmed, study researcher and director of Emory University’s Vaccine Center.

Perhaps the researchers funded by the US government in conjunction with pharmaceutical corporations can collaborate with the manufacturers of the up and coming universal vaccine. These two scientific advancements would pave the way for the vaccine agenda become a real success.

Guidice supports the advancement of vaccine technology and would like to see a new “approach” to inoculations targeted at children be released to “make it easier for parents” to give into the pressure applied by pediatricians to have children vaccinated.

Media Blackout On Bill AB 2109 Threatening Vaccine Rights

On Feb. 23rd, 2012, an assembly bill (AB 2109) was submitted to the California Legislature by state assemblyman and pediatrician, Dr. Richard Pan (D-Sacramento), which will make it harder for parents to refuse to vaccinate their children.

The bill is sponsored by the California Medical Association (CMA), the American Academy of Pediatrics, and the California Immunization Coalition.

Right now in California if a child is enrolled in school their parents are legally required to have them vaccinated.

However, exemptions may be obtained by parents who object for religious or philosophical reasons if they sign the portion of the immunization record that says immunizations are contrary to their beliefs and that they understand that in the case of an outbreak of a ‘vaccine-preventable’ disease the child may be temporarily excluded from attending school/child care institutions “for his/her protection.”

If Bill AB 2109 passes, by July 1st, 2013,  parents who wish to opt out will be required to bring with them on the day of enrollment a written statement from a medical doctor or conventional “health care practitioner” that states they have been informed of the benefits and risks of vaccines and the communicable disease they are said to prevent.

The parent would also be required to submit a written statement that indicates that he or she received the information from the health care practitioner.

As first reported by Dr. Tim O’ Shea in the Feb. 23rd  Doctor Within Newsletter:

This bill, if passed, would require parents to obtain the signature of a  ”health care practitioner”  for a personal beliefs/religious exemption.  MDs, nurse practitioners, and physician’s assistants can sign.  Naturopaths and chiropractors cannot.  The signature will need to be obtained on a separate form provided by the Department of Public Health which states that the health care practitioner has provided risk and benefit information to the parent.

Thus far, there has been virtually no mainstream media coverage of Bill AB2109.

This is a curious fact, considering that if it passes it will be illegal not to submit your children to a medical procedure without the explicit permission of the conventional medical system.

Is this not the very antithesis of the meaning of health freedom, in a country that prides itself on its freedom-loving, Constitutionally underwritten principles? As Dr. Tim O’ Shea explains:

Let's remove the word vaccination from the whole discussion for a minute here. Let's pretend this whole issue isn't about vaccines at all, but rather about any other medical procedure. Got that picture?

OK so then tell me, what kind of political system, or medical system anywhere on earth would presume to make it a law for you to obtain permission to opt out of any medical procedure, which decisions are completely your choice in the first place? Permission not to get medicine? See what I'm getting at here?

If Dr. Tim O’ Shea’s predictions are correct and California falls, like Washington state recently did with the loss of their philosophical exemptions, the rest of the domino states are likely to follow suit in the next 2 years.

In other words, this stealthily submitted and barely noticed bill is setting a dangerous precedent and may represent the beginning of the end for philosophical and religious vaccine exemptions in the United States -- with mandatory vaccinations likely following close behind. Now that children, according to the CDC immunization guidelines, are required to have an increasingly suspect 60 vaccines by age 6 (with dozens of additional vaccines in the developmental pipeline) how can we stand by idly while their health and health rights, and those of all future generations, are being serious jeopardized and legislated away into oblivion?

(NaturalNews) One of the primary reasons for the big push among public school districts across the country to vaccinate as many students as possible appears to have a lot to do with maintaining their eligibility to receive local and state funding, at least in the state of Illinois.

Section 27-8.1.7 of the Illinois Compiled Statutes (ILCS) Health examinations and immunizations law explains that if a school vaccination rate falls below 90 percent, state aid payments to that school are automatically cut by 10 percent until the school comes into "compliance"

According to the current Illinois General State Aid fiscal schedule, Illinois schools receive $6,119 per student from the state. Ten percent of this amount equates to roughly $612. So if a school has 2,000 students, for instance, and it maintains at least a 90 percent vaccination rate, it will receive $12,238,000 from the state per year. But if the vaccination rate falls below 90 percent at the same school, a whopping $1,223,800 will be shaved off this amount (http://nced.info/schoolfinance/file…).

Suddenly it all becomes clear why school administrators are aggressively pushing parents to have their children receive the full vaccination schedule. If students do not comply, the administrators own salaries are on the line! These vaccine quotas also explain why some school districts are actually having to resort to bribary campaigns like giving away free iPods to students who get their shots (http://www.naturalnews.com/032330_v…).

It all appears to be nothing more than a sick “pay-for-play” system where state officials pressure school administrators to comply with the vaccine agenda or else face budget cuts. And they do this because federal officials are pressing them to push the vaccine agenda or else lose funding. In other words, from the top down, Big Pharma has rigged an entire system that forces government workers to push the vaccine agenda or else face a loss of funding — and all this funding, of course, ultimately comes directly from taxpayers.
