Hobby Lobby Wins SCOTUS Decision as Obama Racks Up a String of Judicial Losses at Supreme Court

It has been a tough week for President Obama at the Supreme Court!  As the somewhat surprising ObamaCare loss to Hobby Lobby was added to the tally on Monday, the Obama administration lost 4 out of 5 big decisions and 2 were rare 9 to 0 decisions.

The Roberts Court

By Marion Algier – Ask Marion

Although not unanimous decisions, after months of judicial rulings reining in big government and police on issues like snooping on Americans without a warrant, restrictions on campaign finance and President Obama’s recess appointment powers, the administration’s losses on ObamaCare rules and compulsory union dues served as a final rebuke by the Supreme Court on their last day of this session.

In the five years that President Obama has been in office, the Supreme Court has rejected the government’s argument with a 9-0 decision 20 times.

During the eight years each in the administrations of Bill Clinton and George W. Bush, the government lost on unanimous votes 23 times and 15 times, respectively, putting the Obama administration on course to to be the biggest loser in recent history in terms of judicial losses.  Unfortunately for the American people, Obama won on the big one… the most damaging decision for America: ObamaCare, a decision many people are still baffled by and questioning.

President Obama appointed two of the sitting Supreme Court Judges Elena Kagan and Sonia Sotomayor, under an umbrella of considerable scrutiny and dissent by conservatives, the right. So the number of unanimous cases are important in that nobody can say, ‘Well, there are five Republican appointees on the court and only four Democrats.’

“These cases where they haven’t gotten the votes of either of the two Obama nominees means the arguments being presented by the Justice Department to the court are just out of left field,” said Ilya Shapiro, a senior fellow in constitutional studies at the libertarian Cato Institute.

Monday’s decisions were not unanimous, but congressional Republicans and other critics of President Obama saw the rulings as evidence that the Roberts court is finally acting as something of a final line of defense, a check and balance as they were meant to be, against a president who brags about his use of executive power to bypass Congress and impose his progressive agenda on the American people.

House Speaker John A. Boehner said of Monday’s decision, “It is a victory for religious freedom and another defeat for an administration that has repeatedly crossed constitutional lines in pursuit of its big government objectives.”  Boehner announced last week that he would be suing the president for abuse of executive authority.  And although it is unclear how that lawsuit will play out, the administration’s recent track record in high-profile cases has been poor.

Chief Justice John Roberts managed to corral unanimous votes on both privacy and recess appointments — cases that have dealt stinging defeats to the president, having himself been a lawyer and former lecturer on constitutional law.

US Supreme Court to police: To search a cell phone, 'get a warrant':

Christian Science Monitor: WASHINGTON — In a major affirmation of privacy in the digital age, the US Supreme Court on Wednesday ruled that police must obtain a warrant before searching digital information on a cell phone seized from an individual who has been arrested.

The 9-to-0 decision marks a Fourth Amendment landmark of profound importance given the ubiquity of cell phones, tablets, and portable computers in public places throughout society.

“Modern cell phones are not just another technological convenience,” Chief Justice John Roberts wrote for the court. “With all they contain and all they may reveal, they hold for many Americans the ‘privacies of life,’ " he said.

“The fact that technology now allows an individual to carry such information in his hand does not make the information any less worthy of the protection for which the Founders fought,” the chief justice said.

“Our answer to the question of what police must do before searching a cell phone seized incident to an arrest is accordingly simple – get a warrant.” Read More

The Supreme Court delivered a solid blow Thursday to President Obama, ruling that he went too far in making recess appointments to the National Labor Relations Board.

SCOTUS Limits Recess Appointments Decision:

Fox News: In a unanimous decision, the high court sided with Senate Republicans and limited the president's power to fill high-level vacancies with temporary appointments. It was the first-ever Supreme Court test involving the long-standing practice of presidents naming appointees when the Senate is on break.

In this case, Obama had argued that the Senate was on an extended holiday break when he filled slots at the NLRB in 2012. He argued the brief sessions it held every three days were a sham that was intended to prevent him from filling the seats.

The justices rejected that argument, though, declaring the Senate was not actually in a formal recess when Obama acted during that three-day window.

Justice Stephen Breyer said in his majority opinion that a congressional break has to last at least 10 days to be considered a recess under the Constitution. Read  More

Mandatory Union Fees Curbed by Court in Blow to Labor

BusinessWeek: A divided U.S. Supreme Court handed a setback to organized labor by placing new limits on the ability of unions to demand fees from some public-sector workers.

The high court, voting 5-4, invalidated Illinois rules requiring union payments from people who provide in-home care for disabled Medicaid recipients. The majority said those rules violated the workers’ constitutional right to freedom of speech and association because the home health-care workers weren’t true public employees.

“If we accepted Illinois’ argument,” Justice Samuel Alito wrote in today’s majority opinion, “we would approve an unprecedented violation of the bedrock principle that, except perhaps in the rarest of circumstances, no person in this country may be compelled to subsidize speech by a third party that he or she does not wish to support.”  Read More

American Thinker: Hobby Lobby 1, Obamacare 0

Hobby Lobby Stores Inc. co-founders David and Barbara Green who are asking a federal appeals court in Denver on Thursday, May 23, 2013, for an exemption from part of the federal health care law that requires it to offer employees health coverage that includes access to the morning-after pill. The Oklahoma City-based arts-and-crafts chain argues that businesses, and not just religious groups, should be allowed to seek exemptions from that part of the health law if it violates their religious beliefs. PHOTO ILLUSTRATION/ AP PhotosThe Supreme Court upheld the religious freedom rights of Hobby Lobby, the closely-held corporation owned by believing Christians who objected to being required to supply the abortion pill to their employees.

Steve Ertelt of Life News reports:

…the U.S. Supreme Court today issued a favorable ruling in Sebelius v. Hobby Lobby Stores, Inc., a landmark case addressing the Constitutionally guaranteed rights of business owners to operate their family companies without violating their deeply held religious convictions.

Writing for the 5-4 majority, Justice Samuel Alito handed down the decision for the high court, saying, “The Supreme Court holds government can’t require closely held corporations with religious owners to provide contraception coverage.”

“HHS’s contraception mandate substantially burdens the exercise of religion,” the decision reads, adding that the “decision concerns only the contraceptive mandate and should not be understood to mean that all insurance mandates.”

Justice Anthony Kennedy wrote a concurring opinion saying that government itself could provide the coverage for contraception and the abortion-causing drugs if a company declines to do so.

The Hobby Lobby decision only applies to companies. Non-profit groups like Priests for Life and Little Sisters are still waiting for a ruling about their right to opt out of the mandate.

Note that this ruling only applies to closely-held corporations, but does not rule out applying the same religious freedom reasoning to publicly-held firms and nonprofits.

Ed Lasky points out:

The fact that both these decisions [Hobby Lobby and the forced union dues case] were 5-4 points out the danger of Obama picking the next SC Justice with Reid in control of the Senate. If the opportunity present itself, he will abolish the filibuster for SC nominees, too.

Memo.com: The Supreme Court Gets It Right

Finally, the U.S. Supreme Court has stepped up to defend Americans’ most basic freedoms from the full-frontal assault by the rampaging band of leftists running America. In a 5-4 decision, the Court ruled in favor of Hobby Lobby, a Christian business that objected on religious ground to Obamacare’s mandate that they must cover certain contraceptives.

Hobby Lobby is among about 50 businesses that have sued over covering contraceptives. Some, like Hobby Lobby, are willing to cover most methods of contraception, as long as they can exclude abortifacients.

Justice Samuel Alito said the decision is limited to contraceptives. “Our decision should not be understood to hold that an insurance-coverage mandate must necessarily fall if it conflicts with an employer’s religious beliefs,” he said. He suggested two ways the administration could deal with the birth control issue. The government could simply pay for pregnancy prevention, he said. Or it could provide the same kind of accommodation it has made available to religious-oriented, not-for-profit corporations.

Justice Anthony Kennedy, who was part of the majority, also wrote separately to say the administration can solve its problem easily. “The accommodation works by requiring insurance companies to cover, without cost sharing, contraception coverage for female employees who wish it,” Kennedy said. He said that arrangement “does not impinge on the plaintiffs’ religious beliefs.” Everyone’s rights respected and problem solved. Easy peasy.

Of course, Obamacare was never about health care or health insurance. It was only and always about government power and control. Over you. That’s what the contraceptive mandate was all about: social engineering, abortion made even easier to get, and with the government holding the strings of control over all of it.

Thank goodness the Supremes ruled on the side of religious liberty. It’s about time. But that 5-4 split is too close for comfort. As we head into 2016, don’t forget that the Supreme Court—like all of our courts—hangs by a thread, and with it, our most basic freedoms.

Huffington Post:  If Hobby Lobby Wins, Pro-life Christians Lose

We now know with certainty that the Supreme Court will announce its Hobby Lobby decision on Monday. This weekend, the craft and home décor store, along with numerous evangelical institutions that have filed briefs in its support -including my former employer the National Association of Evangelicals–are hoping and praying God will favor them with a whole new expansion of religious freedom and the protection of human life. I’m praying for the opposite.

Along with nearly 50 other for-profit corporations, Hobby Lobby is demanding the same religious freedoms and protections that each of us has. Hobby Lobby was not endowed by its Creator with certain unalienable rights. It does not have a soul. It cannot have faith. Yet its owners (and their lawyers) insist that it should not have to comply with the contraceptive coverage requirement in the Affordable Care Act on religious grounds. The Obama Administration reasonably granted an opt-out to houses of worship and other religious nonprofits. Hobby Lobby wants similar treatment.

Evangelical intervention on behalf of the multi-billion dollar corporation, which donates generously to their causes, is wrong for many reasons but here are two major ones: If you are pro-religious liberty and pro-life and family, you can’t support allowing a for-profit corporation to use religion to deny contraceptive coverage.

First, supporters of Hobby Lobby think they are helping the Christian faith but are actually harming it. In fact, a ruling in favor of Hobby Lobby weakens religious freedom.

When anyone can use religion to claim an exemption on anything, religion loses meaning. Rather than a personal belief embedded in our souls, faith would become a set of arbitrary rules any corporation could choose from to skirt the law.

Is this what evangelicalism needs? I spent nearly three decades in governmental relations at the National Association of Evangelicals defending the free-exercise of religion and the right to life, among many other traditional values. Coming to the aid of for-profit corporations who want to ride on the backs of religion is not one of these honored principles.

Indeed, it is a kind of corporatism invading the body of Christ — concern not for the “least of these” but the richest of those among us. Is this what Christ would do?

When corporations are allowed the same exemptions that have always been reserved just for churches–whether on health benefits, hiring, or land use–those special protections become less clear and more open for interpretation.

If a for-profit corporation is eligible for legal exemptions on grounds of religious freedom, it puts government in charge of deciding what is or isn’t religion. You can just imagine the lawyers who will find work forever litigating these claims. I know, from experience, that their concern for what should be “legal” is not the same as what is “spiritual” or truly serves the interests of the Church.

What if a corporation owned by Jehovah Witnesses refuses to cover blood transfusions? If Christian corporations are allowed to use faith to refuse contraception coverage to women who work for them, what’s to stop a Christian Scientist business from refusing to cover any health benefits?

Second, the supporters of Hobby Lobby think they are being “pro-life.” They are wrong. A massive study conducted in 2012 showed that contraception coverage without a co-pay could dramatically reduce the abortion rate.

That study, conducted by the Washington University School of Medicine, of 10,000 women at-risk for unintended pregnancy found that when given their choice of birth control methods, counseled about their effectiveness, risks, and benefits, with all methods provided at no cost, about 75 percent of women in the study chose the most effective methods: IUDs or implants. Most importantly, as a result, annual abortion rates among study participants dropped up to 80 percent below the national abortion rate.

Well, you might ask, based upon some of the charges being made, aren’t the contraceptive methods being funded through the Affordable Care Act, abortifacients? Not if you believe medical science.

In the words of Jeffrey F. Peipert, M.D., Ph.D., the Robert J. Terry Professor of Obstetrics & Gynecology at Washington University School of Medicine, “these contraceptive methods work by preventing pregnancy (fertilization) from occurring in the first place. For instance, the intrauterine device works primarily by preventing fertilization. Plan B (or the progestin-containing, morning-after pill), along with Ella (ulipristal acetate), delay the release of a woman’s egg from her ovary. The egg does not get fertilized, which means the woman does not become pregnant.”

In sum, Evangelicals supporting Hobby Lobby at the Supreme Court are not actually being pro-religious freedom or pro-life. If they win at the Supreme Court, these causes will be damaged in the long run.

Although this decision in favor of Hobby Lobby is generally seen as a victory by most on the right, and a win for freedom in general, it has opened the door for a lot of whining by the left, who will certainly take their misinformation and use it as a weapon in the upcoming 2014 Elections.  Therefore, it could not be a better time for Carly Fiorina’s new Pac… the UP Project, to educate women.

A big Supreme Court win on ‘greenhouse gas’ regulations for the EPA

The only win for the White House and the EPA this Supreme Court Session was on greenhouse gas:

A big Supreme Court win on 'greenhouse gas' regulations for the EPA

Human Events:

The outcome is likely to be welcomed by environmentalists because it confirms the Environmental Protection Agency’s authority to restrict greenhouse gases.

The justices handed down two separate rulings in a dispute over permits for new or modified power plants and factories.

In a 7-2 vote, the justices agreed the Environmental Protection Agency could force major polluters to use new and better technology to limit their emissions of carbon dioxide.

“These are major polluting facilities, such as factories and coal-fired power plants,” said Justice Antonin Scalia, and they are already subject to EPA restrictions. Now, those restrictions can include limits on greenhouse gases, he said.

The only disappointment faced by the regulatory State was that a separate 5-4 decision kept it from extending this authority to “millions of other facilities,” as the L.A. Times puts it, although I think that could be more properly rendered as “virtually all other facilities.”  The greenhouse-gas fantasy retains its grip on power plants, but at least they can’t make nearly every construction project pull “greenhouse gas permits,” which is where all of this was headed.  Today’s ruling also won’t do anything to stop the broader War on Energy carried out by the Obama Administration.  Considering what they won at the Supreme Court, their losses are trivial. Jonathan Turly Weighs In On Supreme Court Ruling & Executive Orders Special Report:

REP. BOB GOODLATTE (R-VA): Professor Turley, the constitution, the system of separated powers is not simply about stopping one branch of government from usurping another. It's about protecting the liberty of Americans from the dangers of concentrated government power. How does the president's unilateral modification of act of Congress affect both the balance of power between the political branches and the liberty interests of the American people?

JONATHAN TURLEY: Thank you, Mr. Chairman. The danger is quite severe. The problem with what the president is doing is that he's not simply posing a danger to the constitutional system. He's becoming the very danger the Constitution was designed to avoid. That is the concentration of power in every single branch.

This Newtonian orbit that the three branches exist in is a delicate one but it is designed to prevent this type of concentration. There is two trends going on which should be of equal concern to all members of Congress. One is that we have had the radical expansion of presidential powers under both President Bush and President Obama. We have what many once called an imperial presidency model of largely unchecked authority. And with that trend we also have the continued rise of this fourth branch. We have agencies that are quite large that issue regulations. The Supreme Court said recently that agencies could actually define their own or interpret their own jurisdiction. (House hearing, December 3, 2013).

Production of Rat Poison Halted d-CON… Will Cease Production in July

  • Maker agrees to stop producing harmful rat poison for consumer market
  • Powerful rat poison to be replaced has accidentally harmed children and animals
  • 'This is a significant victory for environmental protection,' attorney says of rat poison halt

LA Times  -  Cross Posted at JOMP: After years of battling federal environmental officials, the maker of d-CON has agreed to stop producing for the consumer market certain rat poisons that have accidentally harmed children, wildlife and pets.

The company's rodent-control products will be replaced next year with a new line of baits the U.S. Environmental Protection Agency has approved for use in every state.

Environmental activists hailed the agreement announced Friday.

"This is a significant victory for environmental protection and corporate responsibility," said Jonathan Evans of the Center for Biological Diversity in San Francisco. "While the fight isn't over until all of these hazardous products are off the market, this decision keeps the worst of the worst products from residential consumers."

The poisons will still be available for use in agriculture and by licensed pest-control operators.

The rat poisons that Reckitt Benckiser Group has agreed to discontinue contain "second-generation anticoagulant rodenticides." These are more toxic and persistent than the previous generation of products. The poisons are designed to kill rodents by thinning the blood and preventing clotting.

Scientists say the products have for years wreaked havoc by working their way up the food chain.

The state of California took sweeping action in March, when the Department of Pesticide Regulation signaled plans to halt retail sales of second-generation rat poisons to consumers after July 1. Reckitt Benckiser, the maker of d-CON, lost its bid to stop the ban.

Kian Schulman

The department said the national agreement would not affect the state's action, and it urged stores to continue the process of removing the products from shelves.

Some activists credited California's action with inducing the company to give in.

"California is a huge market," said Greg Loarie, an attorney with Earthjustice, a public interest environmental law firm in San Francisco. With the July 1 deadline looming, he added, "I suspect [Reckitt Benckiser] took a look around and saw the writing on the wall."

Reckitt Benckiser is one of 17 manufacturers of rodent poisons, but it is the only one that had not altered its packaging and ingredients to comply with federal safety standards.

During nearly two decades of research in and around the Santa Monica Mountains National Recreation Area, National Park Service scientists have documented widespread exposure in carnivores to common household poisons. Of 140 bobcats, coyotes and mountain lions evaluated, 88% tested positive for one or more anticoagulant compounds. Scores of animals are known to have died from internal bleeding, researchers said.

The poisons also affect protected or endangered species, including golden eagles, northern spotted owls and San Joaquin kit foxes.

Among heavy users of the poisons are growers of illegal marijuana throughout California. Scientists have linked rat poisons to the deaths of Pacific fishers, which are small carnivores, that had eaten rodents poisoned by illegal pot growers.

Under the agreement, Reckitt Benckiser will begin to phase out production of 12 d-CON rat and mouse poison products next month and will stop production by year-end. The company will cease distribution of existing stocks by March 31, 2015. Retailers will be allowed to keep the products on shelves until stocks are depleted.

*These types of poisons have also harmed and killed family pets and children.

$634 Million ObamaCare Website Company was Fired by Canada

500xNxObamacare.jpg.pagespeed.ic.d1b4NYtYqW

FrontpageMagazine: So Obama took a Canadian company that Canadian officials fired for screwing up their health care website and gave it a much bigger job.

Canadian provincial health officials last year fired the parent company of CGI Federal, the prime contractor for the problem-plagued Obamacare health exchange websites, the Washington Examiner has learned.

CGI Federal’s parent company, Montreal-based CGI Group, was officially terminated in September 2012 by an Ontario government health agency after the firm missed three years of deadlines and failed to deliver the province’s flagship online medical registry.

The online registry was supposed to be up and running by June 2011.

…

The CMS officials refused to say if federal officials knew of its parent company’s IT failure in Canada when awarding the six contracts.

It wasn’t just those contracts. As mentioned earlier, Obama dumped huge amounts of money on CGI.

CGI Federal is a subsidiary of Montreal-based CGI Group. With offices in Fairfax, Va., the subsidiary has been a darling of the Obama administration, which since 2009 has bestowed it with $1.4 billion in federal contracts, according to USAspending.gov.

HHS is by far the single largest federal contractor of CGI, showering it with $645 million in contracts. The Defense Department pays the Canadian company $254 million, the EPA $58 million and the Justice Department $36 million.

In comparison, in 2008, under President George W. Bush, CGI contracts totaled only $16.5 million for all federal departments and agencies.

The interesting question is why Obama dumped 1.4 billion in taxpayer money on a company this incompetent and ignored all the warnings.

It’s one more thing that ought to be investigated.

Austin’s Fluoridated Water Supply is Poisoning Our Children

Infowars.com | Should Austin’s infants and children be drinking our tap water when it tastes moldy and more like the bottom of Lake Austin than healthy, pure water?

But this should be a concern for all Americans, fluoride is added to the water systems of more water districts throughout American than not and with more and more people moving to Texas and Austin specifically, it could be a direct problem for more and more people moving there!

Video:  Austin's Fluoridated Water Supply is Poisoning Our Children

Should Austin’s infants and children be drinking our tap water when it tastes moldy and more like the bottom of Lake Austin than healthy, pure water? According to the Environmental Working Group, Austin’s tap water exceeds the EPA’s health limits for chlorinated compounds, lead, and coliform bacteria.

Also, many may not be aware that City Council distributes a one size fits all medication, fluoride, through our water supply. Because of the distribution method for fluoride, children and adults get the same amount in a glass of water.

And, because there is no dose adjustment or control for size, weight, height, or sensitivity, fluoride causes multiple side effects such as dental fluorosis, hypothyroidism, osteosclerosis and the League of United Latin American Citizens (LULAC) has issued a powerful Resolution against fluoridation.

In addition, the Material Safety Data Sheet (MSDS) of the fluoride chemical, hydrofluorosilicic acid, that is added to Austin’s water supply, recently included a health warning for children.

Ask Congress to Help Protect Honey Bees

bees_pollen_and_honey

Save the bees -- we need them for our on survival… If the bees die, so do all our fruits, flowers, veggies and so will we with no food.

Yesterday a legal petition was filed--along with over a million public comments--calling on EPA to suspend registration of Bayer’s controversial bee-toxic pesticide, clothianidin.

As the public debate over causes behind Colony Collapse Disorder (CCD) – a syndrome in which bees seemingly abandon their hives – carries on in the media, more and more new science has shown that neonicotinoid pesticides like  clothianidin are indeed a critical piece of the puzzle.

Bees are still sick, and EPA is still stuck. While we may not know the exact cause of CCD, EPA knows enough to act, and has the authority and responsibility to suspend Bayer’s bee-toxic pesticide, clothianidin – yet for over a year the Agency has failed to do so.

Congress has the authority to exercise oversight over federal agencies like the EPA. I just signed a petition from the Center for Food safety asking Congress to step up and help protect bees. Can you sign it too?

It only takes a few seconds and you can sign here:

Monsanto: A HORRIFYING PICTURE THAT WILL FREEZE THE BLOOD IN YOUR VEINS - UPDATED

Film Review: The World According to Monsanto

Film:  The World According to Monsanto – Full Length

clip_image001Directed by Marie-Monique Robin
Review by Jeffrey M. Smith

How much outrage can a single multinational corporation inspire? How much damage can they inflict? The breathtaking new film, The World According to Monsanto, features a company that sets the new standard. From Iowa to Paraguay, from England to India, Monsanto is uprooting our food supply and replacing it with their patented genetically engineered creations. And along the way, farmers, communities, and nature become collateral damage.

The Gazette says the movie "will freeze the blood in your veins." The Hour says it's a "horrifying enough picture" to warrant "fury." But most importantly, this critical film opens our eyes just in time.
The film is the work of celebrated award-winning French filmmaker Marie-Monique Robin, whose three years of work on four continents exposes why Monsanto has become the world's poster child for malignant corporate influence in government and technology.

Combining secret documents with accounts by victims, scientists and policy makers, she guides us through a web of misleading reports, pressure tactics, collusion, and attempted corruption. And we learn how the company systematically tricked governments into allowing dangerous genetically modified (GM) foods into our diet--with Monsanto in charge of determining if they're safe.

Deception, Deception, Deception

The company's history with some of the most toxic chemicals ever produced, illustrates why they can't be trusted. Ask the folks of Anniston, Alabama, where Monsanto's PCB factory secretly poisoned the neighborhood for decades. PCBs are Monsanto's toxic oils used as coolants and lubricants for over 50 years and are now virtually omnipresent in the blood and tissues of humans and wildlife around the globe. But Anniston residents have levels hundreds or thousands of times the average. They all know their levels, which they carry as death sentences. David Baker, who lost his little brother and most of his friends to PCB-related diseases such as cancer, says Anniston kids used to run up to him, report their PCB level and ask, "How long you think I got?"

clip_image002Ken Cook of the Environmental Working Group says that based on Monsanto documents made public during a trial, the company "knew the truth from the very beginning.

They lied about it. They hid the truth from their neighbors." One Monsanto memo explains their justification: "We can't afford to lose one dollar of business."

Monsanto also produced the infamous Agent Orange, the cancer and birth-defect causing defoliant sprayed over Vietnam. It contaminated more than 3 million civilians and servicemen. But according to William Sanjour, who led the Toxic Waste Division of the Environmental Protection Agency, "thousands of veterans were disallowed benefits" because "Monsanto studies showed that dioxin [the main ingredient in Agent Orange] was not a human carcinogen." But his EPA colleague discovered that Monsanto had allegedly falsified the data in their studies. Sanjour says, "If they were done correctly, [the studies] would have reached just the opposite result."

Secret documents stolen from the FDA also reveal serious health effects from Monsanto's genetically engineered bovine growth hormone, called rBGH or rBST. In particular, the amount of a powerful hormone called IGF-1 is substantially increased in milk from treated cows. Samuel Epstein, Chairman of the Cancer Prevention Coalition, says that approximately 60 studies link IGF-1 to "breast, colon, and prostate cancers."

Cancer is also implicated in Monsanto's showcase herbicide, Roundup. According Professor Robert Belle's research showing disrupted cell division, "Roundup provokes the first stages that lead to cancer." Belle, who is with the National Center for Scientific Research and the Pierre and Marie Curie Institute in France, says, "The tested doses were well below those which people normally use."

Monsanto has promoted Roundup as harmless to both humans and the environment. But their advertised environmental claims, such as "biodegradable," "leaves the soil clean," and "respects the environment," were declared false and illegal by judges in both the US and France. In fact, Monsanto's own studies showed that 28 days after application, only 2% of the product had broken down. They were forced to remove "biodegradable" from the label.

Above the law

When Monsanto's transgressions are reported to authorities, somehow the company is magically let off the hook.

When Monsanto finally did share information on PCBs with the government, for example, Ken Cook says "instead of siding with the people who were being poisoned, [the government] sided with the company. . . . It was outrageous!" When William Sanjour's EPA colleague, Cate Jenkins, asked the agency to review Monsanto's flawed Agent Orange studies, Sanjour says, "there was no investigation of Monsanto. . . . What they investigated was Cate Jenkins, the whistleblower! They made her life a hell."

When Richard Burroughs of the FDA held up approval of rBGH by demanding more rigorous and relevant testing, he was fired.

clip_image003

He says, "They figured: 'Well, if you're in the way, we'll get you out of the way. . . One day, I was escorted to the door and told that was it; I was done." Senior government scientists at Health Canada testified that their superiors were pressuring them to approve rBGH and that Monsanto had offered them an alleged bribe of $1-2 million. The scientists were later reprimanded, punished, and eventually  "dismissed for disobedience." rBGH was never approved in Canada, Europe, and most industrialized nations.

When Professor Belle went to his administration "to let the public know about the dangers" of Roundup herbicide, he was "ordered" not to communicate his findings "due to the GMO question lurking in the background." That question about genetically modified organisms was in relation to Monsanto's "Roundup Ready" crops. Monsanto has the patent for 90% of the GMOs grown on the planet, and most of them are genetically modified specifically to tolerate applications of Roundup.

Senate Bill S.510 Passed… Quickly Explained Here

UPDATED:

President Obama appointed former Monsanto vice president and lobbyist Michael Taylor as senior advisor to the Food and Drug Administration commissioner.

This is a classic example of the fox guarding the henhouse. President Obama should isolate the FDA from corporate influence by asking Taylor to step down immediately.

That's why I created a petition to President Obama on SignOn.org. Click here to add your name, and then pass it along to your friends:

The petition says:

President Obama, I oppose your appointment of Michael Taylor, a former VP and lobbyist for Monsanto, the widely criticized genetically modified (GM) food multinational, as senior advisor to the commissioner at the FDA. Taylor is the same person who as a high ranking official at the FDA in the 1990s promoted allowing genetically modified organisms into the U.S. food supply without undergoing a single test to determine their safety or risks. This is a travesty.

Taylor was in charge of policy for Monsanto's now-discredited GM bovine growth hormone (rBGH), which is opposed by many medical and hospital organizations. It was Michael Taylor who pursued a policy that milk from rBGH-treated cows should not be labeled with disclosures. Michael Taylor and Monsanto do not belong in our government.

President Obama, Monsanto has been seen as a foe to family-based agriculture, the backbone of America, by introducing dangerous changes to plants and animals and by using strong-arm legal tactics against farmers for decades. Naturally occurring plant and animal species are permanently threatened by the introduction of DNA and hormonal modification, Monsanto's core businesses.

FDA scientists once regarded genetic modification of the food supply as the single most radical and potentially dangerous threat to public health in history. As early as the 1991, a body of scientific research began to form which now includes articles in over 600 journals. As a whole, these offer scientific evidence that GM foods, hormones, and related pesticides are the root cause for the increase of many serious diseases in the U.S. Since GM foods were introduced, diagnosis of multiple chronic illnesses in the U.S. has skyrocketed. These illnesses include changes in major organs and in hormonal, immune, digestive, and reproductive systems. These modifications to foods and food production may also be contributors to colon, breast, lymphatic, and prostate cancers.

Experts are discouraged that regulators and GM companies systematically overlook potential side effects of GM. Monsanto's objective to use biotechnology to change the world's food supply is the opposite policy direction your administration should pursue. Your legacy of supporting Monsanto to have free rein in U.S. food policy is a nightmare scenario that is against the interest of all Americans and world citizens.

Chromium 6 Going Airborne Through Dust Particles From Government Solar Projects

Video:  Chromium 6 Going Airborne Through Dust Particles From Gov’t Solar Projects

G4T shares information about airborne chromium 6 particles being released inadvertently through government projects.

This is also openly in our TAP WATER!  See Below:

Chromium-6 Is Widespread in US Tap Water

Laboratory tests commissioned by Environmental Working Group have detected hexavalent chromium, the carcinogenic “Erin Brockovich chemical,” in tap water from 31 of 35 American cities.

The highest levels were in Norman, Okla.; Honolulu, Hawaii; and Riverside, Calif. In all, water samples from 25 cities contained the toxic metal at concentrations above the safe maximum recently proposed by California regulators.

The National Toxicology Program has concluded that hexavalent chromium (also called chromium-6) in drinking water shows “clear evidence of carcinogenic activity” in laboratory animals, increasing the risk of gastrointestinal tumors. In September 2010, a draft toxicological review by the U.S. Environmental Protection Agency (EPA) similarly found that hexavalent chromium in tap water is “likely to be carcinogenic to humans.”

In 2009, California officials proposed setting a “public health goal” for hexavalent chromium in drinking water of 0.06 parts per billion (ppb) to reduce cancer risk. This was the first step toward establishing a statewide enforceable limit.

Despite mounting evidence of its toxic effects, the EPA has not set a legal limit for hexavalent chromium in tap water nationally and does not require water utilities to test for it. In 25 cities where EWG’s testing detected chromium-6 — in the first publicly available national survey for the contaminant — it was found in concentrations exceeding California’s proposed maximum, in one case at a level more than 200 times higher.

At least 74 million Americans in 42 states drink chromium-polluted tap water, much of it likely in the cancer-causing hexavalent form. Given the scope of exposure and the magnitude of the potential risk, EWG believes the EPA should move expeditiously to establish a legal limit for chromium-6 and require public water suppliers to test for it.

We now have this carcinogenic chemical not only in our tap water but also airborne through dust particles!

Group Warns EPA ready to increase radioactive release guidelines - As Nuclear Alert for Fukushima Reveals a Meltdown Has Started

The EPA is preparing to dramatically increase permissible radioactive releases in drinking water, food and soil after “radiological incidents,” according to Public Employees for Environmental Responsibility.

What is termed a guidance that EPA is considering - as opposed to a regulation - does not require public airing before it’s decided upon.

EPA officials contacted today in the Atlanta and D.C. offices had no response on the issue as of 6 p.m.

The radiation guides called Protective Action Guides or PAGs are protocols for responding to radiological events ranging from nuclear power-plant accidents to dirty bombs.

Drinking water, for example, would have a huge increase in allowable public exposure to radioactivity, the group says, that would include:

A nearly 1000-fold increase in strontium-90

A 3000 to 100,000-fold hike for iodine-131

An almost 25,000 rise for nickel-63

The new radiation guidance would also allow long-term cleanup standards thousands of times more lax than anything EPA has ever before accepted, permitting doses to the public that EPA itself estimates would cause a cancer in as much as every fourth person exposed, the group says.

These relaxed standards are opposed by public health professionals inside EPA, according to documents PEER said it obtained under the Freedom of Information Act.

PEER is a national alliance of local state and federal resource professionals

Radiation in Massachusetts Rainwater Likely From Japan

Radiation In Massachusetts Rainwater Likely From Japan

Radiation Rain Massachusetts

BOSTON -- Health officials said Sunday that one sample of Massachusetts rainwater has registered very low concentrations of radiation, most likely from the Japanese nuclear power plant damaged earlier this month by an earthquake and tsunami.

John Auerbach, the Massachusetts commissioner of public health, said that radioiodine-131 found in the sample – one of more than 100 that have been taken around the country – has a short life of only eight days. He said the drinking water supply in the state was unaffected and officials do not expect any health concerns.

Nevada and other Western states also have reported minuscule amounts of radiation, but scientists say those presented no health risks.

The Massachusetts Department of Public Health said the in-state sample was taken in the past week, but they did not say where. The testing is part of a U.S. Environmental Protection Agency network that monitors for radioactivity.

State officials said similar testing was done in California, Pennsylvania, Washington and other states, and showed comparable levels of I-131 in rain.

Massachusetts testing last week of samples from the Quabbin and Wachusett reservoirs showed no detectable levels of I-131, health officials said.

Energy and Environmental Affairs Secretary Richard K. Sullivan Jr. directed the Department of Environmental Protection to collect additional samples for testing from several water bodies across Massachusetts. Results will be available over the next several days.

In Japan, mounting problems, including miscalculated radiation figures and inadequate storage tanks for huge amounts of contaminated water, stymied emergency workers Sunday as they struggled to bring the country's nuclear complex back from the edge of disaster. Workers were trying to remove radioactive water from the nuclear compound and restart the regular cooling systems for the dangerously hot fuel.

(Another) 'Probable carcinogen' found in water supply

'Probable carcinogen' found in water supply

It's cancer in a cup: U.S. drinking water is contaminated with a toxic chemical that your own government calls a "probable carcinogen."
So what's that same government doing about it? Same thing it always does: Nothing!

Drink up, everyone.

The chemical is called hexavalent chromium, and if the name sounds a little familiar then you've probably seen the film "Erin Brokovich." It's the toxic compound that set off her battle with Pacific Gas & Electric after it was found in the groundwater of Hinkley, California.
Now, we all may as well be living in Hinkley -- because tests by the Environmental Working Group on water in 35 cities across the country found the chemical in 31 of them.

Twenty-five of those cities had hexavalent chromium levels in excess of limits being proposed by California. And if you're in Norman, Oklahoma, congratulations -- you're drinking 200 times that proposed limit.

We have to go by California's proposed limit because the EPA doesn't have one -- proposed or otherwise.

And that's where this gets really bizarre... because while the EPA doesn't set limits for hexavalent chromium, it does care about total chromium levels.

In other words, it lumps this toxic compound into the same category as the essential mineral trivalent chromium.

One is needed by the body to control blood glucose levels, the other might give you cancer, wreck your kidneys and liver, and maybe even kill you -- but it's all the same to Uncle Sam.

Why sweat the details?

But let's look on the bright side here: Hexavalent chromium probably isn't the worst thing in your water right now.

Heck, it's positively healthy next to the rocket fuel, cocaine, aspartame, hormone drugs, and more regularly found in U.S. drinking water -- and I'm not talking about isolated incidents here.
From coast to coast, our water is toast -- and if you want to know more about WHY these chemicals are turning up, read the September, 2009 issue of The Douglass Report.

I've been on the front lines of the battle for safe water for years -- so when do I get my movie? If Julia Roberts played Erin Brokovich, then I want Brad Pitt playing me.

Have your people call mine, Brad.
