Good News for Justina Pelletier: She May Finally Get to Go Home

Some very good news…

Life News: In a dramatic reversal, the Massachusetts’ Department of Children and Families (DCF) has filed a motion with the courts agreeing with our petition to have Justina Pelletier returned home to her family.

The motion for review of reconsideration and dismissal in the case of Justina Pelletier follows Liberty Counsel’s motion to return Justina home which was filed less than two weeks ago. The motion indicates that DCF is in agreement with returning custody of Justina to her parents!

justinapelletier6DCF’s concession completely undercuts their argument and reasoning for performing a “parent-ectomy” and removing Justina from the care of the Pelletiers in the first place.

She is now getting treatment from Tuft’s medical providers where she was receiving effective treatments before Boston Children’s Hospital intervened.

The entire process is now waiting on the judge. At this point, there is no reason to delay. There’s no reason why he can’t act immediately!

We have filed a motion asking Judge Joseph Johnston to expedite a ruling since all parties are in agreement. A ruling could come any day now.

Every hour she’s not back with her family is an hour she can’t ever get back. Once she does get home, she’ll have a long road to recovery — physically, mentally and spiritually.

Justina has now lost well over a year of her life with her family. The Pelletiers have spent untold hours and an enormous amount of resources fighting “Goliath” to get their daughter back from the misguided actions of an out-of-control state agency.

Justina has recorded a special video plea to Juvenile Court Judge Johnston and Governor Deval Patrick begging them to allow her to go home.

If You Vote for Congressmen Who Support Obamacare, You’re Voting for Obamacare

Many people were angry with Justice Roberts when he declared Obamacare constitutional and I was one of them. He furthered angered the right with these quotes:

“We do not consider whether the Act embodies sound policies. That judgment is entrusted to the Nation’s elected leaders.”

“Members of this Court are vested with the authority to interpret the law; we possess neither the expertise nor the prerogative to make policy judgments. Those decisions are entrusted to our Nation’s elected leaders, who can be thrown out of office if the people disagree with them. It is not our job to protect the people from the consequences of their political choices.”

Now I have to say that he was right. If we want to change the law, we have to vote the Obamacare politicians out of office. We cannot rely on the Supreme Court of the United States, it is not their job.

We, the American people, voted for Obamacare, not once, but repeatedly by electing and re-electing politicians who support Obamacare. We did it here on Long Island when we re-elected congressmen Tim Bishop, Steve Israel, and Carolyn McCarthy, among others. Virginia did it when they recently elected Governor-elect McAuliffe. In fact, McAuliffe ran on Medicaid expansion and Obamacare. He took the election as a referendum for both.

Debbie Wasserman-Schultz said Democrats will be able to run on Obamacare in 2014.

Will they?

We should be most mindful of the 12 Senators who voted for Obamacare, any one of them could have stopped the law which passed with 60 votes.

We voted for them as Justice Roberts indicated.

Consider the words of Nancy Pelosi, “…but we have to pass the bill so you can find out what’s in it, away from the fog of the controversy”:

Despite this, we voted for Obamacare by electing these politicians who did not read the bill and did not know what was in the bill.

Will we do it again?

The following are the names of the Senators who cast decisive votes for Obamacare. If you vote for them again, you are voting for Obamacare. There is no other way to look at it. If you don’t want Obamacare, you cannot vote for these Senators:

Mark Begich, Alaska; Dick Durbin, Illinois; Al Franken, Minnesota; Kay Hagan, North Carolina; Mary Landrieu, Louisiana; Jeff Merkley, Oregon; Mark Pryor, Arkansas; Jack Reed, Rhode Island; Jeanne Shaheen, New Hampshire; Mark Udall, Colorado; Tom Udall, New Mexico; Mark Warner, Virginia.

These senators are now scrambling for cover and looking for ways to make it appear as if they didn’t support what they wholeheartedly supported – The Affordable Care Act. They were given multiple opportunities by the House to adjust the bill in the past three years and they refused.

Mary Landrieu is putting through a bill now that will supposedly allow people to keep their present coverage as President Obama promised. It is co-sponsored by Obamacare supporter, Dianne Feinstein, whose state now has 1 million people losing their insurance.

Mary Landrieu has been an ardent supporter of Obamacare from day one. She flew on Air Force One with Mr. Obama two weeks ago but made certain she was not photographed with him.

Are you going to fall for their ploys?

These people do not have our best interests at heart. They wanted to support Mr. Obama, not us. They do not deserve to be our representatives.

Make no mistake, a vote for them is a vote for Obamacare.

If you vote for them again, you will get what you deserve and Justice Roberts would agree.

As an aside, healthcare.gov won’t be ready by December 1st as promised by Mr. Obama. Jay Carney said it will be ready for a lot of people. They plan to put peoples’ personal and financial information at risk on a site that is somewhat working.

An exuberant President Barack Obama declared on Tuesday, April 1st that his signature medical insurance overhaul is a success, saying it has made America's health care system 'a lot better' in a Rose Garden press conference.  He even called it ObamaCare, officially taking ownership of that handle as well as of the bill.  It will be his legacy, good or bad! 

However buried in the supposed 7.1 million enrollments that he announced in a heavily staged appearance is an even more unsettling reality.

The numbers from a RAND Corporation study that has been kept under wraps suggests that barely 858,000 ‘previously uninsured’ Americans, in whose name all this was done, have paid for their new policies and nowhere to join the ranks of the insured by Monday night.  In fact, the CBO reports that in the end after millions lose their healthcare, will be paying more and our system eventually goes to a single-payer socialized medicine system, that will include death panels and a shortage of doctors, there will still be 31 million uninsured.

In fact, many of the others who are included in the 7.1 million, include millions who lost coverage when their existing policies were suddenly cancelled because they didn't meet Obamacare's strict minimum requirements.  But the president still claimed that 'millions of people who have health insurance would not have it' without his insurance law.'

'The goal we’ve set for ourselves – that no American should go without the health care they need ... is achievable,' Obama declared.

The president celebrated the end of a rocky six-month open-enrollment period by taking pot shots at Republicans who have opposed the law from the beginning as a government-run seizure of one-seventh of the U.S. economy.  Curiously he never mentioned HHS Director Sibelius who was sitting in the front row.

The president also chided conservatives 'who have based their entire political agenda on repealing it,' and praised congressional Democrats for their partisan passage of the law without a single GOP vote.

'In the end,' Obama warned the GOP, 'history is not kind to those who would deny Americans their basic economic security. ... That's what the Affordable Care Act represents.'

'“The bottom line is this,' said the president: 'The share of Americans with insurance is up, and the growth in the cost of insurance is down. There’s no good reason to go back.'

'We could not have done it without them, and they should be proud of what they've done,' Obama boasted, in a clear nod to November's contentious elections in which Republicans are expected to make large gains on an anti-Obamacare platform because of the law's general lack of popularity. 

We shall see who has the last the laugh when the actual facts and numbers surface.

The anti-bossy campaign is just the latest example of the Left’s obsession with gender, sex, and sexuality as a way of remaking society

Little-girl-scolding-puppy-225x300 The Razor: In America, it used to be that boys were boys and girls were girls, except for a handful of boys and girls who didn’t conform to the norm.  Boys were at the top of the heap; girls had a carefully carved out, limited sphere of influence and opportunities; and sexually non-conforming people were ignored or abused, depending on both their ability to blend in and their community’s ability to cope with their differences.  Both women and sexually non-conforming people were routinely denied equal treatment under the law.

The women’s lib and gay rights movements were originally sold as a way to ensure that women and gays (and, eventually, the whole LGBTQ spectrum) received equal treatment under the law.  That was originally understood to mean equal access to education, employment opportunities, and house; equal pay for equal work; and freedom from overt, violent discriminatory practices — and that was it.

Since then, equal treatment under the law has become a picayune, limited goal.  Instead, the Left is using gender and sexuality as a way to remake society entirely in opposition to heterosexual males, the ones who created Western society in the first place.

The latest push to remake society is the effort either to ban the word “bossy” or to turn it into an undiluted positive when the word is applied to girls.  This, of course, ignores the reality of bossy little girls.

Girls are bossy, something that comes about because they model themselves on their mothers.  Despite decades of Leftist marriage, gender, and sexuality rejiggering, for most children, Mom is the Big Boss in the house.  (Indeed, considering the soaring number of single moms, she’s the only boss in the house.)  The vast majority of little girls identify with mommy.  That’s a fact that no gender theory will ever change.  So if Mommy is bossy — as she has to be in order to run a household with children — then a little girl’s logical assumption is that, to be a grown woman in training, she too must be bossy.

And what about the claim that we’re all wrong to say it’s obnoxious when girls are bossy?  I couldn’t disagree more.  It’s incredibly obnoxious when girls are bossy.  What’s appropriate coming from a grown woman with responsibilities is profoundly irritating whether a 4-year-old lisps orders to her friends, a 10-year-old hollers imprecations at her brother, her a 15-year-old, in a strident whine, tells her parents what she wants them to do.  It’s obnoxious not because the 4, 10, and 15-year-old are female, but because they haven’t yet earned the right to boss anyone around.  The issue is age, not sex.

Even as the Leftist/Progressive/Democrat establishment seeks to make it so that every girl’s fecal matter is perceived as perfumed, the relentless attacks on boys never end.  Fortunately for me (’cause I’m lazy), I don’t have to go into detail on this topic because Matt Walsh has already done so, saying what I would say, only doing it better.

So let me just skip ahead to a discussion of the Left’s latest attack on America’s last bastion of masculinity:  the military.  The military used to be the place where you sent your boys to become men.  Now?  I don’t know.  The military is still overwhelmingly male, but the Obama administration, even though it cannot change the numbers, is doing its best to change its manly ethos.

Gays can openly serve now, which puts a great deal of pressure on young men.  While the Left will freely acknowledge that women shouldn’t have to shower with men who view them in a sexually predatory fashion, and that women in the military are at risk of becoming victims of violent sexual attacks from predatory men, the Left refuses to acknowledge that gay men can be equally predatory to other men.  (And lesbian women are often predators to other women.)  Under the new paradigm, shying away from showering with an aggressive gay man or lesbian woman isn’t logical self-preservation and respect for ones own sexual integrity; it is, instead, homophobic and the people holding such views must be re-educated and/or destroyed.  It’s an interesting social experiment, but a disastrous burden to place on an institution that has as its primary task combat training and preparation to fight off enemies of unspeakable savagery.

Placing women in combat is also a de-masculinizing effort (yes, it’s a neologism) on the Obama administration’s part.  Training standards will have to be lowered because it’s the extraordinarily rare woman who can compete head-on physically with men.  Men are bigger and stronger.  They have stronger bones and joints.  Their skin is tougher and has fewer nerves, meaning it’s less sensitive to pain.  They get less breathless.  They can pee standing up or into old water bottles, and they don’t have periods or get pregnant.  They are vulnerable to rape (see the above paragraph), but less vulnerable, especially because cultures other than America subscribe to the Red Army’s approach to despoiling conquered women.

The only way women can compete equally with men is to lower the standards for men.  This means that young men will not be challenging themselves as much.  To the extent many join the military because men need challenges, the military becomes less attractive.  Additionally, young men aren’t fools.  They know that women will create physical and emotional drags on a combat unit.  Only in the Ivory Tower, surrounded by theory, would people think that women with their different biology are identical to men for all purposes, including combat.

Having turned the military into a Progressive experiment for gays and women, now what do we do?  We bring transsexuals into the military.  Although the number of transsexuals in the military will of necessity be small (there aren’t that many around), I suspect the transsexual-infused military will be a different animal from what it currently is.  Libby, one of my wonderful commenters, found this interesting tidbit about transsexuals:

The American Foundation for Suicide Prevention report on suicide attempts among transgender and non-gender conforming adults (Jan.2014)  found that the while rate for suicide attempts in the general US adult population is about 4.6%, in transgender people, the rate is 41% (46% for trans men).

transsexuals are deeply, deeply unhappy people, who wear their own bodies like a painfully ill-fitting outfit.  I feel nothing but compassion for their anguish (an anguish that gender reassignment may do nothing to help).  Having said that, I am appalled that our president somehow thinks that the military will be the group therapy environment these troubled souls need.  He is using America’s front line defense against a dangerous world to normalize that which, statistically and biologically speaking, isn’t normal.*

There is nothing closer to who and what we are than are gender and sexual orientation.  A wise friend of mine thinks that Islam’s entire beef with the Western world is the fact that, as Westernism creeps into Muslim communities, women fight to leave the harem, the burqa, and the hijab.  All other insults to the religion are tolerable, except for the one that shakes up the relative values between men and women under Islam.

The Left understands this, but it heads in an opposite direction from Islam.  Rather than attacking women and gays to gain control over culture, it attacks heterosexual males.  This is why, beginning when they’re just little children, America’s males are systematically demeaned and insulted.  They are also deprived of opportunities to express their masculinity in positive ways and, instead, are reduced to expressing it through computer games, random violence, and perpetual dorm-style sloth and slobbery.  If you want to see the end of a sustained Leftist attack on men, you need only look to the American black community, where men have been rendered useless.  The government fulfills all the functions women need (shelter, food, health care, and child care), leaving the men responsible only for spread sperm.  No wonder, then, that black men have developed a culture focused on the size of their weapons (both of which, ironically, are tucked in the pants):  guns and penises.

*No, I’m not saying people on the LGBTQ spectrum are “perverts” or “sickos,” or that they should be ridiculed, humiliated, discriminated against, hanged, beaten, imprisoned, or anything else.  I don’t believe that.

What I do believe is that love and physical desire are a combination of mind, biology, and culture, and that, when it comes to consensual adult relationships, it’s my business to stay out of it.  When I look at people, I judge them on values other than their sex partners, values such as individual freedom versus government control, stable relationships versus promiscuity, hard work versus parasitism, kindness versus cruelty, etc..  I do, however, reserve the right to look down upon people if their choice of sex partner is their only value.

So, rather than sit in judgment on LGBTQs, what I’m trying to say is that non-heterosexual orientations are statistical anomalies and that it is impossible to build a culture around a biological statistical anomaly.  It won’t stick.

Examiner Editorial: Why does Nancy Pelosi fear an Obamacare inspector general?

Washington Examiner: Among the least-heralded public servants in the nation's capital are the 73 inspectors general established by Congress to root out waste, fraud and inefficiency in the executive branch. With teams of thousands of auditors and inspectors, the IGs issue hundreds of investigative and audit reports that send a steady parade of crooks to jail while saving taxpayers hundreds of billions of dollars every year. Unfortunately, it's doubtful that one out of 100 Americans could name a single IG.

That anonymity is a key to their success, however, because it helps keep the focus on the job at hand and away from political considerations that can derail the pursuit of justice. So it's particularly disappointing to see House Minority Leader Nancy Pelosi blatantly playing politics with the imminently reasonable proposal of Rep. Peter Roskam to create an IG for Obamacare. The Illinois Republican announced his proposal Thursday, and no sooner had he done so that Pelosi made clear her opposition to it.

Asked about the Roskam proposal at her daily news conference, Pelosi said: “No. Each of the committees of jurisdiction has oversight, so the congressional oversight is something that I support. Each of the agencies of government that are implementing the law, the Affordable Care Act, have their own inspectors general. I think that the system has enough appropriate oversight. I don't see any reason to go to that point.”

Of course, there are oversight committees of Congress for all 73 of the departments and agencies that presently have IGs, but none of those federal entities control one-sixth of the U.S. economy or trillions of dollars in federal spending. So why would Pelosi be opposed to an Obamacare IG?

Roskam found the likely answer in Pelosi's position on previous proposals to create IGs. He noted that Pelosi enthusiastically supported creation of IGs for the U.S. war efforts in Iraq and Afghanistan, as well for the Toxic Asset Recovery Program, the federal relief effort to victims of Hurricane Katrina and the intelligence community. Perhaps its merely coincidental, but every one of those IG proposals came when a Republican president was in the White House. Now that a Democrat works in the Oval Office and is responsible for the biggest federal entitlement program ever created, Pelosi thinks an IG is unnecessary.

Pelosi was speaker of the House when Congress approved the $700 billion Wall Street bailout in 2008 with a Special Inspector General for TARP. As Roskam pointed out last week, the SIGTARP has since “identified $5.3 billion in restitution and savings, including $533 million in direct taxpayer savings. In comparison, the healthcare law is estimated to cost $1.8 trillion when fully implemented, dwarfing TARP's cost to taxpayers.”

It was also Pelosi who famously said of Obamacare that “we have to pass it so you can see what’s in it.” Remember, too, that Obamacare was written behind the closed doors of Pelosi’s office. Could it be there’s something in Obamacare that she fears an Obamacare IG will expose?

Ezekial Emanuel Is Really Looking Forward To The Demise of Insurance Companies

PJ Tatler: Ezekial Emanuel, the brother of Rahm Emanuel and former health care adviser to President Obama, is just salivating at the thought of the demise of health insurance companies. Why, he’s downright gleeful.

Ezekial Emanuel, brother of Chicago mayor and former Obama staffer Rahm Emanuel, is cheerily predicting that Obamacare will bring about the death of the private insurance companies in the US. Ezekiel makes the provocative prediction in the New Republic.

Emanuel writes that Obamacare is already causing insurance companies to either die or evolve into something else. “The good news is you won’t have insurance companies to kick around much longer,” he writes.

Obamacare was not sold to the American people as a means of destroying private health insurance companies or even forcing them into turning into a different type of company. It was sold as a means of bringing insurance costs down while increasing access. It has turned out to cause about 6.2 million Americans to lose their insurance while forcing some Americans to buy insurance or pay a fine to the IRS. “If you like your healthcare, you can keep your healthcare,” President Barack Obama repeatedly promised. Emanuel’s article provides more evidence that the president was knowingly lying, and that people like Emanuel, who were close advisers while Obamacare was being written, knew that it would cause chaos for millions of Americans and their insurance.

Emanuel writes that Obamacare is already causing some medical services providers to seek exclusive contracts with employers, cutting insurance plans out but also limiting the choices available to customers.

Ezekiel has consistently predicted, after Obamacare became law, that it would kill insurance companies. While Obamacare was being debated, Democrats denied that its purpose was to destroy private health insurance companies. Emanuel claims, without providing any evidence, that Americans will be happier in the new employer-based health provider networks.

“So be prepared to kiss your insurance company good-bye forever,” Emanuel concludes at the end of the article.

About 85% of Americans were happy with their healthcare before Obamacare.

It’s really no secret that the Democrats’ plan all along was single payer. Some just aren’t willing to admit it.

Update: Emanuel appeared on Morning Joe talking about how great Obamacare is doing. He didn’t, however, mention his glee at the coming demise of the insurance companies. 

He also did not mention his creepy ‘Complete Lives System’. In 2009 Betsy McCaughey warned about Obama’s Health Rationer-in-Chief and now we are standing at the door…

More Black Babies Aborted Than Born in NYC

RUSH/EIB: If I may get solemn and serious, as this requires, there is shocking news out of New York. I don't know how shocking it is, but it's really bad, and it's Cybercast news service, but the actual source of this is the New York City Department of Health and Mental Hygiene.  So this is a city source: "In 2012, there were more black babies killed by abortion (31,328) in New York City than were born there (24,758)..."

So out of a possible 56,000 black babies in New York City in 2012, 31,000 were aborted and 25,000 were killed, "and the black children killed comprised 42.4% of the total number of abortions in" New York City. This is shocking.  Let me run these numbers by you again, because I know they're tough to follow on radio and I screwed up the addition.  So there were, give or take, 56,000 black pregnancies in New York City 2012.

And 31,000 of the 56,000 were aborted and 25,000 were born.  The 31,000 aborted was almost 50% of the total number of abortions, but the African-American population is only, what, 11 to 13%.  These are striking numbers, and this is... Dare I go there?  Yes, I do.  This is exactly what Margaret Sanger had in mind when she came up with the whole notion of Planned Parenthood and eugenics. 

I've always been amazed that the white, liberal elite champion Margaret Sanger, when it wouldn't take anything for Jesse Jacksons and Al Sharptons to go back and figure out who she is what she really wanted. How in the world there's any support for whatever Margaret Sanger attached her name to is beyond my ability to comprehend.  Well, no it's not, because I know the left. These people that are relying on the Democrat Party to protect them to take care of them, to guard them against whatever extremism might be coming their way from conservative Republicans, are wiping themselves out -- with the support of and the recommendation of the Democrat Party -- which puts abortion in top two of the most important issues going.  It's just amazing here, and when you look at the reality of this and then you understand who it is they blame for their lot in life and their plight?

Obamacare will double my monthly premium (according to Kaiser)

That’s  right… the Progressive website, the Daily Kos, reported that according to Kaiser, people’s healthcare premiums, under the new Affordable Care Act, ObamaCare, are doubling for some.

Daily Kos: My wife and I just got our updates from Kaiser telling us what our 2014 rates will be. Her monthly has been $168 this year, mine $150. We have a high deductible. We are generally healthy people who don't go to the doctor often. I barely ever go. The insurance is in case of a major catastrophe.

Well, now, because of Obamacare, my wife's rate is gong to $302 per month and mine is jumping to $284.

I am canceling insurance for us and I am not paying any fucking penalty. What the hell kind of reform is this?

Oh, ok, if we qualify, we can get some government assistance. Great. So now I have to jump through another hoop to just chisel some of this off. And we don't qualify, anyway, so what's the point?

I never felt too good about how this was passed and what it entailed, but I figured if it saved Americans money, I could go along with it.

I don't know what to think now. This appears, in my experience, to not be a reform for the people.

What am I missing?

I realize I will probably get screamed at for posting this, but I can't imagine I am the only Californian who just received a rate increase from Kaiser based on these new laws.

UPDATE: Updated the title per some requests. I appreciate all the helpful comments. I am   now on baby duty but will go through these later for more information. I can't keep up with all the comments right now.

How Cells from an Aborted Fetus are Used to Create Novel Flavor Enhancers

For several years anti-abortion advocates have been warning that a new technology for enhancing flavors such as sweetness and saltiness uses aborted fetal cells in the process.

The biotech company using this novel process, Senomyx, has signed contracts with Pepsi, Ajinomoto Co. (the maker of aspartame and Meat Glue), Nestlé and other food and beverage companies2 over the past several years.3

The primary goal for many of these processed food companies is to make foods and beverages tasty while reducing sugar and salt content.

While Senomyx refuses to disclose the details of the process, its patent applications indicate that part of the secret indeed involves the use of human kidney cells, known as HEK293, originating from an aborted baby.

It’s worth noting that no kidney cells, or part thereof, are actually IN the finished product.4 Rather they’re part of the process used to discern new flavors, which will be discussed below.

That said, to many, this is still “over the line.” Two years ago, anti-abortion groups launched boycott campaigns against Pepsi Co., urging them to reconsider using flavorings derived from a process involving the use of aborted embryonic kidney cells.

Whatever your personal convictions might be on the issue of using biological material from an aborted fetus, the issue of whether or not biotech-constructed flavor enhancers are safe or not remains...

Biotech Cooks Up New Flavors

Senomyx5 is a high tech research and development business that is "dedicated to finding new flavors to reduce sugars and reduce salt." These include new flavors such as Savory Flavors and Cooling Flavors, as well as flavor modulators such as Bitter Blockers and enhancers of Sweet and Salt tastes.6

Senomyx is also engaged in a new effort to discover and develop high-potency sweeteners to replace high fructose corn syrup, artificial sweeteners, and natural herb sweeteners like Stevia, which some people object to due to its aftertaste.

To accomplish this, Senomyx has developed patented “flavor enhancing” compounds using "proprietary taste receptor-based assay systems." It’s a taste testing system that provides scientists with biochemical responses and electronic readouts when a flavor ingredient interacts with their patented receptor, letting researchers know whether or not they’ve “hit the mark” in terms of flavor. As described by Senomyx:7

“Flavors are substances that impart tastes or aromas... Individuals experience the sensation of taste when flavors in food and beverage products interact with taste receptors in the mouth. A taste receptor functions either by physically binding to a flavor ingredient in a process analogous to the way a key fits into a lock or by acting as a channel to allow ions to flow directly into a taste cell.

As a result of these interactions, signals are sent to the brain where a specific taste sensation is registered. There are currently five recognized primary senses of taste: umami, which is the savory taste of glutamate, sweet, salt, bitter and sour.

Senomyx has discovered or in-licensed many of the key receptors that mediate taste in humans. We created proprietary taste receptor-based assay systems that provide a biochemical or electronic readout when a flavor ingredient interacts with the receptor.”

According to an article in The New Yorker8 published in May 2011, Pepsi’s New York plant has a robot fitted with human taste buds to reliably “predict” what humans might like. To create this robotic taste tester, Pepsi Co. scientists injected the genetic sequences of the four known taste receptors into cultured cells, and then hardwired the cells to the robot’s computer. The robot (which has replaced human taste testers for the initial taste trials) can sample some 40,000 flavor assays per day.

What are These Genetically Engineered 'Flavor Enhancers,' and are They Safe?

According to a CBS News report from June 2011, 70 out of 77 Senomyx patents9, 10 filed at that time referred to the use of HEK 293.11 These are human embryonic kidney cells originally harvested from a healthy, electively aborted fetus sometime in the 1970’s. The “HEK” identifies the cells as kidney cells, and the “293” denotes that the cells came from the 293rd experiment.

These cells have been cloned for decades, as they offer a reliable way to produce new proteins using genetic engineering. Senomyx has engineered HEK293 cells to function like human taste receptor cells,12 presumably such as those used in Pepsi Co’s taste-testing robot. This was done by isolating taste receptors found in certain cells, and adding them to the HEK cells.

HEK cells are also widely used within pharmaceutical and cell biology research for the same or similar reasons. It is however the first time HEK cells have been used in the food industry, which carries a certain “ick” factor for many. There’s also the issue of just not knowing how these new flavors are created. As stated in another CBS news report:13

So what exactly is this magic ingredient that will be appearing in a new version of Pepsi, and how is it made? Unfortunately, those questions are hard to answer. Senomyx... refers to them only as 'enhancers' or 'ingredients'... The products work by triggering receptors on the tongue and tricking your taste buds into sensing sweetness — or saltiness or coolness, in the case of the company's other programs...

So are Senomyx's covert ingredients safe? That, too, is anyone's guess... many of its enhancers have 'been granted' GRAS (Generally Recognized As Safe) status, but all that means is that the company did its own assessment and then concluded everything was fine. We don't know whether Senomyx did any testing since the company isn't required to submit anything to the FDA.14

There's no reason to think that Senomyx's products will cause harm, but until or unless Pepsi decides to share details about how exactly it's achieving a 60 percent reduction in sugar while keeping the taste the same, customers will be drinking their 'scientifically advantaged' sodas completely in the dark.”

The lack of labeling requirements is particularly troublesome and will probably become an issue in the future. Since these compounds (whatever they are) are used in such minute quantities, they don’t have to be listed on the label. They’ll simply fall under the generic category of artificial and/or natural flavors. What this means is that the product will appear to be much “healthier” than it might otherwise be, were a flavor enhancer not used.

According to a 2010 CBS report,15 Senomyx’s flavor enhancers were already being sold outside the US at that time. For example, Nestle was by 2010 using an MSG flavor enhancer in its Maggi brand soups, sauces, condiments and instant noodles, and Ajinomoto was also using a similar ingredient in products for the Chinese market. This means less of the artificial sweetener is needed to create the same sweet taste as before, but while one could argue that this is a good thing, I suspect we will ultimately learn that this flavor enhancement method has multiple unforeseen adverse consequences — metabolically, and biologically.

Consequences of Food Alteration are More the Rule than the Exception...

There are many reasons why you're better off choosing natural whole foods in lieu of processed alternatives, but one of the primary ones is that junk foods contain additives that increase your toxic load, which in turn may increase your tendency to develop cancer. As of yet, there is NO medical research to back up the assertion that manipulating your taste buds in the way Senomyx’ products do is safe and healthy in the long term. As an example, I would point to the evidence now available showing that one of the reasons why artificial sweeteners do not work as advertised is because the taste of sweet itself is tied into your metabolic functioning in a way that we still do not fully understand... As a result, artificially sweetened products, oftentimes boasting zero calories, actually result in greater weight gain than sweetened products when used “in the real world.”

It's easy to forget that the processed, pre-packaged foods and fast food restaurants of today are actually a radical change in terms of the history of food production. Much of what we eat today bears very little resemblance of real food. Many products are loaded with non-nutritive fillers — purposely designed to just “take up space” to make you think you’re getting more than you really are — along with any number of additives. Many additives have been shown to have harmful effects on mood, behavior, metabolic functioning and biochemistry.

Now, with the introduction of untested engineered flavor enhancers, you’re left wondering whether processed foods with “cleaner” labels really are safer and healthier or not... Remember, because Senomyx’ flavor enhancers are used in such low concentrations they are not required to undergo the FDA's usual safety approval process for food additives.

The disease trends we're now seeing are only going to get worse as much of the processed foods consumed today are not even food-based. Who knows what kind of genetic mutations and malfunctions we're creating for ourselves and future generations when a MAJORITY of our diet consists of highly processed and artificial foods that contain substances never before consumed by humans in all of history.

Obamacare: The epic fail act

Even the left is realizing that Obamacare is not going to work.

Of course, the left does not want Obamacare repealed because Obamacare has never been about insurance or even medical care. It has always been about power.

So what do liberals do when they realize they have a problem? The keep digging the hole deeper.

As the state moves to expand healthcare coverage to millions of Californians under President Obama's healthcare law, it faces a major obstacle: There aren't enough doctors to treat a crush of newly insured patients.

Some lawmakers want to fill the gap by redefining who can provide healthcare.

They are working on proposals that would allow physician assistants to treat more patients and nurse practitioners to set up independent practices. Pharmacists and optometrists could act as primary care providers, diagnosing and managing some chronic illnesses, such as diabetes and high-blood pressure.

"We're going to be mandating that every single person in this state have insurance," said state Sen. Ed Hernandez (D-West Covina), chairman of the Senate Health Committee and leader of the effort to expand professional boundaries. "What good is it if they are going to have a health insurance card but no access to doctors?"

Hernandez's proposed changes, which would dramatically shake up the medical establishment in California, have set off a turf war with physicians that could contribute to the success or failure of the federal Affordable Care Act in California.

Doctors say giving non-physicians more authority and autonomy could jeopardize patient safety. It could also drive up costs, because those workers, who have less medical education and training, tend to order more tests and prescribe more antibiotics, they said.

Isn’t that typically liberal.

Instead of letting the free market work, Democrats must legislate another failure.

What happens when we run out of Doctors, nurses and Physician assistants?

In California, I’m sure they will just approve witch doctors to do medical treatment.

Real Danger of “Obamacare”: Insurance Company Takeover of Health Care

Election rhetoric shuns the big picture in favor of the bigger platitude. Now that The Show is over, we are left with the equivalent of a Sunday morning hangover following a binge of promises and lies. We leave the theatre of political spectacle on steroids for the real world of unstable economy, a globally and publicly subsidized financial sector, and increased costs of living on everything from food to education to health-care; outpacing declining median incomes. The average cost for health insurance for a family is $15,745 per year vs. a median income of $50,502, or about half post-tax take-home pay.

“Obamacare” is the name commonly used for the Patient Protection and Affordable Care Act (PPACA) of 2010. The very moniker is indicative of how name-and-image-centric our world has become; Medicare was never called “Johnsoncare” when President Johnson signed it into law in 1965 and Johnson was not exactly a man of small-personality. At any rate, Obamacare or the PPACA ranks as one of the most misrepresented issues from the campaign, by both sides of the ever-slimming aisle.

The Tea-Party Conservative types get it embarrassingly wrong when they call it a “government takeover of health care.” Likewise, Progressive Obama-supporters are deluded in accepting it as the most sweeping healthcare reform since Medicare. (Side note: I wish the word ‘sweeping’ could be retired from politics until it actually means -sweeping.)

Here’s why. The PPACA does nothing to restructure the health insurance industry, anymore than the Dodd-Frank Act restructures the banking industry. This means everything else it attempts to do, positive or negative, will be vastly overshadowed by an industry accelerating to morph itself into a acquisition machine in order to circumvent anything that even smells like a restriction, including laws that exist and ones to come.

How? By doing the same thing energy and telecom companies did after they were deregulated in 1996, and that banks did after they were summarily deregulated (after moving that way for decades) in 1999. They are merging, consolidating, eliminating competitors, and controlling their domain. They are manufacturing power.

Investment bankers are roaming the world to exploit this hot new opportunity. That’s one reason insurance companies don’t even call themselves that anymore. Now, they are ‘managed health care’ companies. Call yourself a managed health care company, and you can buy everything from other insurance companies to hospitals to clinics to doctors. The more consolidation, the more fees bankers rake in, and the more premiums and medical reimbursements and health care procedures, each company can control.

The result of 1996 energy deregulation was a glut of crime-spawned bankruptcies like Enron. Likewise WorldCom led a pack of telecom degenerates in the production of tens of billions of dollars worth of accounting fraud. The final repeal of Glass-Steagall ignited a merge-fest of investment and commercial banks, their linkages ensuring that taxpayers, whose deposits have been protected since the New Deal, provide a safety-net upon which they can mint toxic assets loosely based on over-leveraged home mortgages, and engage in risky, speculative activity; big banks don’t go bankrupt when they fabricate values or lose big on stupid bets, they get federally subsidized in all sorts of ways.

You know who else is similarly too big to fail? The insurance industry. UnitedHealth Group, the nation’s largest health insurer covers 50% of the insurable population in over 30 states. Blue Cross-Blue Shield, covers 100 million people through a constellation of 38 sub-companies. They, and other insurance companies are growing in breadth. When companies consolidate, the result is less transparency, less competition, and more possibility for fraud and shady behavior. Every. Single. Time.

Obamacare and Accounting Fraud

By January 2014, the PPACA will require insurance companies to list their prices on competitive exchanges. In Obama-theory, this is supposed to reduce premiums via competition. But what if, say, only three companies control nearly all of the premiums? Consider the fact that it costs the same $3 to extract your money from a Chase, Bank of America or Citigroup ATM (if you don’t get it directly from the firm you bank at.) They constitute a monopoly that defies anti-trust inspection (thank you, Department of Justice.) What incentive would any of them have to charge less? None. That’s why they don’t.

Managed Health Care companies don’t just administer private, but government health insurance policies as well. The http://www.healthcare.gov website says that under the PPACA, the life of the Medicare Trust Fund will be extended to 2024 as a result of reducing waste, fraud, abuse, and slowing cost growth. President Obama promised to reduce Medicare fraud 50% by 2012 according to the site – but if he did, he forgot to mention it during the campaign period.

To supposedly combat price hikes, the PPACA calls for a new Rate Review program, wherein insurance companies must justify premium hikes of more than 10% to a state or federal review program. Given that banks aren’t supposed to hold more than 10% of the nation’s deposits in any one institution, and three do, this isn’t a comforting constraint.

While it is positive that the PPACA requires coverage of people with pre-existing conditions and prohibits lifetime caps, it can’t control what people pay for insurance, because it doesn’t limit actual premiums, which have risen 13% on average since the Act was passed.

The medical cost ratio limitation the PPACA instills; that 80% of premiums must be used for medical care in the case of individuals and small groups, and 85% in the case of large groups) to supposedly ensure companies operate on a more efficient premium in vs. premium out basis, is a joke. Its punch line is accounting manipulation. Call everything a medical cost; even buying another company, and the ratio is meaningless.

WellPoint got the Joke

WellPoint got that joke immediately. The largest for-profit “managed health care” company in the Blue Cross and Blue Shield Association, it began trading publicly on December 1, 2004. Depending on the state, it operates under Blue Cross and Blue Shield, Blue Cross or Anthem.

After the PPACA was passed, in March 2010, WellPoint allegedly reclassified certain administrative costs as medical care costs in order to meet the law’s new medical loss ratio requirements (which requires insurers spend at least 80% or 85% of premiums on health care services, depending on the type of plan, individual or group respectively.)

A month earlier, WellPoint announced its Anthem Blue Cross unit would raise insurance rates for some individual policies in California up to 39%. Federal and California regulators are still investigating this, but the premium hikes remained.

WellPoint is also one of Wall Street’s favorite “managed health care” companies; cause it keeps getting bigger through acquisitions that pay hefty fees to the bankers involved. On October 23rd, WellPoint got approval from Amerigroup’s shareholders to acquire Amerigroup, a Medicaid-focused health insurer, in a $4.9 billion cash deal. The deal makes WellPoint the nation’s largest Medicaid insurer, and provides it greater access to Medicaid patients who also qualify for Medicare.

It was the largest cash deal ever, and the largest premium paid for a company in the managed health care realm. As a result, Goldman Sachs (who advised Amerigroup) and Credit Suisse (who advised WellPoint) retained their top positions in the global healthcare deal advisory league table.

The value of Amerigroup, as a company, dropped 34% within two weeks of that agreement, in stark shades of what happened when Bank of America took over Merrill Lynch in the fall of 2008.

This summer, Amerigroup and Goldman Sachs faced a shareholder lawsuit filed by the city of Monroe Employees Retirement System and Louisiana Municipal Police Employees Retirement System. It alleged that Goldman advised Amerigroup to accept WellPoint’s offer quickly, rather than seek other bids, because the bank had structured a complex, and fee-heavy derivatives transaction on the back of the deal. The insurers resolved the suit by tweaking the deal parameters. All parties denied ‘any wrongdoing.’ But where there’s smoke in complex derivatives land, there is fire.

Other Mergers

After the Supreme Court upheld the PPACA, a spate of mergers rippled through the managed health care realm, to ostensibly cope with smaller profit margins and ‘compliance costs.’ But really, it’s because each firm wants to corner as much as possible of the market, in as many states as it can, to garner more premiums and control more disbursements and prices at the upcoming insurance ‘exchanges.’

In late August, the third largest insurance company in the US, Aetna announced it was buying Coventry Health Care for $5.7 billion. Coventry provides Medicare and Medicaid services, thus the takeover expands Aetna’s Medicare and Medicaid business. Being part of Aetna enables Coventry to grab more consumers on more state-run health insurance exchanges, reducing competition in the process. The Department of Justice is examining anti-trust issues surrounding the deal, but it’s still expected to close in mid-2013.

On October 17th, UnitedHealth Group issued $2.5 billion of bonds as part of its $4.9 billion acquisition of Brazil’s Amil Participacoes. Bank of America Merrill Lynch, Goldman Sachs, J.P. Morgan Chase & Co., Morgan Stanley, UBS and Wells Fargo Securities were lead underwriters on the deal.

They are not buying international companies in order to increase accounting transparency. Like other multinationals, they are doing so to move profits around and circumvent restrictions and tax laws. They are using cash, or raising extra debt, to do so, rather than to reduce premiums or increase disbursements to medical professionals.

And if you’re keeping score – billion of dollars are flowing from insurance companies – NOT to reduce premiums to patients and NOT to reimburse doctors and NOT to enhance the quality of care, but to simply expand nationally and globally. Meanwhile, their CEOs are doing quite well from all that non-health care related movement.

Total compensation for the bulk of health care company CEOs rose by 14.7% in 2011 by 14.7%, or $11.1 million, to $87 million. Cigna’s CEO David Cordani made $19.1 million. UnitedHealth Group’s CEO, Stephen J. Hemsley bagged $49 million in salary, stock options, and other compensation last year. The highest-paid CEO made 94 times the average compensation level of primary care physicians. And none of them had to pick up a single scalpel in the process.

Doctors as profit centers

Not just patients, but physicians have been bled steadily from the current state of insurance company controlled health care through diminishing insurance reimbursements, electronic medical records mandates whereby they spend as much time complying with Kafkaesque controls over their decisions on performing surgeries and providing care, and debt. New doctors are graduating with an average of $250,000 in debt, which, combined with diminishing disbursement and soaring costs, will keep many, underwater. Forever.

According to Dr. Michael H. Heggeness, President of the North American Spine Society, a group of 6500 global spinal and orthopedic surgeons (at which I delivered a speech last month), “The last people, that most of the population feels sorry for are doctors, yet they are in an economic crisis of their own. In 2002, 80% were in private practice, now 70% are in hospitals because they can’t afford to make a private practice work.”

Meanwhile the more hospitals are viewed as profit centers, the more their Chairmen will cut costs to maximize returns, and not care quality. They will seeks ways to sell underperforming assets, programs or services and reduce the number of nonessential employees, burdening those that remain. No doubt the private equity community will be getting more into this game, as insurance companies buy more hospitals, doctors, clinics, and perhaps drug companies, or vice versa, and ‘restructuring’ accelerates.

And if insurance companies can manage doctors directly, they can control not just costs, but treatment – our treatment. It’s not an imaginary government takeover anyone should fear; but a very real, here-and-now insurance company takeover, to which no one in Washington is paying attention.
