Obamacare: The New “Animal Farm”

GodFather Politics – Cross-Posted at AskMarion: Now that we’ve had just a few weeks of the mess that is ObamaCare, it brings home how grossly unfair it is for the political class to impose it on the rest of us and not have to abide by it (for as long as it lasts) — think Animal Farm (50th Anniversary Edition). It may yet collapse on its own weight.

I feel sorry for the younger generation (just out of college). They have less of a chance to get a good job with benefits. Many companies continue to downsize because of ObamaCare.

So these young people get less work. But they’ll have to pay more for healthcare, which they may never see. Assuming they can register for it, which we now know is a huge assumption.

Last week, one liberal blogger described how he had been all for ObamaCare. He was one of the few ones (relatively speaking) who managed to get through the computer system and register on-line. Lo and behold, his insurance costs were going to go through the roof, as was the deductible. So he said, forget it. He even said he won’t pay the fine either. Well, good luck with that.

ObamaCare seems simple to understand: You pay more, but you get less. Not to mention the loss of freedoms, the institution of a massive governmental bureaucracy, and the potential annihilation of healthcare as we know it.

At the very least, fairness would demand that all the politicians have to live under it. It’s grossly unfair to force the rest of us into a system that doesn’t seem to work, while the elite class has exempted itself from it.

All of this reminds me of the classic anti-Communist novel, Animal Farm , by the great British writer George Orwell (1903-1950). The short book is a parable of the Soviet Union.

And no, I’m not calling anyone a Communist. But Dr. Paul Kengor, Grove City College professor, documents in his book, The Communist (Kindle), Obama was mentored by Frank Marshall Davis, a member of the Communist Party USA (#47544). This is part of the public record.

Here’s a spoiler alert. In Orwell’s novel, you will recall, the animals revolt against the tyrannical farmer (Mr. Jones, a human), who represents the czar. But then as the animals look forward to sharing everything equally, the pigs in charge ultimately live high off the hog, so to speak.

After killing the farmer, the animals declare, “Remove Man from the scene, and the root cause of hunger and overwork is abolished forever.”

The animals post “Seven Commandments” — the final one stating, “All animals are equal.”

But as the plot develops, it becomes clear that the pigs (representing Josef Stalin, Leon Trotsky, and other Soviet leaders) have become an elite class.

At the end of the book, as the other animals — who do all the work and underfed — look into the farmhouse, they see the pigs enjoying a great meal. They can barely distinguish the pigs from the humans, whose regime they had rebelled against.Animal Farm_all animals are equal

The Seven Commandments had been changed to just two: “ALL ANIMALS ARE EQUAL, BUT SOME ANIMALS ARE MORE EQUAL THAN OTHERS.”

Today, we seem to have an elitists’ class and the rest of us. As long as ObamaCare is implemented as the law of the land, then it ought to apply to the president, his family, his staff, the Senators, and members of the House of Representatives and their staff. The law (and tax) should be good enough for the Supreme Court and their staff as well.

I’ve heard some Congressmen complain that their staff members can’t afford it. Well, what about the rest of us?

Meanwhile, the Bible says differing standards are unfair and unjust: “Differing weights and differing measures — the Lord detests them both” (Prov. 20:10). Psalm 94:20 criticizes “those who frame injustice by statute.” Paul strongly criticizes Peter in Gal. 2:14 for forcing a standard on the Gentiles that he himself was not living by.

Our nation’s birth certificate declares that “all men are created equal.” Are we to assume that under ObamaCare, some are created more equal than others?

Perspective: New Law - "The Affordable Boat Act" 2014

The U.S. government has just passed a new law called: "The affordable boat act" declaring that every citizen MUST purchase a new boat, by April 2014. These "affordable" boats will cost an average of $54,000-$155,000 each. This does not include taxes, trailers, towing fees, licensing and registration fees, fuel, docking and storage fees, maintenance or repair costs.

This law has been passed, because until now, typically only wealthy and financially responsible people have been able to purchase boats. This new law ensures that every American can now have a "affordable" boat of their own, because everyone is "entitled" to a new boat. If you purchase your boat before the end of the year, you will receive 4 "free" life jackets; not including monthly usage fees.

In order to make sure everyone purchases an affordable boat, the costs of owning a boat will increase on average of 250-400% per year. This way, wealthy people will pay more for something that other people don't want or can't afford to maintain. But to be fair, people who cant afford to maintain their boat will be regularly fined and children (under the age of 26) can use their parents boats to party on until they turn 27; then must purchase their own boat.
If you already have a boat, you can keep yours (just kidding; no you can't). If you don't want or don't need a boat, you are required to buy one anyhow. If you refuse to buy one or cant afford one, you will be regularly fined $800 until you purchase one or face imprisonment.

Failure to use the boat will also result in fines. People living in the desert; ghettos; inner cities or areas with no access to lakes are not exempt. Age, motion sickness, experience, knowledge nor lack of desire are acceptable excuses for not using your boat.

A government review board (that doesn't know the difference between the port, starboard or stern of a boat) will decide everything, including; when, where, how often and for what purposes you can use your boat along with how many people can ride your boat and determine if one is too old or healthy enough to be able to use their boat. They will also decide if your boat has out lived its usefulness or if you must purchase specific accessories,(like a $500 compass) or a newer and more expensive boat.

Those that can afford yachts will be required to do so...its only fair. The government will also decide the name for each boat. Failure to comply with these rules will result in fines and possible imprisonment.

Government officials are exempt from this new law. If they want a boat, they and their families can obtain boats free, at the expense of tax payers. Unions, bankers and mega companies with large political affiliations ($$$) are also exempt.

If the government can force you to buy health care, they can force you to buy a boat....or ANYTHING else..

So Yah...it's that stupid...  and that frightening!!

Obamacare: The epic fail act

TPN:  Here is a major shock.

Even the left is realizing that Obamacare is not going to work.

Of course, the left does not want Obamacare repealed because Obamacare has never been about insurance or even medical care. It has always been about power.

So what do liberals do when they realize they have a problem? The keep digging the hole deeper.

As the state moves to expand healthcare coverage to millions of Californians under President Obama's healthcare law, it faces a major obstacle: There aren't enough doctors to treat a crush of newly insured patients.

Some lawmakers want to fill the gap by redefining who can provide healthcare.

They are working on proposals that would allow physician assistants to treat more patients and nurse practitioners to set up independent practices. Pharmacists and optometrists could act as primary care providers, diagnosing and managing some chronic illnesses, such as diabetes and high-blood pressure.

"We're going to be mandating that every single person in this state have insurance," said state Sen. Ed Hernandez (D-West Covina), chairman of the Senate Health Committee and leader of the effort to expand professional boundaries. "What good is it if they are going to have a health insurance card but no access to doctors?"

Hernandez's proposed changes, which would dramatically shake up the medical establishment in California, have set off a turf war with physicians that could contribute to the success or failure of the federal Affordable Care Act in California.

Doctors say giving non-physicians more authority and autonomy could jeopardize patient safety. It could also drive up costs, because those workers, who have less medical education and training, tend to order more tests and prescribe more antibiotics, they said.

Isn’t that typically liberal.

Instead of letting the free market work, Democrats must legislate another failure.

What happens when we run out of Doctors, nurses and Physician assistants?

In California, I’m sure they will just approve witch doctors to do medical treatment.

Update: Religious organizations are already saying that the Obama’s announced compromise is hollow. Catholic Bishops and other religious organizations are moving forward with their protests. The political fallout from this issue could be huge in the 2012 Election among religious groups and Independents. Remember Obama carried the Catholic vote in 2008.

But in reality:  Obama Didn't Cave on the HHS Mandate; He's Making an Unprecedented Power Grab and this is why, if people realize, this could be Obama’s Waterloo!  And if not, we are in big trouble!!

RUSH: Everybody's reporting that Obama's caving on this mandate that the Catholic services provide abortion and all. There's not a cave here! There may be an accommodation, but there's no big cave-in here. It's still the government mandating this stuff happen. They're just changing the provider. It's not done by the church. He says he gave them a way out of it by mandating the insurance companies do it, but that's not the point here.

So everywhere I'm reading that Obama is caving on the mandate in Obamacare that Catholic churches -- well, not churches, but the schools and hospitals are mandated to provide contraceptives and abortion-related services that they religiously disagree with. "What's happened here is that Obama's caved! He has seen, he has heard, and now he's gonna shift that burden to the insurance companies!"

Obama is not doing what he's doing to make Barbara Boxer happy or the pro-abortion crowd happy or the Democrat Senate Caucus happy. He knows that's gonna happen. What he's doing is violating the Constitution. He is coalescing extra-constitutional power. He is making a power grab here that is unprecedented in the history of the presidency. (interruption)

Thomas Edsall, that's right. Thomas Edsall wrote that piece in the Nuev Orc Times, former Washington Post columnist. So I don't think... This has been my if you then argument with the Republican establishment from the get-go with Obama. I don't think this is traditional politics at all. I don't think traditional politics has anything to do with why Obama's doing this. This is about fundamentally transforming this country from a representative republic to a pure, straight democracy with the president assuming he's the majority and therefore can do whatever he wants to do. We're not dealing with the average, "Okay, the Democrats won the White House. They're gonna have it for four or eight years. We gotta try to stop 'em however we can and we'll get power back."

There's something unprecedented going on here.

AP: Obama to Change Contraceptive Mandate to Accommodate Religious Employers

AP Source Now Says Obama to Compromise

WASHINGTON (The Blaze/AP) — The Blaze has covered the religious freedom issues surrounding the Obama administration’s contraceptive mandate extensively. President Barack Obama will announce a plan to accommodate religious employers outraged by a rule that would require them to cover birth control for women free of charge, according to a person familiar with the decision.

Obama was expected to make the announcement at the White House Friday. ABC has more regarding what sources are saying the president is poised to present:

The move, based on state models, will almost certainly not satisfy bishops and other religious leaders since it will preserve the goal of women employees having their birth control fully covered by health insurance. [...]

One source familiar with the decision described the accommodation as “Hawaii-plus,” insisting that it’s better than the Hawaii plan — for both sides.

In Hawaii the employer is responsible for referring employees to places where they can obtain the contraception; Catholic leaders call that material cooperation with evil. But what the White House will likely announce later today is that the relationship between the religious employer and the insurance company will not need to have any component involving contraception.

CBS News corroborates:

The exact nature of the clarification remains unclear, but any accommodation could largely follow what exists in a majority of states, like in Illinois where DePaul University, the largest Catholic university in the country, offers an employee health plan that does cover contraception. Georgetown University offers a similar plan.

The shift is aimed at containing the political firestorm that erupted after Obama announced in January that religious-affiliated employers had to cover birth control as preventative care for women. Churches and houses of worship were exempt, but all other affiliated organizations were ordered to comply by Aug. 2013.

Republican leaders and religious groups, especially Roman Catholics, responded with intense outrage, saying the requirement would force them to violate church teachings and long-held beliefs against contraception.

The issue also pushed social issues to the forefront in an election year that had been dominated by the economy. Abortion, contraception and any of the requirements of Obama‘s health care overhaul law have the potential to galvanize the Republicans’ conservative base, critical to voter turnout in the presidential and congressional races.

Republicans vowed to reverse the president’s policy, with House Speaker John Boehner accusing the administration of violating First Amendment rights and undermining some of the country’s most vital institutions, such as Catholic charities, schools and hospitals.

The measure also sparked an internal debate at the White House. Vice President Joe Biden, then-chief of staff Bill Daley and deputy national security adviser Denis McDonough, all Catholics, raised concerns about how the administration proceeded on the policy. On the other side, senior White House advisers Nancy-Ann DeParle, Pete Rouse and David Plouffe argued for the need to ensure coverage for all without exception, as a matter of women’s health and fairness.

5 Reasons the Obama Admin May Be Losing the Contraceptive Mandate Battle

The Obama administration clearly underestimated the response it would receive from Catholics and non-Catholics, alike, after implementing a universal mandate on health plans that requires coverage of contraceptives, sterilization and abortion-inducing drugs.

Many liberals who traditionally support these options for women have been jumping ship to side with Catholic leadership in agreement that the administration has overstepped its bounds — an event that so rarely happens in theological and political circles.

But it’s important to note that, despite very boisterous outcries, Obama does have support from some liberals on this issue; many of them are pointing to the fact that nearly all Catholic women use contraceptives as a defense. Using this argument, those who favor the mandate claim that the Church is out of touch and not accurately speaking for its followers on this important women’s health issue.

But is this the proper lens through which to view the issue? Free and religious speech advocates would argue that usage has little to do with views on government intervention in church affairs. In the end, it’s a complicated scenario with political capital for whichever side wins the public over. At the moment, the situation may not be as favorable for Obama as he would like. In an article published on Wednesday, Religion News Service’s David Gibson provides five reasons that the president may be losing the battle.

First, the debate, despite what the mandate’s supporters say, is about religious freedom — not contraception. Regardless of where one stands, the main issue at hand is whether the government has the right to interfere in church affairs and dictate what will be covered in health care plans. Gibson writes:

The bishops don’t have as much credibility with the laity as they used to, thanks to the clergy sex abuse scandal, among other things. But Catholics are still a potent tribe, and if outsiders are seen as attacking the church, Catholics can get defensive – and they can get even.

Then there’s the fact, as mentioned, that some liberal Catholics have abandoned the president on the issue. Regardless of where these individuals stand on use of these health care options, forcing Catholic institutions (among other faith-based groups) to violate their conscience just isn’t sitting right.

Now, let’s talk about those other faith groups. Many times, people of different religious traditions have a tough time coalescing, but on this issue, individuals with varying theological ideals are coming together. After all, it’s one thing to sit back and watch an attack on a rival faith group unfold, but when considering what could happen, should this mandate go unchecked, many religious people are fearful: “What’s next?,” they’re wondering. Gibson continues:

Even though evangelicals and other conservative Protestants generally don’t have religious objections to contraception, they do have a big problem with “big government” and with perceived infringements on religious freedom. Evangelicals – both their leaders and their troops – have never been big Barack Obama supporters anyway, so they were happy to provide any electoral and rhetorical muscle the Catholic hierarchy could not muster.

The fourth reason Gibson highlights is the fact that the “attack on religion” frame the issue is being explored through is an appealing one for Republicans. While many conservatives are wondering why Obama would approach this subject in an election year to begin with, others are noticing just how effective religious freedom rhetoric will be for the GOP nominee.

The rhetoric is already ratcheting up. “This attack by the federal government on religious freedom in our country cannot stand, and will not stand,” House Speaker John Boehner (R-Ohio) said earlier this week.

And, of course, there’s the overwhelming fact that the president will need to secure the Catholic vote to ensure re-election. “While Obama won the overall Catholic vote 54 percent to 46 percent in 2008, he lost the white Catholic vote, 47 percent to 53 percent,” Gibson writes. It‘s hard to imagine the president won’t lose a portion of this important cohort as a result of his refusal, thus far, to compromise.

As GOP Presidential candidates Mitt Romney and Rick Santorum have both said, “Obama has shown his hand and if he is re-elected, even if they walk this back now, this is the road that his administration will go down!”

Sure, he’s shown “openness” to the ideal of coming up with a viable solution that appeases both sides, but to those so staunchly opposed, such a notion isn’t good enough. The president will need to admit wrongdoing and back away from the mandate, should he wish to appease many of those individuals who feel wronged by the government’s newfound regulations. So far, there’s no evidence that he will take such a course.

Why Justice Clarence Thomas Should Not (Needn’t) Recuse Himself… and Why Justice Elena Kagan Should (Must)

This question is all about politics, not ethics: If neither Thomas or his wife has a "fiduciary interest" in the case, Justice Thomas is in the clear, says Doug Mataconis in Outside the Beltway. But this isn't about legal ethics, it's an attempt to "deflect attention" from Sen. Orrin Hatch's call for liberal Justice Elena Kagan to recuse herself because of her previous work as Obama's Solicitor General. And unlike the Democrats' "phony" case against Thomas, Hatch has "at least an argument" that Kagan should sit this out.
"House Democrats call on Justice Thomas to recuse himself..."

Let's leave all spouses alone: "I get that this is mostly just rhetorical jousting," since Thomas won't recuse himself voluntarily and nobody can make him, says Kevin Drum in Mother Jones. But either way, "it's a bad idea" to argue that "judges' spouses need to be apolitical creatures or that judges are responsible for what their spouses do." That hurts women a lot more than men, and if it's true, why not ban all lawmakers' spouses from political activism, too?

Justice Elena Kagan was directly involved, herself, with ObamaCare. So, Justice Kagen Should Recuse Herself From ObamaCare Case This is 100% different from the Clarence Thomas situation.

Federal law requires Supreme Court justices to recuse from a case if they had earlier "participated as counsel" in the case. Justice Kagan did just that when she was Obama's solicitor general, but has never explained why she believes she is nevertheless justified in sitting on the case under this standard.

Carlson: Ginni Thomas Will Not Interview Or Write About Business Clients

Last week Tucker Carlson, who just hired Ginni Thomas for staff on the Daily Caller, said the same thing on Hannity.  He said he saw no reason for Justice Thomas to recuse himself unless the Thomas’s are receiving fiduciary compensation. (In recent weeks, the site has picked up some high-profile new employees, including former Slate and Newsweek blogger Mickey Kaus.)

Thomas is no political shrinking violet. She’s made her name most recently as a conservative advocate and de facto lobbyist — publicly offering her services to clients of the advocacy group Liberty Central and its partner the Patrick Henry Center for Individual Liberty. She’s the wife of Supreme Court Justice Clarence Thomas, vocally opposes the health care reform law, and worked in 2010 to elect Republicans to Congress.  But many (maybe most) in Washington are married to people who are in one way or another involved or working either in one of the 3-branches of government, in support or lobbying concerns, CIA or FBI or security related departments or in the media.

The only way that Justice Thomas would be required to recuse himself under this canon would be if his wife has a fiduciary interest of some kind in the outcome of the litigation or if she falls under one of the provisions of subsection (d). The fact that she may be affiliated with a Tea Party group that has taken a position on the Affordable Care Act is not, in and of itself, sufficient to meet the requirements of Canon 3(C)(1), and anyone with a modicum of training in legal ethics would know that.

Recusal is on a case by case basis and unfortunately up to the judge to recuse themselves.  However in this case… the Obama administration knew of the conflict with Kagan and her recusal should have been provision of her confirmation.

The upcoming decision on ObamaCare is not only over changing the quality of healthcare in America, it is about how much power the government has (will have) over Americans to make us buy whatever they choose, if this is not over-turned. It will also give the federal government control over one-sixth of the budget of the United States. Look at their record… does anyone believe they are capable of that responsibility? Just like social security now… in the not so distant future there will be no money in the coffers for anyone’s (but a chosen few) to get healthcare… let alone decent healthcare or anything like what Americans have now.

Kagan was a guaranteed vote for the White House for the administration in case the constitutionality of the Affordable Care Act ended up there. Kagan is ineligible to vote on this case and the White House always knew that. But the Congress did not do their job….

Kagan should (must) recuse herself.  Thomas should (need) not. Some pressure from the other judges might help… Encourage them!

Buried in his massive amendment to the Senate version of Obamacare is Reid's anti-democratic poison pill designed to prevent any future Congress from repealing the central feature of this monstrous legislation!

Beginning on page 1,000 of the measure, Section 3403 reads in part: "It shall not be in order in the Senate or the House of Representatives to consider any bill, resolution, amendment or conference report that would repeal or otherwise change this subsection."

In other words, if President Barack Obama signs this measure into law, no future Senate or House will be able to change a single word of Section 3403, regardless whether future Americans or their representatives in Congress wish otherwise!! (This will be challenged in Court but the audacity and darkness behind this type of legislation speaks for itself.)

Note that the subsection at issue here concerns the regulatory power of the Independent Medicare Advisory Board (IMAB) to "reduce the per capita rate of growth in Medicare spending." without particulars of how and how not to reach this goal.

That is precisely the kind of open-ended grant of regulatory power that effectively establishes the IMAB as the ultimate arbiter of the cost, quality and quantity of health care to be made available to the American people. And Reid wants the decisions of this group of unelected federal bureaucrats to be untouchable for all time.

FACTS - If the Slaughter Method is used:

1. The Senate Bill will be passed as is… including all the kick backs.

2. Abortions will be covered using taxpayer money.

3. The chances of any of the questionable legislation or deals promised to be removed from this bill will not happen.

4. Additional deals are being cut one by one to get the votes on this bill and everyone will cost you money and or freedoms!

5. The takeover of the student loan industry, including federal control over curriculum and ‘service requirements’ for your children is being attached to this bill.

6. There will be no 72-house opportunity for the legislators or the people to read the bill.

7. The 2/3 of negative legislation already passed (see below) as part of the stimulus bill and others will be activated by this bill’s passing.

8. Experts say that the chances of this bill being over-turned, or at least a large part of it, is virtually nil once it passes.

ObamaCare needs to be taken off the table. All versions. Now! No talks. No televised discussions. Nothing... until Congress and the White House agree to START OVER! OR ELSE PLEASE VOTE “NO” ON THIS TRAIN WRECK OF A HEALTH CARE BILL.

I am disgusted by the deceptive tactics employed in recent days - simultaneously planning televised "bi-partisan" discussions while holding back-room meetings on how to ram ObamaCare through with no bi-partisan support. Such underhanded efforts are offensive to me and millions of Americans.

Also, as a pro-life American, I adamantly oppose any healthcare plan that will require me to pay for abortions with my tax dollars. Any government sponsored healthcare system with this mandate is bad for America and violates the deeply held beliefs of many Americans.

Its past time to scrap all the versions of ObamaCare and start over with a constitutionally correct and moral plan with far less government intrusion. I urge you to stand with a clear majority of Americans and oppose ObamaCare or any other plan containing an abortion mandate and "public

I doubt whether they will bother making any changes or adding things afterwards. They just want it to pass, so Obama can implement his socialistic agenda and we as Americans do not want anything to do with a socialistic government.

Men and women have died for our Freedoms and our Republic. We will fight for our country. Obama and his administration needs to be “Recalled “or “Impeached”. We are not happy with his style of government period.

Reconciliation… Who… What… Why…

What Is "Reconciliation" - And Why Is It A Threat?
During last week's health summit, Senate Majority Leader Harry Reid uttered a remarkably dishonest and, in retrospect, ironic statement, claiming that "nobody is talking about reconciliation" to pass the health bill.

It was a dishonest statement because Democrats have been openly floating the specter of passing the health bill using reconciliation since it first became obvious it would have difficulty passing the Senate, including just days before the summit by Sen. Reid himself.

It was ironic because it seems that all the cable news shows, talk radio, blogs and pundits have been talking about since the summit is whether President Obama, Harry Reid, and House Speaker Nancy Pelosi will use the Senate budget reconciliation process to pass their big government, big bureaucracy health bill.
But what exactly is the reconciliation process? And why, exactly, is it so controversial a move to pass the health bill?

A Tool for Congress to Meet Spending Goals
The budget reconciliation process was created in 1974 as part of the law that created much of the modern rules and organizational structures used by Congress to pass the annual budget.

This new law required Congress to pass a budget resolution every year that would set the parameters by which the various congressional committees would write their specific parts of the total budget bill.

Within these budget resolutions, instructions can be given to specific congressional committees to create legislation that would alter current laws affecting spending and/or taxation in order to conform to the targets set out in the budget resolution.

To enhance Congress’ ability to meet budget resolution targets, these pieces of legislation are not passed under the normal rules of the Senate. Instead, they fall under the “budget reconciliation process” rules which prohibit unrelated amendments to the bills and set a maximum of 20 hours of debate on the floor. As a practical matter, this means only 51 votes are needed to pass a reconciliation bill because the limit on debate overrides the threat of a filibuster.

The Byrd Rule to Prevent Abuse of Reconciliation
While the budget reconciliation process was a success in its principal goal of giving Congress more power to meet the spending and revenue goals of the budget resolution, it quickly became prone to abuse.

Provisions that had nothing to do with meeting budget resolution requirements, even some that directly contradicted them, were passed using the reconciliation process.

To prevent this, the so-called “Byrd Rule,” named after Democratic Sen. Robert Byrd, who introduced the legislation, was passed in 1985 and made permanent in 1990.

The Byrd Rule allows any senator to raise a point of order objection to provisions in a reconciliation bill that they consider extraneous to meeting budget resolutions requirements. Then, it is up to the chair – either the Vice President (as President of the Senate) or, more often, the presiding officer of the Senate if the Vice President is not present -- whether that provision stays or is stricken.

However, the chair almost always relies on the advice of the Senate Parliamentarian to determine if that objection is legitimate. (Learn more about the parliamentarian here.)

This determination is made based on six tests created as part of the Byrd Rule used to weed out provisions that have nothing to do with raising or reducing taxes or spending. It takes a 3/5 majority vote to override the decision of the presiding officer if he or she finds that a provision violates one or more of these tests. Reconciliation in Action
Reconciliation has been used for 22 bills, of which, 14 were passed by Republican majorities. Nineteen of those bills were signed into law by the President. Three were vetoed. You can view a chart of these bills here.

Notice the similarity between them? All of these bills were obviously directly related to taxation and spending, and since 1985, have successfully met the Byrd rule tests.

Health Reform Is About More than Federal Spending
This is why passing the left's big government, big bureaucracy health bill using the budget reconciliation process is so fundamentally dishonest and dangerous to Senate precedent.
Leaving aside the bill's merits (which, to be clear, are abysmal), both its defenders and detractors would acknowledge that it is, for better or worse, a fundamental overhaul of the nation's health system, both public and private. It sets new rules and regulations that span the entire healthcare sector. It is much larger in scope and more all encompassing in purpose than simply affecting federal spending and revenues.

This is not to say that the bill would not have some effect on the federal budget. Almost any piece of legislation could meet that meager standard.

The reconciliation process was only intended to be used for legislation directly related to meeting budget resolution spending and revenue goals.

The minor affect the left's health bill would have on the deficit over 10 years (beyond that there is every reason to think it would increase the deficit substantially), even by charitable estimates, cannot be used to justify passing this sort of sweeping legislation using reconciliation.

This is one reason why a number of Democrats, including Sen. Robert Byrd, author of the Byrd Rule and who also helped create the budget reconciliation process in 1974, called the idea of using it to pass the health bill (and cap and trade) "an outrage that must be resisted."

It's also why Robert Byrd objected to President Clinton's efforts to pass Hillarycare in 1993 using reconciliation.

Why should the left's latest big government healthcare grab be held to any different standard?

Welfare Reform vs. the Left's Big Government Health Bill
This week, the left is out in force, pointing to other significant pieces of legislation passed by Republicans using the budget reconciliation process as justification for passing their health care bill. One of the examples they are using is welfare reform.
Since welfare reform was passed while I was Speaker of the House, I am happy to compare the two cases.

First, welfare reform was an integral part of the Republican Congress' efforts to balance the budget, producing immediate savings of over $50 billion dollars between 1997 and 2002. It was originally combined with the balanced budget act that President Clinton vetoed in 1995.

By contrast, for most of the debate over the health bill, the left has constantly boasted about how their bill was "deficit neutral". President Obama repeatedly sought to assure the American people that he would not sign a bill that "added one dime" to the deficit. Medicare cuts were combined with new taxes to pay for the cost of new programs and bureaucracies.

So while real effective health reform would certainly have a positive effect on the deficit, it is clear that the left never intended for their health bill to be primarily a budget bill. Its focus was and still is on getting more people covered. It was only after Democratic leaders began setting the stage for passing the bill using reconciliation that they began emphasizing it as a way to reduce the deficit. Second, when we decided to roll welfare reform into the balanced budget bill in 1995, we never stopped the conference committee efforts to resolve the differences between the versions of the welfare reform legislation that passed in the House and Senate earlier in the year. This continuation of work, along with the active participation of the governors, allowed us to quickly produce the final bill in conference the next year, once it became clear that President Clinton was now finally ready to sign welfare reform.

In contrast, the Democrats have done an end run around the conference committee process that would resolve the differences between the House and Senate bills, instead trying to negotiate their final bill in secret at the White House. This process continues today, with President Obama, Nancy Pelosi, and Harry Reid exploring different tricks they can use to ram a bill through their respective chambers without first producing a conference bill.
Third, welfare reform was passed with overwhelming bipartisan support, with more Democrats voting for it in the House and Senate than opposing it. It was signed by a Democratic President. Bipartisanship was integral to the success of the bill.

Today, Democrats are turning to passing the bill using the reconciliation process precisely because they are rejecting bipartisanship. Republican Scott Brown's stunning election in Massachusetts, thanks largely to opposition to the left's health bill, has meant that the Democrats would need at least one Republican vote to break a filibuster in the Senate. And their bill is so bad they can't get one.

Finally, and perhaps most importantly, welfare reform was overwhelmingly popular with the American people. One poll showed that over 90 percent of Americans favored reform, including 88 percent of those on welfare.

As for the left's health bill, after a year of debate and discussion, the American people have overwhelmingly rejected it. A poll we released at the Center for Health Transformation showed that it is opposed by a 2-1 margin. It is a fact that the more Americans learn about the left's plan, both its substance and the corrupt manner in which it has been passed, the more they oppose it.

Three Corrupt Options for the Left
The left's big government, big bureaucracy health bill is overwhelmingly unpopular with the American people. It is incapable of obtaining any bipartisan support in the Senate.

Faced with this reality, President Obama, Nancy Pelosi and Harry Reid should do the responsible thing and scrap the unpopular bill and start over, focusing instead on smaller pieces of legislation that could obtain bipartisan support.

However, they've made it clear they aren't willing to do this. The Democrats are determined to pass a comprehensive health bill no matter how unpopular it is. This means they have to use reconciliation to avoid needing 60 votes to end debate in the Senate.

There are several corrupt options available to the Democrats using reconciliation.

One option would be for the House to pass the exact same health bill the Senate passed in December (thus avoiding the need for the Senate to marshal 60 votes again for a final bill now that Scott Brown is in office) with an understanding that a separate bill with a series of fixes would be passed immediately afterward using the budget reconciliation process in the Senate.

The left argues that technically, this would keep the use of reconciliation fairly narrow. However, the plain truth of the matter is that the Democrats would be using the budget reconciliation process to pass a bill they could not otherwise pass using the normal legislative process. It is a dirty trick that ignores congressional tradition and the overwhelming opposition to the bill from America.

Another option is for the Democrats to try and pass the full health bill in the Senate with 51 votes using reconciliation and then for the House to pass the same bill that emerges from the Senate.
For all the reasons outlined above, this would be an enormously inappropriate use of the budget reconciliation process. But it also means that the left's endlessly complicated bill that creates hundreds of new regulations, new programs, and new bureaucracies would have to survive the Byrd Rule tests, creating the possibility that by the time all the extraneous provisions are removed, the final "swiss cheesed" legislation would be unrecognizable.

For President Obama, Nancy Pelosi and Harry Reid to promise to pass a bill when they, in reality, don't know what the final bill will look like, is the height of irresponsibility. (Of course, they passed the stimulus without reading it so it would certainly fit with their precedent.)

How Far Are The Democrats Willing To Go?
Which brings us to a third, more drastic option for the Democrats to get their high tax, big government, big bureaucracy health bill passed.

As explained above, under the Byrd Rule, the vice president of the United States is ultimately responsible for deciding whether a provision in a reconciliation bill is extraneous. It is merely tradition that dictates he follow the advice of the parliamentarian, not a Senate rule.
To avoid their legislation being subjected to Byrd Rule tests, the vice president could choose simply to ignore the advice of the parliamentarian on points of order and rule to keep the extraneous provisions in the final bill. Any senator can appeal these rulings, but the appeal may be defeated with a simple majority vote.

To be clear, no vice president has ever acted in this fashion in the history of the reconciliation process. But no one has ever tried to push this kind of bill through reconciliation before either.
With the American people overwhelmingly opposed to the health bill, not to mention every other part of the left's agenda, and the political environment turning increasingly toxic for the Democrats, President Obama, Harry Reid and Nancy Pelosi could decide to make a cynical, calculated political decision.

Faced with the high likelihood of political defeat in November, they could decide it is preferable to pass the bill they want and be defeated rather than to fail to get a health bill (or only a partial bill), and be defeated anyway.

In fact, this seems to be the message Speaker Pelosi was pushing this past weekend , dismissing her caucus' concerns of defeat.

Republicans Must Vow To Replace the Left's Health Bill
If the Democrats are bound and determined to exert all their power and manipulate every rule they can to pass their big government health bill, Republicans may not be able to stop its passage.

We'll find out today as President Obama is set to announce his recommendation on the way forward.

But no matter what President Obama, Speaker Pelosi and Majority Leader Reid decide, the bottom line for Republicans is that they must stand with the American people in opposing this bill.
This doesn't just mean voting against it and using every parliamentary maneuver available to delay its passage.

It also means running on a platform of replacing whatever left-wing health bill the Democrats manage to pass with real health reform that empowers patients and doctors, not bureaucrats, to bring down health costs. And delivering on that promise in 2011 if Republicans gain control of Congress.

And if President Obama is still determined to ignore the will of the people by vetoing the Republican bill after such a clear message from America, it means that the Republican candidate for President in 2012 must run on a platform that includes signing the replacement of the left's big government health bill. After all, no matter what dirty tricks the politician may try to get his way, in America, the people have the final say.

The House, Harkin says, will first pass the Senate bill after Senate leaders show House leaders they have the votes to pass reconciliation in the Senate. Then the Senate will apply pre-arranged "fixes" and pass the bill with 51 votes or more.

Using the bully pulpit of the presidency during the "Sham-Wow Summit" last week, Barack Obama pitched a healthcare reform plan that is in essence just a repackaged version of what we've already seen - with a few new bells and whistles.

Obama was never really interested in "finding common ground."

His sole purpose in the "Summit" was to resuscitate his unwanted, pro-abortion healthcare agenda that should have been dead and buried many months ago!

++ Sadly, the continual arm twisting is taking a toll in the House.

I'm deeply concerned that President Obama's power play and the continual bullying by White House operatives could sway moderates in the House into changing their votes in favor of ObamaCare.

A recent survey of 39 House Democrats who earlier voted against ObamaCare found that NINE now say they may switch their votes. And the liberal media is doing everything in its power to paint those who oppose ObamaCare as "obstructionists."

Here's the danger: The President's speech today could mark a momentum shift in favor of ObamaCare - especially if members of Congress do not hear from the majority of Americans who strongly oppose this pro-abortion, anti-family bill.

In fact, I believe the next week is absolutely crucial. We need thousands of patriotic Americans to respond to this last-ditch effort to force ObamaCare down our throats!

President Obama declared for the first time today that he is prepared to steamroll his troubled health reform legislation through Congress with only Democratic support, a move Republicans denounced as the “nuclear option.”

Signalling that his patience had now snapped after a year-long fight over health reform, Mr Obama laid the ground for Democrats in Congress to muscle the Bill through using a high-risk legislative maneuver known as reconciliation, which overrides a Republican filibuster.

Although he did not use the word “reconciliation”, Mr Obama made clear that is the uncompromising route he now intends to take with his top domestic priority. White House aides and top Democrats on Capitol Hill have also stated in recent days that, in the face of unanimous Republican opposition, the legislation will now be forced through.

By using reconciliation, Democrats can get the health reform package through the Senate with a simple majority, rather than needing the Bill to pass the 60-vote threshold needed to overcome a Republican filibuster. Mr Obama’s party ceded their 60-stong majority in the upper chamber after losing the late Edward Kennedy’s Massachusetts seat in January.

That shock defeat was in large part due to growing public hostility to Mr Obama’s health reforms, which many see as too expensive at a time of exploding deficits. Forcing the Bill through Congress is, therefore, a high-risk strategy that Republicans vowed to exploit.

In a speech from the White House, Mr Obama conceded the risks involved. “I don’t know how this plays politically, but I know it's right”, he said.

He added: “The American people…are waiting for us to lead. And as long as I hold this office, I intend to provide that leadership.”

He added: “We have debated this issue thoroughly, not just for a year, but for decades.”

Mr Obama rejected Republican calls to start drafting new legislation. “For us to start over now could simply lead to delay that could last another decade or even more.

“I have therefore asked leaders in both houses of Congress to finish their work and schedule a vote in the next few weeks.”

The push for a swift endgame to the bruising health care battle was carefully choreographed by the White House after Mr Obama’s “bipartisan” health care summit with congressional Republicans last week.

He used that encounter to place four Republican ideas into his final health reform package today. That enabled him to declare that he was reaching out to the opposition, at a time when Democrats are in fact preparing to shut them out of the process altogether.

Eric Cantor, the number two Republican in the House, said: “If the president simply adds a couple of Republican solutions to a trillion dollar health care package that the American people don’t support, it isn’t bipartisanship. It’s political cover.”

Mitch McConnell, the senior Republican in the Senate, warned that Republicans would use the health care issue to damage Democrats in November’s congressional mid-term elections.

If the Democrats “jam” an expensive Bill through Congress, Mr McConnell added, “it will be the issue in every single race in America this fall.”

Reconciliation is a procedure created in 1974 that was designed at the time to help Congress push through difficult budget legislation, and in particular measures aimed at cutting deficits. These could not be filibustered and would only need a simple 51 vote majority in the Senate to pass. It was therefore designed to address fiscal, and not social policy. Mr Obama and Democrats have, therefore, been stressing in recent months that his reforms are aimed at reducing long-term deficits by cutting health costs.

Both parties have used reconciliation more than 20 times each since 1980, but never to pass a piece of legislation as expensive as sweeping as Mr Obama’s health reforms. Bill Clinton used it to overhaul the welfare system; President Reagan to give health benefits to people who lose their jobs. George W Bush used it twice to ram through huge tax cuts in 2001 and 2003.
