North Dakota Governor Jack Dalrymple Signs Obamacare Nullification Bill

Apparently deciding that the risk of angering his constituents over a failure to act against Obamacare was worse than angering his Attorney General, Wayne Stenehjem, who holds that the state cannot pass laws contradicting federal law, Governor Jack Dalrymple signed SB2309. The bill affirms that North Dakotans have the right to buy, or not buy, whatever health insurance they want. This law is statute. A previous bill that would have amended the constitution with similar language was defeated with a gang of 29 House Republicans voting with Democrats at the behest of Stenehjem to kill it.

This bill was discussed on Fox News recently by state nullification proponent Tom Woods and Judge Andrew Napolitano. “The new state law, if signed by Dalrymple, says the federal health insurance law can’t interfere with North Dakotans’ decision to buy health insurance or not buy health insurance,” wrote the editorial board of the Minot Daily News though the paper went on to say that the law “won’t make a difference” because state law “can’t override a federal law.”

This, of course, isn’t true. The states are under no obligation to abide by federal laws that are unconstitutional. And since that is the State of North Dakota’s official position on Obamacare in a multi-state lawsuit challenging the law, this law passed by the legislature and signed by the governor is appropriate.

Kudos to Dalrymple for having the courage many other political leaders in this state do not.

EDITOR’S NOTE: Recently, Idaho’s Governor Otter signed an order refusing state compliance with the Patient Protection and Affordable Care Act (Obamacare). With this signature, North Dakota is now the first state in the country to pass into law the Health Care Nullification Act.

Keep Praying!

Today's hearing of our lawsuit against ObamaCare is making national headlines. Many news organizations are reporting on the great significance of my oral argument and Virginia Attorney General Ken Cuccinelli's presentation that will be heard back-to-back by the Fourth Circuit Court of Appeals in Richmond, Virginia.

These lawsuits - one on behalf of private parties and one on behalf of a sovereign state - are the first lawsuits against ObamaCare to reach the appeals court level.

Because the three judges who will hear our case are selected from among the 14 sitting judges in the Fourth Circuit - four of whom are Obama appointees and three of whom are Clinton appointees - preparation for this case has been highly challenging. We cannot know who will be chosen to hear our case tomorrow, so we had to make sure we are very broadly prepared.

How important is our challenge to the constitutionality of ObamaCare? The panel of judges we will face is just one level below the United States Supreme Court. As you may recall, two lower court judges have already declared ObamaCare to be unconstitutional, while certain liberal judges have sided with the so-called healthcare "reform" act.

We are well prepared and calling for continual prayer!

As I wrote on Friday, I'm excitedly anticipating just how powerful the prayers of tens of thousands of Believers will actually be!

I know each of the 76,593 patriotic men and women who signed our Amici Book want our nation to be delivered from the devastation of ObamaCare before it is too late.

Above all, I know God is hearing these prayers and that He Is answering!

20 States Go to Court Today To Challenge ObamaCare - Updated: Court Date Set

PENSACOLA, Fla. (AP) — Twenty states and the nation’s most influential small business lobby plan Friday to file their response to the government’s attempt to dismiss their lawsuit challenging President Barack Obama’s health care overhaul.

The Justice Department in June asked a federal judge to dismiss the lawsuit, saying the U.S. District Court in Pensacola lacks subject-matter jurisdiction over some of the lawsuit’s claims. They also said other parts of the lawsuit failed to state claims upon which relief can be granted.

The states, the National Federation of Independent Business and several individual taxpayers will file their response in Pensacola federal court.

A key issue raised by their lawsuit is whether the federal government can require individuals to purchase health care insurance and fine those who don’t.

The court must hear the case to preserve individual liberties granted through the Constitution, said Karen Harned, executive director of the Small Business Legal Center of the National Federation of Independent Business.

“The federal government does not have the authority to regulate an individual’s decision to do nothing. If they did, then they could force us to purchase any product they want,” she said.

In a statement, Harned said the government’s motion to dismiss was based on “political rhetoric and flimsy legal arguments” and was an attempt to distract the court from evaluating the case’s constitutional issues.

Florida Attorney General Bill McCollum, a Republican candidate for governor, is leading the legal challenge. Other states that have joined the lawsuit are Alabama, Alaska, Arizona, Colorado, Georgia, Indiana, Idaho, Louisiana, Michigan, Mississippi, Nebraska, Nevada, North Dakota, Pennsylvania, South Carolina, South Dakota, Texas, Utah and Washington.

U.S. District Judge Roger Vinson has set a Sept. 14 hearing to consider arguments on the motion to dismiss.

In its motion to dismiss the lawsuit, the Justice Department said the requirement to buy coverage is an exercise of Congress’ constitutional power to tax and spend. Government attorneys also have said that while reasonable people may disagree on issues such as the health care overhaul, it cannot be moved from the elected branches of government into the courts without a genuine constitutional issue, which they maintain is absent in this case.

The states argue the new law will require them to pay additional Medicaid costs not covered by the federal government, but that they cannot opt out of the program for low-income and disabled people because it has become too popular.

They maintain that violates the 10th Amendment, which says the states and people have powers that the constitution does not grant to the federal government nor prohibit the states from having.

The health care law, passed along partisan lines, requires most Americans to carry health insurance — through an employer, a government program, or by buying their own policy. The mandate is effective in 2014. Insurers will then be required to take all applicants, and the government will offer tax credits to help middle-class households pay premiums. Medicaid will be expanded to cover millions more low-income people.

Individuals who refuse to get health insurance will face a tax penalty, with exceptions for financial hardship and religious reasons.

(Reuters) - A Florida judge said on Tuesday he would hear arguments on December 16 on a lawsuit by 20 U.S. states seeking to block President Barack Obama's overhaul of the healthcare system.

District Judge Roger Vinson, who is weighing a motion by the Justice Department to dismiss the lawsuit, set the followup hearing on the lawsuit led by Florida and involving 19 other states, which was originally filed in March by mostly Republican state attorneys general.

Vinson said he would formally rule on the dismissal motion by October 14, but Florida Attorney General Bill McCollum said the judge had already strongly indicated that the case would not be dismissed.

"The judge's apparent decision today means we will proceed," McCollum told reporters.

The lawsuit claims the sweeping reform of the $2.5 trillion healthcare system, pushed through by Obama's fellow Democrats in the Congress after months of bitter partisan wrangling, violates state government rights in the Constitution and will force massive new spending on hard-pressed state governments.

Buried in his massive amendment to the Senate version of Obamacare is Reid's anti-democratic poison pill designed to prevent any future Congress from repealing the central feature of this monstrous legislation!

Beginning on page 1,000 of the measure, Section 3403 reads in part: "It shall not be in order in the Senate or the House of Representatives to consider any bill, resolution, amendment or conference report that would repeal or otherwise change this subsection."

In other words, if President Barack Obama signs this measure into law, no future Senate or House will be able to change a single word of Section 3403, regardless whether future Americans or their representatives in Congress wish otherwise!! (This will be challenged in Court but the audacity and darkness behind this type of legislation speaks for itself.)

Note that the subsection at issue here concerns the regulatory power of the Independent Medicare Advisory Board (IMAB) to "reduce the per capita rate of growth in Medicare spending." without particulars of how and how not to reach this goal.

That is precisely the kind of open-ended grant of regulatory power that effectively establishes the IMAB as the ultimate arbiter of the cost, quality and quantity of health care to be made available to the American people. And Reid wants the decisions of this group of unelected federal bureaucrats to be untouchable for all time.

FACTS - If the Slaughter Method is used:

1. The Senate Bill will be passed as is… including all the kick backs.

2. Abortions will be covered using taxpayer money.

3. The chances of any of the questionable legislation or deals promised to be removed from this bill will not happen.

4. Additional deals are being cut one by one to get the votes on this bill and everyone will cost you money and or freedoms!

5. The takeover of the student loan industry, including federal control over curriculum and ‘service requirements’ for your children is being attached to this bill.

6. There will be no 72-house opportunity for the legislators or the people to read the bill.

7. The 2/3 of negative legislation already passed (see below) as part of the stimulus bill and others will be activated by this bill’s passing.

8. Experts say that the chances of this bill being over-turned, or at least a large part of it, is virtually nil once it passes.

ObamaCare needs to be taken off the table. All versions. Now! No talks. No televised discussions. Nothing... until Congress and the White House agree to START OVER! OR ELSE PLEASE VOTE “NO” ON THIS TRAIN WRECK OF A HEALTH CARE BILL.

I am disgusted by the deceptive tactics employed in recent days - simultaneously planning televised "bi-partisan" discussions while holding back-room meetings on how to ram ObamaCare through with no bi-partisan support. Such underhanded efforts are offensive to me and millions of Americans.

Also, as a pro-life American, I adamantly oppose any healthcare plan that will require me to pay for abortions with my tax dollars. Any government sponsored healthcare system with this mandate is bad for America and violates the deeply held beliefs of many Americans.

Its past time to scrap all the versions of ObamaCare and start over with a constitutionally correct and moral plan with far less government intrusion. I urge you to stand with a clear majority of Americans and oppose ObamaCare or any other plan containing an abortion mandate and "public
option." I will be monitoring your vote on this bill.

I doubt whether they will bother making any changes or adding things afterwards. They just want it to pass, so Obama can implement his socialistic agenda and we as Americans do not want anything to do with a socialistic government.

Men and women have died for our Freedoms and our Republic. We will fight for our country. Obama and his administration needs to be “Recalled “or “Impeached”. We are not happy with his style of government period.

Congress Exempts Amish From Health Care Bill

There is an interesting controversy brewing over the current version of the health care bill in which Amish families are exempted from the mandatory coverage. Other groups may also receive exemptions.
For some Americans who do not want to pay for health insurance (but face a fine under the law), the exemptions are likely to trigger challenges. Why should an Amish person be allowed exemption, but not someone with political or philosophical opposition to the insurance?

The Amish do use medical facilities and regular doctors, but they pay in cash. They believe that such care is the primary responsibility of their church.

The question is why religious conscientious objectors are given exemptions but not secular conscientious objectors. There are plenty of people who have profound objections to this plan that are not religious based. Is it far to allow only faith-based objectors to get exemptions so that some Christians can apply but not Cato members?
Congress can probably prevail in such distinctions (much like conscientious objectors to the draft), but it raises in my view a legitimate question of fairness.

The Healthcare Bill and Its Troubling "Religious Conscience" Exemption

When it comes to H.R. 3200 -- the over-1000-page-long bill to overhaul the American health care system -- there is no question that the devil is in the details. While Americans are trying to absorb the positions taken by each party regarding the big picture issues, such as how "universal" is "universal," and whether it is appropriate to limit care for the elderly, they are being told very little about the interest group deals that have been included in the bill.

The one that most troubles me, setting aside the financial and tax ramifications of the whole structure, is the exemption for "religious conscience" at Part VII, Subpart A, Sec. 59B(c)(5) (on pages 170-171 of the House Draft). Including such an exemption in the bill is both unconstitutional and dangerous for children in faith-healing homes.
A Special Exemption that Unconstitutionally Favors Only Established Religions Such as Christian Science.

The Subpart begins with a requirement that a tax be imposed on any individual who does not satisfy the requirements of the bill to obtain medical coverage. The exemption states, however, that this tax "shall not apply to any individual (and any child residing with such individual) for any period if such individual has in effect an exemption which certifies that such individual is a member of a recognized religious sect or division . . . and an adherent of established tenets or teachings of such sect or division. . . ."

First, it is not consistent with the First Amendment to grant exemptions solely to "a recognized religious sect" with "established tenets or teachings." If the government can tolerate a religious exemption, then it must do so evenhandedly among religious believers with the same beliefs. This is sheer favoritism for a certain class of religions, or even for one religion.

Although the language is somewhat opaque, there is little question that the Christian Science Church's lobbyists are responsible for this provision. As Malcolm Maclachlan reported in The Capitol Weekly, according to one of the Church's lobbyists, the Church is lobbying across the country to ensure that medical care exemptions based on religion are included in health care reform bills. They succeeded in introducing the similar exemptions in parallel California bills, which ultimately did not pass.

In a previous column, I pointed out how the Church had obtained funds under the Medicare program to cover the costs of faith healers and hospice-like centers where no medical care was provided. Yes, Medicare funds are now being used to cover faith-healing in circumstances where medical care is being rejected. The first version of that law clearly identified Christian Scientists as the recipients of that federal funding. When that aspect of the law became publicly known, however, Congress amended the law to make it more opaque, even though its wording was tailor-made for Christian Scientists. The few constitutional challenges to the Medicare system's payment of religious practice have been rejected in the lower appellate courts, despite the obvious impropriety of Congress' favoritism shown toward a single church and belief system and of funding non-medical care with funds dedicated to medical care.

The Provision Puts Children In Serious Peril – Including Peril of Death
A second important problem with the exemption – and one that is of grave importance – is that it puts children in danger. Health care reform is an opportunity for the United States to turn back the tide on the ability of religious parents to let their children perish or become disabled. The common law rule is that a parent is required to provide a child with adequate medical care, and that rule should be followed. It is beyond disappointing that in 2009, in a federal bill, this basic need of children has been traded away to lobbyists.
Yet the federal government is not alone in ignoring the common law rule. In a significant minority of states, there are faith-healing exemptions from the state's medical neglect laws. In these states, if a child does not receive medical treatment because a parent is a drug addict, then that parent is liable, usually both criminally and civilly. But in a home where the reason for the failure to treat is religious belief, states give the parents a pass on either civil or criminal liability, or on both. These exemptions were secured by the Christian Science Church, and they are the best argument against religious exemptions that exists, for the stakes could not be higher, nor the consequence of the exemption more baleful.

Some readers might discount the likelihood that a faith-healing parent will really watch his or her child die an agonizing death without obtaining help. But it does happen. Consider the recent Neumann jury verdict in Wisconsin, where the parents prayed over their 11-year-old daughter, Madeline, but offered no medical treatment for her diabetes. The result: Madeline died of a completely treatable condition. Were her parents outliers? Not at all: They were accompanied in prayer by fellow believers. No one called 911 until Madeline stopped breathing. Ultimately, a criminal jury found her father guilty, but a guilty verdict cannot bring back a young life.
While adults can legally choose to forego medical treatment and, in effect, choose death, parents may not legally choose death for their children (ergo, the medical neglect laws). The provision of the federal health care bill I have described above, however, implies that it is appropriate that a child receive no medical care at all, so long as the child lives with a parent who believes in faith over medical treatment. That rule goes directly against the common law duty owed by parents to their children, to provide adequate treatment.

Such an exemption also means that the state will have to pay for the treatment of these children. In essence, if the bill is passed with the exemption intact, faith-healing parents would be able to avoid the tax imposed on every other underinsured adult, and then, when their children need medical attention, will still be able to expect the state to pay for their care. The federal government, after all, is exempting them from obtaining the health insurance that presumably will cover everyone else. The defense that they should not have to pay general taxes that contradict their religious beliefs was rejected in 1982, in United States v. Lee, when the Supreme Court held that the Amish must pay Social Security taxes for their employees just as every other employer does, despite their religious objections.

Amid The Controversy Over the Healthcare Bill, We Cannot Forget Children's Lives Are Put in Peril By the Exemption.

The sad truth is that members of Congress either do not know this religious-exemption provision exists within the mammoth health care bill, or else they are willing to pander to a small religious group at the expense of children's well-being.

Either way, this grave and important issue is a very good reminder that no one should ever assume that a piece of legislation actually serves the ends at which it is purportedly aimed. It is irrational to believe that permitting faith-healing parents to forego otherwise mandatory medical insurance will contribute to better health in the United States.

Savage": Using Exemptions to Win

Please pass this along to all you know. I was listening to Michael Savage tonight. He stated that this health care bill will exempt Christian Scientist and Amish from being subject to health care due to religious freedom. Savage's take is to find some obstacle as it relates to different religious backgrounds that could possible exempt us from this Obamacare. I could not listen to the whole show as I was home and at 9 pm tonight i needed to make dinner, but he was going to take calls as to how we could exempt ourselves based on religious basis. So let's all put our thinking caps, think outside the box and protest and refuse based on religious beliefs. As a network, we can group together by religious types and file class action suits. I say it is worth a shot.

At this point ObamaCare is still short of votes. If they do manage to pass it, the Supreme Court reviews based on unconstitutionality will not be far behind. But that is a very long process and much of the pre-program billing of the taxpayers and hiring of more unnecessary gov’t workers for this program will have started and be costly and then difficult to reverse. In 2012, once Obama is out of office, much of the ObamaCare bill and the 2/3 of related legislation that has already been passed can be over-turned. But in the meantime, we need to do our homework and find and fight all the negative legislation.

But in the meantime, Michael Savage’s exemption program is worth a shot!~

OBAMA'S HEALTH PLAN -- TAXES, TAXES EVERYWHERE

The White House recently released President Obama's health care reform proposal. The plan incorporates a mixture of the many tax increases passed by the House and Senate, hiking taxes by almost $750 billion over ten years. This is on top of $1.3 trillion in other tax increases the President recently proposed in his 2011 budget. Not that there is ever a good time to raise taxes, but doing so as the economy is still emerging from a deep recession is particularly ill-advised and will likely prolong full recovery. Moreover, the President's proposal deviates from his stated goal to address the soaring spending and debt problem the nation faces by piling on massive new spending and taxes, says the Heritage Foundation.

How will the president's plan affect payroll taxes?

  • President Obama accepted the Senate's plan to break long-held policy by raising the Hospital Insurance (HI) portion of the payroll tax on high-income earners to pay for a new and unrelated health care entitlement.
  • He then doubled-down on this dangerous new precedent by separately applying the HI tax to investment income for the first time.
  • The tax code already taxes investment too much; higher taxes still on dividends, interest and business income increases the cost of capital which will further depress investment and thus job creation (ironic to propose this at the very time the President wants employers to create jobs).

How will seniors be affected by the Medicare payroll tax?

  • President Obama's proposed tax hike on investment will hammer seniors particularly hard because their investment income is a major supplement to their pension and Social Security checks.
  • Seniors also sell assets to raise income, so raising the tax on capital gains further reduces their resources.
  • Lastly, raising the taxes on capital income and capital gains will lower asset values.
  • Nearly 30 percent of all stocks are held in retirement savings plans; most of the seniors that rely on the income from these plans for their livelihood are not "fat cat" investors that have been the target of other populist tax hikes.
  • They are people that spent their working years saving money for their own retirement in mutual funds, 401(k)s, IRAs and other savings vehicles; this would just punish them for a lifetime of careful planning and saving.

What MSM Won’t Tell You: Doctors Are Challenging Government Health Care-and the AMA

Attempting to enact his big-government health care scheme, President Obama and his supporters frequently claimed that a “majority” of doctors supported his health-care plans. When the American Medical Association – which had opposed HillaryCare – signed onto Obama’s plan last year, the organization seemed to make the President’s case. Most people assumed that the AMA represented most of the doctors in the country. But in fact, the AMA represents less than 20 percent of all physicians in the United States. And yet as the organization’s leadership moved more to the left, it held a near monopoly on media attention on issues pertaining to public health. No longer.

As the AMA has become increasingly politicized in recent years – issuing a statement in support of climate change, for example, in 2008 – a new group of doctors has risen to challenge them. Like other anti-statist groups that have risen in opposition to the Obama-Reid-Pelosi agenda, Docs4PatientCare are challenging the AMA’s stranglehold on health care matters, just as other groups once challenged the right of the left-leaning American Bar Association to determine what judges are and are not qualified for the United States Supreme Court. How Docs4PatientCare managed to barge its way into the closed-door meetings of Washington offers a lesson to other groups seeking to have a voice in their federal government.

Founded by Dr. Hal Scherz, a prominent Atlanta physician, the group of doctors expressed concern that like so many other professional groups, the AMA’s leadership have been thoroughly “Washintonized” – caring more about the pleadings of other lobbyists on K Street, White House invitations and Capitol Hill committee appearances than the professions they are supposed to represent. As doctors have taken a battering over several decades from insurance companies, HMOS, and government agencies, Scherz says the AMA was a bystander.

“As the insurance companies become more and more impossible and government intrusion keeps growing, we’ve seen our delivery of care to our patients compromised and our incomes decrease,” he said.

But it was the AMA’s support for ObamaCare that really troubled Scherz and others in his field.

Many doctors run small businesses and by nature are entrepreneurial. Why then, he wondered, would the AMA favor ObamaCare’s regulatory and taxation burden? Why would they want a multitude of government panels interfering with the decisions doctors usually make with their patients about care and treatment? Recognizing that the AMA was compromised, Scherz decided to organize his own group in opposition to the Obama plan.

He recalled how effective talk radio had been the year before in stopping the seemingly unstoppable immigration amnesty bill, and wondered if there was a way for him to get his voice heard on the air. In fact, Scherz was driving home one night when he heard talk show host Hugh Hewitt ask on the air, “Where are the doctors?” opposing ObamaCare in the health care fight. Scherz wanted to give him an answer. So when Salem radio brought a “road show” on Obama’s first 100 days to Atlanta last May, he decided to attend. Listening to Hewitt and other Salem talk show stars like Bill Bennett and Dennis Praeger again ask, “Where are the doctors?” Scherz waited patiently in a long line of people to give them his answer. But just as he reached the head of the line, the master of ceremonies shut down the mikes for the evening.

Undeterred Scherz called a fellow physician, Congressman Tom Price, and asked the Congressman if he would come address a group of doctors if Scherz could assemble them. Price agreed and when Scherz got 40 doctors in the waiting room of his office to discuss ObamaCare, the meeting ended with the doctors deciding to form an organization to it. They christened themselves Docs 4 Patient Care that night and put together enough money to hire an attorney, set up a business structure, and establish a website.

Growing past this initial cadre of supporters proved difficult, however. Scherz spent as much time as he could emailing and phone calling more doctors to join the effort, but the response rate was slow. So coming home one night from the operating room, he called the Hewitt show and got in on the call-in queue. Waiting on hold for two hours, he finally got on the air in the show’s third hour. Delighted to have his missing-doctor question finally answered, Hewitt spoke with Scherz for a lengthy period.

“Then Hewitt blogged about us and put us the website and that made all the difference,” said Scherz.

Having heard the doctor on Hewitt’s program, Salem Radio’s vice president of content, Lee Habeeb, a legendary talk show producer, booked him on other Salem shows including a co-hosting gig with Mike Gallagher in Dallas, Atlanta, and New York. “Mike and his show were coming on strong. So it was just the right moment. He made our group a focal point of listener interest and it really helped,” says Scherz. This led to television interviews, involving Scherz and other members of the group to get their message out, such as Fred Shessel, one of Scherz’s partners and vice president, Scott Barbour, a prominent orthopedic and sports medicine surgeon, and Todd Rubin, a local anesthesiologist who started making something of the website (www.docs4patientcare.org). One talk show listener and activist, Felicia Horton, asked to be brought on as volunteer executive director.

With their newfound growth and publicity, Docs 4 Patient Care made getting heard in Washington their next objective. Wearing their scrubs and white jackets, the doctors drew attention as they walked the halls of congress and spoke at rallies on Capitol Hill. Often just showing up in the offices of members of the House and Senate, they would manage to get appointments with the members themselves or key staff members.

One particular meeting that stuck out in memories was with the staff of Senator Olympia Snowe, the Maine Republican senator who was being heavily courted by Democrats in the hope of getting some bipartisan window dressing for the Democratic bill. The meeting was a long one by Capitol Hill standards and the Snowe staff kept bringing up the arguments made by Democrats on behalf of ObamaCare. But in the face of the doctor’s facts and experience the arguments didn’t stand up long. Schertz believes Docs 4 Patient Care may have helped make a difference in Snowe’s ultimate, and fateful, decision not to sign on to ObamaCare.

Another memorable incident cited by members of the group occurred when one of their members, Joyce Lovett MD, an African American female pediatrician, got the doctors into a meeting of the Congressional Black Caucus. A debate opened up over the health care plan and soon the doctors were text-messaging their colleagues visiting other offices around the capitol for reinforcements. As the room began filling up, the doctors, doing well in the back and forth of debate, seemed to be changing some minds. At that point, a worried Black Caucus leader and diehard partisan, John Conyers, broke up the meeting, saying the doctors were more interested in embarrassing the first black president than in achieving real reform. Unused to this sort of political attack, the astonished doctors told other caucus members how they felt after taking time from their practices and patients to come all the way to Washington only to hear a member of Congress insinuate they were racists. One caucus member privately dismissed Conyers’ “old ways of thinking,” suggesting that the CBC might be ready for fresh, and more innovative, leadership.

In addition to return trips to Washington over the next 4 months, Docs4PatientCare also helped organize physician led-rallies around the country with hundreds of doctors participating in Atlanta, Los Angeles, Chicago, Indianapolis and Portland. The rallies proved crucial as the largely Atlanta-based group made new connections in taking on a national character. Jaime Ronderos MD, a prominent Texas anesthesiologist, who had already organized many of the doctors in his own state, folded his group in with D4PC. Also coming on board was Marc Neerhof, a perinatologist who is also on the faculty of the University of Chicago and a skillful op-ed writer. In addition, Reed Wilson, a well-known Los Angeles cardiologist with a business and political background became a board member. And finally, as the group showed its interest in working with all health care professionals, Joel Strom, a Los Angeles dentist and experienced coalition organizer agreed to head up an outreach program.

Only last month, the group had its inaugural board meeting in Atlanta where, in addition to making plans to increase their public and media presence, they inaugurated a fund raising program that would let them run a full-blown field operation in the elections this Fall. “We want to be out there in the states and let voters know which members of Congress put patient care second and voted for this power grab by Washington politicians,” said Scherz.

But, beyond this, Scherz and the other board members want Docs 4 patient Care to grow into what the AMA should have been. This means more than defeating ObamaCare. The group is non-partisan and anxious to work with all those who want to hear from Docs 4 Patient Care on the dangers of state-run medicine. With chapters recently up and running in several states, he sees growth ahead. That is likely discouraging news for the status quo world of Washington, D.C., but an inspiration for other Americans who see what their government is doing and want to offer an alternative.

Declaration of Health Care Independence

In order to retain the Blessings of Liberty as secured to us by our Founding Fathers and as expressed in our Constitution, We the People reject the imposition upon us of a new, Washington-controlled system of government-run health care. We demand Constitutional protection of the right to make our own health decisions and our own health care choices free of government denials, bureaucratic red tape and greater intergenerational debt.

A Washington takeover of American health care will:

  • Deny fundamental personal and economic liberties and indisputably violate the Principle of Limited Government as established by the Constitution;
  • Impose increased costs and taxes upon individuals, families and businesses, as well as taxpayers at the federal, state and local levels;
  • Irreparably cripple the American economy, at the cost of jobs, businesses, productivity, and quality of life;
  • Create an inescapable new tax by imposing individual and employer mandates;
  • Institutionalize a massive, ever-expanding federal bureaucracy that is impersonal and impractical;
  • Empower bureaucrats to interfere in the doctor-patient relationship, undermine the quality of care, limit choice, and increase the cost of health care.

We have appealed to the decency of the elected majority to respect the rights of all Americans, but their leaders have been deaf to the Voice of the People. We are appalled by their cavalier disregard of the Constitution and of the demands of the People. We are repulsed by their blatant political bribes and kickbacks.

We, the People and Representatives of the United States of America, therefore, do solemnly Publish and Declare that health care reform, as a matter of principle, must:

  • Protect as inviolate the vital doctor-patient relationship;
  • Reject any addition to the crushing national debt heaped upon all Americans;
  • Improve, rather than diminish, the quality of care that Americans enjoy;
  • Be negotiated publicly, transparently, with genuine accountability and oversight;
  • Treat private citizens at least as well as political officials;
  • Protect taxpayers from funding of abortion and abortion coverage;
  • Reject all new mandates on patients, employers, individuals, or states;
  • Prohibit expansion of taxpayer-funded health care to those unlawfully present in the United States;
  • Guarantee Equal Protection under the law and the Constitution;
  • Empower, rather than limit, an open and accessible marketplace of health care choice and opportunity.

Democrats will Implement "Trick" to Pass Health Care Reform

Washington, Feb 10 - Well, so much for a bipartisan strategy session on health care. Despite calls from the White House about bringing Republicans to the table to get their ideas into the debate, it looks like Democrats have already decided on a plan to pass their original legislation. Legislation Americans have soundly rejected from coast to coast.

Speaking at the National Health Policy Conference hosted by Academy Health and Health Affairs, House Speaker Nancy Pelosi's senior health care adviser Wendell Primus said that Democratic leaders in Congress will implement a legislative "trick" to pass their very unpopular version of health care reform.

Mark Tapscott with the Washington Examiner writes that Congress Daily, which originally published the story, is a subscription-only publication, but provided a link to LifeNews.com, which provided these details:

"In comments reported by Congress Daily, House Speaker Nancy Pelosi’s top health care aide Wendell Primus admitted top Democrats have already decided on the strategy to pass the Senate's pro-abortion, government-run health care bill.

"Primus explained that the Senate will use the controversial reconciliation strategy that will have the House approve the Senate bill and both the House and Senate okaying changes to the bill that the Senate will sign off on by preventing Republicans from filibustering.

“'The trick in all of this is that the president would have to sign the Senate bill first, then the reconciliation bill second, and the reconciliation bill would trump the Senate bill.

“'There's a certain skill, there's a trick, but I think we'll get it done,' Primus said."

Why propose a televised, bipartisan meeting on February 25th if the underlying plan has been to pass the Democrats' original health care proposal all along? Well, it's simple. President Obama wants to give the appearance of bipartisan cooperation without really caring at all. It's one PR stunt after another with this White House, and this latest action is a clear assault on the intelligence of the American people.

The Democratic leadership of this Congress and White House simply refuses to take no for an answer when it comes to a government takeover of your health care. They simply refuse to consider any idea being proposed by me or any of my Republican colleagues. Is this the leadership you want in Washington, or more importantly, the leadership you deserve?

As everyone suspected the entire ploy of having a bipartisan meeting on healthcare was just a ‘dirty trick’… a complete sham! The Dems have shut the GOP out of the entire process, bribed their own party and told both the GOP and the American Public that they will not start over and put together a simple bipartisan reform of healthcare, which is all we need. Why? Because this was never about healthcare or healthcare reform… it was always about a progressive government takeover of 1/6 of the economy and major information and decisions in all our lives.

Mainstream media pundits would have you believe Democrat Maratha Coakley will be the undisputed winner in the Massachusetts special Senate election occurring on January 19.

The so-called 'experts' may be in for a bit of a surprise.

Freedom-loving Americans from across our nation are rising-up to support Republican candidate Scott Brown.

Brown would provide the critical 41st vote in the Senate to break the Democrat's filibuster-proof majority and stop the unprecedented assault on our personal liberties that is now taking place in Congress.

Brown has pledged to vote against the government takeover of our health care system and is also opposed to cap-and-trade.
Brown raised over $1.3 million in one day this week. He has been gaining momentum in the polls and is now within the margin of error.

Those in power in this country should not underestimate the resilience of the American people to defend their liberty from a tyrannical government.

ObamaCare Now Coming Under Siege by Liberals, Unions, Doctors, Former Political Proponents, Constitutionalists and the Majority of the American People

Senator Christ Dodd said today, “ObamaCare Legislation is hanging by a thread”, so it can be stopped!

Despite all their promises for fairness and transparency, when it comes to ObamaCare, the President, Nancy Pelosi and Harry Reid continue to look the American people in the eye and lie right to your face.

As California Governor Arnold Schwarzenegger -- once a proponent of ObamaCare and certainly no staunch conservative -- said recently, the so-called health care "reform" bill has become nothing more than "a trough of bribes, deals and loopholes."

That was putting it nicely. The truth is, the process that Obama and Democrat leaders are employing in their efforts to put the government in charge of one-sixth of the nation's economy -- your family's health care decisions -- is perhaps the most corrupt and non-transparent process in the history of our great nation.

In fact, Obama, Pelosi and Reid are so intent on keeping ObamaCare behind closed doors - out of sight from the American people -- that they are going to bypass a conference committee process altogether to try to avoid more public opposition as they seek to combine the House and Senate versions of ObamaCare.

The New York Post summed up what is going on this way:
"Congressional Democrats plan to take final negotiations on the massive health-care overhaul behind closed doors - far from the prying eyes of the public and most lawmakers."

Forget transparency... forget a recent request by C-SPAN to televise further ObamaCare proceedings (something the President himself promised on numerous occasions)... forget about the American people knowing what's in this next ObamaCare offering before it comes up for a final vote in the House and the Senate.

The Heritage Foundation was more blunt in describing the situation:

"These secret meetings will not be a 'traditional conference committee,' nor will they be a conference committee in any sense of the term. The only individuals allowed in the room will be those invited by both the House and Senate Leadership. Why the secrecy? Pelosi and Reid want to be sure they can secure the votes they need to pass the bill again."

Why the secrecy?

That's easy... operating behind thick and guarded doors... utilizing intimidation, political payoffs and ideological fanaticism... that's the only way that Obama, Pelosi and Reid will be able to jam ObamaCare down the throats of the American people.

But we're not going to let them get away with it.

They can meet in secret all they want, but with your help, we will derail their ObamaCare train once and for all.

They are busy combining both the undesirable House and Senate versions of the ObamaCare Bills. But in the end the goal is to pass anything (instead of nothing and starting over on real reform). Why?… Because once something is on the books and passed, unless we over turn on the ground of un-Constitutionality or by reversal due to the will of the majority of the people by the elections of a whole new crop of ‘American politicians’… not loyal career Dems or Republicans, they will re-write the entire thing and put in everything the Progressives wanted in the first place… including:

What Is Happening with ObamaCare???

Bipartisan? Transparent? Dems Merging Health Bills in Secret Without GOP

House and Senate Democrats intend to bypass traditional procedures when they negotiate a final compromise on health care legislation, officials said Monday, a move that will exclude Republican lawmakers and reduce their ability to delay or force politically troubling votes in both houses.

The unofficial timetable calls for final passage of the measure to remake the nation's health care system by the time President Barack Obama delivers his State of the Union address, probably in early February.

Democratic aides said the final compromise talks would essentially be a three-way negotiation involving top Democrats in the House and Senate and the White House, a structure that gives unusual latitude to Senate Majority Leader Harry Reid of Nevada and Speaker Nancy Pelosi of California.

These officials said there are no plans to appoint a formal House-Senate conference committee, the method Congress most often uses to reconcile differing bills. Under that customary format, a committee chairman is appointed to preside, and other senior lawmakers from both parties and houses participate in typically perfunctory public meetings while the meaningful negotiations occur behind closed doors.

In this case, the plan is to skip the formal meetings, reach an agreement, then have the two houses vote as quickly as possible. A 60-vote Senate majority would be required in advance of final passage.

"I look forward to working with members of the House, the Senate and President Obama to reconcile our bills and send the final legislation to the president's desk as soon as possible," Pelosi said late last year as the Senate approved its version of the legislation.

"We hope to get a bill done as soon as possible," said Jim Manley, a spokesman for Reid.

The issue is so partisan that only one Republican, Rep. Anh "Joseph" Cao of Louisiana, has cast a vote in favor of the legislation.

GOP leaders have vowed to try and block a final bill from reaching Obama's desk. "This fight isn't over. My colleagues and I will work to stop this bill from becoming law," Sen. Mitch McConnell, R-Ky., the Republican leader, said shortly before the Senate cleared its version of the bill last month.

Both houses have already passed legislation to remake the health care system, extending coverage to millions who lack it while cracking down on industry practices such as denying insurance on the basis of pre-existing medical conditions.

There are literally hundreds of differences between the two bills, a House measure that ran to 1,990 pages and a Senate version of 2,074, not counting 383 pages of last-minute changes. The biggest differences involve a dispute over a government-run insurance option — the House wants one, but the Senate bill omitted it — as well as the size and extent of federal subsidies to help lower-income families afford coverage.

Bypassing a formal conference committee enables Democrats to omit time-consuming procedural steps in the Senate and prevents Republicans from trying to delay the final negotiations.

Under Senate rules, three separate votes are required before negotiators for the two houses may hold a formal meeting. While the three normally are agreed to within seconds, each may be filibustered, and Democrats would then have to produce 60 votes to cut off debate.

Additionally, Republicans would have the right to demand votes on nonbinding proposals once negotiators for the two houses were appointed. That could, in turn, require Democrats to vote on political controversies such as wiping out the legislation's proposed cuts in Medicare, the type of issue that could easily be turned into attack ads in next fall's campaign.

Congress plans no formal sessions until Jan. 19, but Pelosi intends to meet this week with key committee chairmen and other leaders, and a separate meeting is also planned for members of the rank and file.

Skulking Senate Majority Leader Harry Reid rammed the government health care takeover package through under the cover of darkness before Thanksgiving and Christmas. House Democratic leaders forbade debate on all but one amendment not authored by themselves. The Senate Finance Committee killed a GOP amendment that would have required Demcare to be available online for 72 hours before the committee voted. Reid and his Volterra-style henchmen cut last-minute cash-for-cloture deals behind closed doors.

And now House and Senate Democratic leaders are reportedly preparing to cut dissenters out of the reconciliation process by bypassing the formal conference committee. (Read Full Article)

Help Mike Huckabee Stop Ben Nelson and Stop ObamaCare

I am sorry to send you this email so late this evening but things are moving quickly and I need your help to stop the Senate Health Care bill.

First, in case you haven't heard, Nebraska Democrat, Senator Ben Nelson has caved in his opposition to the Senate Health Care bill. Nelson's surrender paves the way for Senate passage of the bill sometime this week. Tomorrow morning I am headed to Omaha, Nebraska to headline a rally later in the day demanding Senator Nelson switch his vote back to NO.

The rally will be held at the Omaha Music Hall, 17th and Capitol. Doors open at 2 PM. Rally starts at 3 PM.

Other participants will include Congressman Terry, Auditor Foley, Senators McCoy, Fulton, Krist, Price and Lautenbaugh.

Momentum Building for Code Red Rally

It's time we all stop pretending that what is happening with this Obamacare debate is about "helping the uninsured" or "fixing the healthcare system" or "giving the people what they want." It's about none of those things. Its about amassing as much power in a central government as humanly possible. It's about wealth redistribution. It's social engineering at its absolute worst.

The American people must take this political system back from those who have hijacked it in one of the most abhorrent power grabs that we the voters have ever seen. It's the holiday season so the Democrats are counting on you to be otherwise occupied and too busy to stand against their massive expansion of government. Let them underestimate us again just as they did last summer. Let these unrepresentative politicians proceed with their legislative chicanery and self-righteous grandstanding. We can expose them and confront them in the classic American spirit--a public gathering on their doorstep. On December 15th at 1:30pm, we will remind Pelosi, Reid, Schumer et al. that they work for us and not the other way around. We will demand that they follow the will of the people, not dismiss and degrade it by putting future generations into a deficit dungeon. We will put every politician who supports this travesty on notice: enjoy your remaining time in the U.S. Capitol because we're coming for your seat.

The American people will not forget those who turned their backs on us and voted for a bill that they hadn't read and which will do nothing but ensure that one of the best healthcare systems in the world is compromised.
