Yes, States Have the Constitutional Right to Nullify Obamacare

Capitalism Institute: Every effort to navigate the proper channels to repeal Obamacare have been thus far blocked by Democrats (and even some big government Republicans), despite practically everyone hating the oppressive legislation.

Naturally, states are considering other means by which to stop this economic disaster before it gets even worse.

South Carolina and Georgia have already jumped on board with a state-level model developed by the Tenth Amendment Center to effectively nullify Obamacare in their states. The template is even being applied outlaw the NSA from operating within Arizona.

Using this model to combat Obamacare, South Carolina and Georgia are prepared to “nullify” Obamacare by withholding the state’s personnel and resources the law depends on. It would be illegal for the state’s resources to contribute towards the law’s implementation. This is essentially how it works:

Nullification begins with a decision made in your state legislature to resist a federal law deemed to be unconstitutional. It usually involves a bill, passed by both houses and signed by your governor. In some cases, it might be approved by the voters of your state directly, in a referendum. It may change your state’s statutory law or it might even amend your state constitution. It is a refusal on the part of your state government to cooperate with, or enforce any federal law it deems to be unconstitutional.

Most of the “naysayers” will tell you that these nullification efforts are “illegal” because of the supremacy clause:

This Constitution, and the Laws of the United States which shall be made in pursuance thereof; and all treaties made, or which shall be made, under the authority of the United States, shall be the supreme law of the land; and the judges in every state shall be bound thereby, anything in the constitution or laws of any state to the contrary notwithstanding.

However, those at the Tenth Amendment Center disagree:

The major argument used by those that oppose Nullification is the Constitution’s supremacy clause. But in fact, the arguments for the supremacy clause ARE the arguments for nullification.

They continue:

The major architects of the Constitution, and those that led the fight for its adoption, laid down what the supremacy clause meant during the ratifying conventions. By doing so, they defended state sovereignty, and set the stage for the negation of unconstitutional actions.

Judge Andrew Napolitano, a senior judicial and political analyst, recently confirmed that these efforts are, in fact, legal — and effective: 

[I]t will gut Obamacare because the federal government does not have the resources or the wherewithal […] to go into each of the individual states.

It was Alexander Hamilton who said, “but the laws of Congress are restricted to a certain sphere, and when they depart from this sphere, they are no longer supreme or binding.”

The TAC cites several other historic quotes from the New York, Pennsylvania, North Carolina ratifying conventions and the Federalist Papers demonstrating that the supremacy clause is — and was intended to be — a platform upon which we could hold an overbearing federal government “in check”:

[The Founders] established the means for the states to defend themselves and their citizens from a general government that exceeding its authority and that power is NULLIFICATION.

The nullification of overbearing, unconstitutional federal laws is essential to preserving our liberty. The Founders were certainly not ignorant of the consequences of letting a federal government run amok; thus, they crafted in our Constitution a fail-safe.

When Congress seems more interested in propelling us head-first into tyranny rather than protecting us from it, we have to take matters into our own hands.

The nullification efforts in South Carolina, Georgia, and Arizona are just the beginning.

Obamacare Produces Pain and Chaos by Design

RUSH: Here's Denise in Trenton, Michigan, as we head back to the phones.  Welcome to the Rush Limbaugh program.  Hi.

CALLER:  Hey, Rush.  My question is pretty simple, but I also want to ask, you talked to somebody on Tuesday, it was a guy, I know you'll remember him, he worked two part-time jobs and he had a one-year-old and he talked about how he can't get benefits. And you had told him that you had hope to give him, and you talked about a time where there were people in like their fifties and stuff, and they had to go back and they basically lost their jobs, and they did what they really wanted to do.

RUSH:  Right.

CALLER:  And I just hope he's listening today, 'cause I was on the phone with you on hold saying, "Please take my call so I can tell him."  It was true then, and it's true now.  That's what we're doing.  That's what our family is doing, 'cause of course thanks to Obama and his infinite wisdom, I went through the same thing and lost two of my jobs, and I'm back in school and I'm gonna do what I want to do.  And I just want your guy -- I hope he hears this because anybody can do it, and you are who you are not because of who they let you be, but because of you.  He has to do what you said and follow his passion, because --

RUSH:  That's a good point.  It really is.  Just to recap, I remember the guy.  He was working two jobs because he had been downsized because of Obamacare.  He'd been reduced in both jobs to part-time status, so he'd lost his benefits. Even though with two jobs he had the equivalent of a full-time job, he didn't have any benefits, and health care, particularly, was gone.  He didn't know what he was gonna do.  He was from Asheville, North Carolina, and I told him, "You know, even true today, most of the limitations that people face are self-imposed."  And I asked him, "Are you willing to move to pursue your dream?"  He said, "Yeah."

Okay, well, that's the big one.  Once you're willing to move you're really over a hump, but if you're not gonna leave Asheville, then you have to realize your potential is dictated by what Asheville has, what there is to do there job-wise, career-wise, or what have you.  But the point that I made that you recounted here that's really worth it, all these guys in the nineties laid off in their middle ages, fifties, white-collar guys, could not get rehired at the salaries that they were earning.  So what they did late in life was start businesses with the things they really loved and always wanted to do but had never done.

BREAK TRANSCRIPT

RUSH: Now, one thing from our last caller.  The caller she was talking about was Andy from Asheville, North Carolina.  This is worth repeating.  He was downsized in two jobs, so he had a full-time workweek with two jobs. So he was part time in two jobs, did not have any benefits as a result. He was been downsized in both jobs because of health care. The companies where he worked converted him to part-time status so that they would not have to provide him health care coverage, and that's common and it's happening with greater frequency and will increase its occurrences as more companies realize what they have to do to be complicit with Obamacare.

If they want to stay in business they're gonna have to let people go.  If they want to stay in business they're gonna have to convert people to part time.  They're gonna have to reduce their hours and they're gonna have to reduce their benefits.  No, that's not the spirit of Obamacare at all.  In fact, Obamacare officials are shocked and stunned that this is happening.  Actual people in the government can't believe this.  They thought that the health care experience in America would be, as they said, enriched because of Obamacare.  They're just a bunch of political lug heads who accept the flawed premise and promises of liberalism.  And because they're good people and because they've put the program together, it's magically gonna work.  Never does.

(interruption)

I was just asked if they just discount all the articles that point out how it's not being implemented as it was designed.  'Cause it isn't a surprise.  It isn't a surprise that business is doing this.  Everybody that paid any attention, had any smarts at all, knew exactly what businesses were gonna have to do in order to stay in business once this thing started to be implemented.  And so the question is, don't these guys in government -- how do they not know this?  Don't they read these stories?  I don't know.  Maybe they don't read them.  But more likely they do and just discount what they're reading.  They do.  They think it's all right-wing propaganda, no matter where it runs.

All of these forecasts, Obamacare not working, all of these stories of companies downsizing, they just think that's evil business profit-taking.  These people in the government who really thought that Obamacare and even do still think Obamacare is gonna lower costs and expand coverage, and when it doesn't happen, what do they think?  They think that evil CEOs are being greedy and they're just laying people off using the excuse of Obamacare, but all they're doing is hoarding money and building bigger houses for themselves and buying nicer cars while they're firing or laying people off.  That's what they think.  They think that all of this is right wing conspiratorial activity designed to harm Obama.  When they read these stories -- look, try this one.  This is from the Washington Examiner but this is just a repeat of an LA Times story.

"UnitedHealth, the nation’s largest private insurer, will not participate in California’s Obamacare health exchange, the Los Angeles Times reported Thursday. Health insurance giants Aetna and Cigna will also opt out of Covered California, the state agency charged with implementing Obamacare. All three insurers will still provide health insurance through large employers in the state," but they're not going to participate in the Obamacare exchanges.

"Kaiser Permanente, the largest health insurer in California, will work with Covered California, as will Anthem Blue Cross and Blue Shield of California. Together, these two companies already control 87 percent of the state’s individual health insurance market. That number will only go up as UnitedHealth, Aetna and Cigna drop out of the individual market entirely. Market consolidation and decreased consumer choice is exactly what some supporters of Obamcare hoped would happen all along."

This is my point.  As UnitedHealth pulls out, as Cigna pulls out, as Aetna pull out, what does that mean?  It means consumers have fewer choices.  That's the design.  The people that really thought about this at the government, the Obamacare people, the people that really put this together with their ultimate aim in mind, intended all of this.  They intended for it to be too big, too unworkable, and too expensive.  They intended for all of these companies, be they businesses or insurance companies, to pull out, to not insure people, they intended this.  That's why the fines for not having insurance in the first couple years are very cheap.

The fines for not having a policy cost much less than having a policy. They want people to not have the policy. They want people to pay the fine. They want to upset the market and create a mess -- and, then to clean up the mess, they want everybody just to finally say, "You know what? You know what would fix this? Single payer! Just have the government do it. To hell with Aetna, to hell with Cigna, to hell with United Health, to hell with private insurance. Just have the government do it."

That will be the solution.

It's not me saying so. Obama said this in 2007 in a speech to the Service Employees International Union. We've played the audio of that speech on this program I don't know how many times where he said to 'em, "I know you want single payer. I want single payer, too. But we can't get there overnight. It's gonna take 10, maybe 15 years. People are going to have  to be slowly conditioned to it and ultimately it's going to have to be the only option available. That's how we'll get it done."

Because people don't want that. Obama knows it. He knew it in 2007; he knows it today. He's governing against the will of the people. People do not want single-payer, government-run health care. They don't want Obamacare. Still, the numbers are 60%. But the people in the regime who believe in this, who think that all of this is the perfect solution to our health care problems, they'll read a story here. They'll read this LA Times story: United Health, Aetna, Cigna pulling out.

They will tell themselves that the people running these companies are just a bunch of greedy Republicans trying to screw Obama. Everything is political to them, and there is no legitimacy in capitalism, and therefore no capitalistic entity is legitimate. They're all cheats, liars. They're all frauds. "Capitalism is unfair. Capitalism is what the 1% use to stay the 1%, and they got to be the 1% by taking everything from everybody else!"

So if you start out from the standpoint that there's nothing legitimate about free markets, if there's nothing legitimate in capitalism, and you read a story like this (and you know how mean and nasty Republicans are), well, you're just gonna assume that the people running these companies are Republicans and hate Obama and they're trying to screw up his grand plan. Then, at some point, they realize what's going on. That's when you get the stories, "Yeah, we really thought it was gonna lower costs!

"We really thought it was going to enrich health care experience for people." The cookie-cutter liberal, the standard operating procedure liberal is really a giant ignoramus. I mean that seriously. They're really ignorant. They are so politically oriented, and they are so arrogant and condescending -- and they have such solid boundaries built around themselves -- that the truth of anything doesn't permeate. The only truth is what they believe and what they think, including all of their biases and all of their prejudices.

Those things are truth. Anything outside their believability system, outside the cocoon, is a conspiracy designed to undercut them or destroy Obama -- or it's just a bunch of right-wing kooks. That's the challenge. That's why there's no working with these people. There isn't any point in bipartisanship. There is no area of commonality. We don't have anything in common with these people. That's why, in my mind, politically they're to be defeated. The problem is we usually do. They are a minority.

We're just being governed by a minority. It's made to look like the majority because of their never-ending media support. I mentioned yesterday that even the union for the people who are going to enforce Obamacare, the IRS, is begging out of it. It's the National Treasury Employees Union, which runs the IRS. That's the union that all IRS workers are members of. They want to be exempted from it. Their job is to make sure you sign up. Their job is to make sure you are assessed a fine if you don't get insurance under the terms of Obamacare.

They want an exemption. That is liberalism for you. They set up two sets of rules: One set for everybody else, and another set for them. They never have to live by the rules that they set up for everybody else. 'Cause they're special! They're better. They're more important. The rules set up for everybody else are to handle "the masses," the bourgeois -- you know, the slow-witted, dim-witted, mindless people that are incapable of taking care of themselves.

So they set up rules for them, and then another set for themselves, and that's how it works. United Health, Aetna, and Cigna opt out of the California Obamacare exchange -- and they're going to continue to offer insurance policies to employers. Eventually what is designed to happen, and therefore will, is that the policies are going to be so much more expensive than what will be found at the exchanges, private insurance will end.

Don't Leave ObamaCare Alone - Republicans Need to Get Back to Repealing ObamaCare

Even after three years, the nation remains divided on Obamacare. The people who already had health insurance—as well as those who have lost their insurance since Obamacare became law—still seem to hate it. The people who didn't have insurance before, and don't yet have insurance now, seem to love it because they think it means free health care. Obviously they have never heard the old saw about the free lunch.

Health care and health insurance are two distinctly different things. Having health insurance helps insulate a family against the costs of a catastrophic illness, for example, but really does nothing to guarantee any kind of quality care. All the insurance in the world will be of no use to the person who has a fatal illness science has not yet figured out how to cure.

Too much of the discussion about health care is really about the cost of health care and not enough is about quality. Some of the big thinkers out there, like former Bush White House senior aide Jim Pinkerton, have been sounding the call for even more spending on health care and on research. He makes the very salient argument that the economic costs of not doing so could be crippling 50 or even 25 years out as the nation grapples with the declining health of an aging population that is, overall, living longer—which is exactly why Obamacare is the wrong prescription for moving forward.

As many health care experts have explained, the route that the president's signature legislative achievement puts the country on is one that makes stops at places like rationing, denial of care, quality of life determination boards and other backwaters where, it will become clear uncomfortably soon, people go to die. To put it simply, America needs to spend more money on health care, not less, an idea that really is at the heart of most of the conservative proposals to transform the nation's health care industry.

Nevertheless it is the GOP that gets the rap for being parsimonious and uncaring. It's the GOP that gets ads run against it showing prominent elected officials pushing grandma out of her wheelchair and over a cliff. It's the GOP that needs to get to work talking up real reforms that will replace the sham that is Obamacare; reforms that will improve the quality of the health care available and, over time, make more health care available to more people.

The first step down this long road is for the GOP-controlled House of Representatives to once again take up the mantle of "repeal and replace" and take Obamacare apart brick by brick, beginning with the individual purchasing mandate.

Whether it's a tax, like Chief Justice John Roberts says it is, or a penalty for not buying insurance, like the Obama Administration said when trying to get its bill through Congress, the individual purchasing mandate is the singularly most unpopular part of Obamacare. Previous efforts to repeal just that section were set aside while the constitutional challenge made its way to the U.S. Supreme Court on the grounds that no one wanted to change the law before the court had a chance to rule.

Well, the court ruled and, contrary to what just about everyone expected, the law stands. So Congress is free to attack the mandate, head on. The House should vote on repeal of the mandate just as soon as it can. It will pass. And it should vote on it again in the fall, when key parts of Obamacare are supposed to be coming on line.

In fact, House Speaker John Boehner should make it a monthly event, forcing a wedge between the supporters of Obama and his health care plan, who like the mandate, and the folks back home, who hate it. Make congressional Democrats go on record again and again until Senate Democratic Leader Harry Reid is willing to let the issue come up for a vote on the other side of the Capitol. Get everyone one record as to just where they stand on the issue of the individual mandate. Then check and recheck to see if anyone has changed their position. The political media may laugh, may think it's all just political theater, but it will underscore to voters the essential point that one party really does want to repeal Obamacare, just like they do, and the other doesn't.

There may be some on the other side of the issue who would welcome this, thinking it would make the GOP look ridiculous. And they would be wrong. Right now, with the Obamacare bureaucracy still in its infancy, no one has really had to deal with how dysfunctional it will be. Over time, as the health care exchanges fail to come on line, as the system malfunctions, as it proves to be worse than anyone but its most severe critics believed it could be, public attitudes in favor of repeal will grow stronger. And when that happens it will be, for most politicians, good to have been on record as a "long time critic" of Obamacare rather than a "Johnny-come-lately" advocate for reform.

The voters may not have long memories, but the people who run the public interest groups and super PACs do. And they're still willing to spend millions on ads and grassroots development to get rid of this awful, awful law—before we all really do have to send grandma out on the ice floe and toast her memory.

Illegal aliens get top notch health care, say immigration officials, but if you even mention it saying the word illegal could cause you to be charged with a hate crime… if the left has their way.

If a Mexican national wishes access to a full array of healthcare services, all they need do is cross the border into the United States and make certain they’re captured by agents from the U.S. Immigration and Customs Enforcement’s (ICE).

Providing quality healthcare to illegal aliens who are in ICE’s custody is an important and challenging task — one that Assistant Director for ICE Health Service Corps (IHSC) Dr. Jon Krohmer claims is taken very seriously, officials at the Department of Homeland Security said in a statement on Tuesday.

The ICE Office of Enforcement and Removal Operations (ERO) ensures the safe and humane conditions of confinement for aliens detained in ICE custody. This includes the provision of reliable, consistent and appropriate health services.

IHSC, which falls under ERO, is comprised of more than 900 Public Health Service-commissioned officers, federal civil servants and contract support staff. Their mission is straightforward: to serve as the medical authority for ICE on a wide range of medical issues, including the agency’s comprehensive detainee health care program, according to DHS officials.

However, at this point only estimated costs for this healthcare program are available and vary between $50 million and $150 million per year.

ICE Health Service Corps (IHSC) provides direct care to approximately 15,000 detainees housed at 21 IHSC-designated facilities throughout the nation. In addition, IHSC oversees the medical care provided to an additional 17,000 detainees at non-IHSC staffed detention facilities across the country. Whenever necessary, it authorizes and pays for off-site specialty and emergency care, consultations and case management, according to ICE.

“A detainee’s health care begins the moment they walk through the facility’s doors,” said Dr. Krohmer. “Within the first 12 hours of their admission, all detainees undergo a preliminary health screening, which includes an evaluation of the individual’s medical, dental and mental health status and within the next 14 days, a more detailed physical examination takes place.”

Because so many of these detainees are either new arrivals in the country or haven’t had access to health care in the past, Dr. Krohmer said it is not unusual for serious health problems to be diagnosed at these screenings.

“We’re finding out about health issues that even they didn’t even know about and in most cases are able to begin treatment,” he said.

However, some observers find Dr. Krohmer’s findings disturbing.

“I’m more concerned with illegal aliens who may enter the U.S. carrying a serious — even deadly — disease that may be highly contagious. Why don’t IHSC physicians and medical staff concentrate on screening immigrants coming from nations that may have serious health problems?” asks former NYPD police officer and emergency medical technician Nick D’Amato.

The continuity of care not only lasts during the individual’s period of detention, but also throughout their removal to their country of origin. Before any detainee boards a plane to be removed from the United States, they must first undergo an evaluation to make sure they are fit to fly, according to officials.

In order to continually upgrade the quality of medical services they deliver, IHSC not only actively complies with the Performance Based National Detention Standards, but is also instrumental in the standard’s continuous upgrades and improvements. “My staff and I are aware that detainee health care is an ever-evolving issue and that just like in the general population, health care priorities are constantly changing,” said Dr. Krohmer. “We are working to develop a more systematic approach to our health care system within the detention facilities.”

For instance, ICE recently streamlined the treatment authorization request. This application — used to formally request a specialized medical procedure that falls outside the scope of what IHSC can provide — is now typically reviewed and approved within 24 hours.

Krohmer added that plans are underway to forge a more uniform health care system among the IHSC facilities, enabling them to work together more cohesively.

“Sounds to me like illegal aliens are getting better health care than American citizens who are poor or homeless and can only receive emergency medical treatment at hospitals. It’s a disgrace,” said Mike Baker, a political strategist and attorney.

"There are 23 of these conservative-leaning Democratic House members who voted for Pelosi's Obamacare back in November, which passed by just five votes, with 39 Democrats defecting to vote against the bill.

All 23 of these Congressman who did vote for the Pelosi bill are extremely vulnerable.

Opponents of Obamacare need to climb all over these 23 Congressmen with TV ads and advocacy campaigns in their districts to get them to change their vote this time, to vote "no" to the Senate bill when it comes before the House.

Voters need to say, "You voted for Obamacare the first time. But your district opposes it by 2 to 1. Now it is coming up for a vote again. Listen to your constituents and vote no. We don’t want Medicare cuts or premium increases or rationing of medical care. Don’t monkey with our health care. Vote no this time.”

Since the House healthcare bill passed by five votes, much has happened and the political landscape has changed dramatically.

The Massachusetts election of a Republican to Ted Kennedy's Senate seat has sent shock waves through Washington. Every one of these 23 Democrats knows they will face an angry backlash in their districts if they vote for the Senate bill and go along with Pelosi-Reid plan to ram through Obamacare.

I believe now is the time to act for opponents to act. The truth is that Obamacare is hanging by a thread.

Opponents, if they move now, can drive a stake through its heart.

Once these Congressmen hear from their aroused constituents, they won’t be able to back Obamacare.

As I mentioned, the Pelosi health bill passed the House by only 220-215. Nancy Pelosi knows she has no margin for error.

If only a handful of these 23 Congressman change their vote under public pressure, the Pelosi-Reid plan is stopped and Obamacare is dead."

What are Democratic leaders saying? “If you pass the Stupak amendment, more children will be born, and therefore it will cost us millions more. That’s one of the arguments I’ve been hearing,” Stupak says. “Money is their hang-up. Is this how we now value life in America? If money is the issue — come on, we can find room in the budget. This is life we’re talking about.”

If Obamacare passes, Stupak says, it could signal the end of any meaningful role for pro-life Democrats within their own party. “It would be very, very hard for someone who is a right-to-life Democrat to run for office,” he says. “I won’t leave the party. I’m more comfortable here and still believe in a role within it for the right-to-life cause, but this bill will make being a pro-life Democrat much more difficult. They don’t even want to debate this issue. We’ll probably have to wait until the Republicans take back the majority to fix this.”

“Throughout this debate, even when the House leaders have acknowledged us, it’s always been in a backhanded way,” he laments. “I’m telling the others to hold firm, and we’ll meet next week, but I’m disappointed in my colleagues who said they’d be with us and now they’re not. A worried woman went to her gynecologist and said: 'Doctor, I have a serious problem and desperately need your help! My baby is not even 1-yr-old and I'm pregnant again. I don't want kids so close together.'

So the doctor said: 'Ok, and what do you want me to do?' She said: 'I want you to end my pregnancy, and I'm counting on your help with this.' The doctor thought for a little, and after some silence he said to the lady: 'I think I have a better solution for your problem. It's less dangerous for you too.' She smiled, thinking that the doctor was going to accept her request. Then he continued: 'You see, in order for you not to have to take care of 2 babies at the same time, let's kill the one in your arms. This way, you could rest some before the other one is born. If we're going to kill one of them, it doesn't matter which one it is. There would be no risk for your body if you chose the one in your arms.

The lady was horrified and said: 'No doctor! How terrible! It's a crime to kill a child!

'I agree', the doctor replied. 'But you seemed to be ok with it, so I thought maybe that was the best solution. The doctor smiled, realizing that he had made his point. He convinced the mom that there is no difference in killing a child that's already been born and one that's still in the womb. The crime is the same!

Sometimes it just takes a different vantage point to put things in the right perspective. That is the same with abortion clinics, abortion legislation and abortion funding… especially taxpayer funding for abortions. One of the reasons the U.S. is in the situation it is, is because somewhere along the way… we lost our way. You can’t be a part-time Christian or a part-time Patriot. Something is either right, or it is wrong. Murder is either right or wrong. We have to choose to live by the Bible and the Constitution, or live in chaos. The present healthcare bill questions our commitment to both.

Together we can help save precious lives! That is unless we are no longer given the choice~

Obama Knows Best? Vows to Force-feed Americans Bill They Hate

After more than a year of $862 billion dollar deficit stimulus bills, national-debt-doubling federal budgets, and government takeovers of the auto industry, it is difficult to remember that President Barack Obama actually ran as a moderate in many ways. On his way to a 53% – 46% win over Sen. John McCain (R-AZ), then-Sen. Obama promised to “cut taxes for 95% of workers and their families,” expand the Army by 65,000 and the Marines by 27,000, and enact “a net spending cut” for the federal government. Obama promised lower taxes, a strong defense and shrinking the size of government. No wonder independents in nine states that went for President George Bush in 2000 and 2004 switched their vote to Obama in 2008 (CO, FL, IN, IA, NV, NM, NC, OH and VA). But now those independents are beginning to reassess. Public Policy Polling (a liberal polling firm) notes that Obama now has a negative approval rating in every state that he flipped from the Bush column to his in 2008.

And now President Obama has lost one of his biggest and earliest supporters on his signature issue: health care. Yesterday, when pressed on CNBC if he would be in favor of scrapping the Senate health care bill, Warren Buffett responded: “I would be.” Specifically, Buffett believes that the Senate bill will not contain health care costs: “We have a health system that, in terms of cost, is really out of control, and if you take this line and you project what has been happening into the future, we will get less and less competitive. So, we need something else. Unfortunately, we came up with a bill that really doesn’t attack the cost situation that much and we have to have a fundamental change.” Buffett is correct on both fronts: 1) the President’s own Centers for Medicare and Medicaid Services (CMS) has reported that the Senate health care bill would raise national health expenditures $234 billion by 2019; and 2) our current system is completely unable to control exploding health care costs.

So why is our current system completely unable to control costs? For the same reason most Americans over-eat at buffets: when you don’t have to pay for each plate of food, you usually eat more. In recent decades, the percentage of health care spending paid “out of pocket” by patients has fallen substantially, from 52% in 1965 to only 15% in 2005. Instead of patients paying for the care they receive, our system is built around a third-party payment system where the government and insurance companies are the ones who actually pay for individual medical expenses. When prices are determined through administrative procedures rather than market processes, both patients and producers are anesthetized from normal market incentives to reduce prices and spending. That is why our health care costs are rising so rapidly.

And every major pillar of Obamacare makes the third-party-payer problem worse: mandates that limit out-of-pocket spending by patients, mandates that extend the minimum benefits insurance must cover, a massive expansion of Medicaid, and lower limits on the tax deductibility of out-of-pocket spending. And the one measure that the left once pointed to as its key cost-reducing measure – the taxing of expensive health insurance plans –has been gutted and pushed back until 2018, when any honest observer knows it will never be implemented. Commenting on the state of health care reform, Buffet told CNBC yesterday:

If it was a choice today between plan A, which is what we’ve got, or plan B, what is in front of — the Senate bill, I would vote for the Senate bill. But I would much rather see a plan C that really attacks costs. And I think that’s what the American public wants to see. I mean, the American public is not behind this bill. And we need the American public behind the bill, because it’s going to have to do some tough things.

The current system is unsustainable. We do need heath care reform. But not reform that is opposed by the vast majority of the American people and makes the core problem of the current system worse. The President should follow Buffett’s advice, scrap the current bill and start over.

The Foundry: All Rhetoric, No Reality from White House on Health Care

Flanked, again, by doctors in lab coats, President Barack Obama gave yet another speech this afternoon urging Congress to pass his health care reform plan.

The President again claimed his plan lowers health care costs. It doesn’t.

The President again claimed his plan would not give government bureaucrats or insurance company bureaucrats more control over health care. It does.

The President again claimed that “if you like your plan, you can keep your plan. If you like your doctor, you can keep your doctor.” That simply is not true.

The President again said his plan gives the American people the same health care as Members of Congress. It doesn’t.

The President again claimed his plan is paid for. It is not.

The only “new” wrinkle in this speech was President Obama much telegraphed call for “an up or down vote” on health care reform. Again the White House is completely out of touch with reality. The Senate has already passed Obamacare. It is currently sitting ready for a vote in the House of Representatives. The House could pass Obamacare into law by an up-or-down/simple-majority vote tomorrow if they so desired.

But the simple reality is that they don’t have the votes. The House may be controlled by an overwhelming Democratic super majority, but the Obama administration simply does not have the 50% plus one votes they need to turn their top domestic priority into law.

Now the President is claiming he has some new plan that he all of a sudden wants a brand new vote on in the Senate. But that is not going to happen any time soon. President Obama says he is open to four specific conservative ideas, but the White House has produced no details or even legislative language for this new plan. And even if the White House ever does produce such language, it would then have to go to the Congressional Budget Office for scoring.

More importantly, simply adding so-called conservative ideas to the bill does not change the fundamental direction of the proposal. The bills before Congress, including the President’s new additions, would still result in a massive shift of power over health care financing and delivery of care to Washington politicians and bureaucrats. The public has spoken, and it does not want a federal take over of health care.

Conservatives should continue to press the Administration and leaders in Congress for bipartisan solutions that are based on elements of common ground, including letting states take the lead on health reform, tackling the tax treatment of health insurance, sensible insurance market reforms, and an honest commitment to fixing existing health care programs that the government already controls.

Obama Threatens Reconciliation

Weak Attempt to Salvage ObamaCare

Yesterday, after a temporary lull in the health care debates, President Obama released a "fresh attempt" to salvage his health care overhaul agenda. Though the details will not be released for some time, the ideas at the core of this 11-page outline (embedded in article) aren't really so "fresh." Based largely on the Senate's flawed plan, the "new" proposal is riddled with many of the same harmful taxes, dubious mandates, and unprecedented federal regulatory powers.

But even though the Senate bill serves as its template, the president's proposal does have some new initiatives -- and they add up to $80 billion. This would increase the overall cost of health care "reform" to a staggering $950 billion over ten years, a cost likely to rise as the legislative text is finalized.

Perhaps the most alarming difference is the prospect of a Federal Health Insurance Rate Authority, which would grant federal bureaucrats the power to set and control insurance prices and thus effectively create a government-run health plan. "If government can control both health benefits and health care pricing, that's the proverbial ball game,"writes Heritage health policy expert Bob Moffit. "Private health care is private in name only."

Although President Obama doesn't use the 'reconciliation' word, I can't imagine he meant the following statements as anything other than a threat to use pass Obamacare by reconciliation and let the voters pass judgment at the polls in November.

“We cannot have another year long debate about this. And if we can’t I think we got to go ahead and make some decisions and that’s what elections are for. Ben Stein Accuses Obama of Treating the Republicans Like Third Graders

Oh my, Ben Stein is apparently upset that the Republicans weren't being treated respectfully enough during the health care summit by the President. Heaven forbid... he called them by their first names. Gasp... the horror Ben. Yeah, those poor little defenseless Republicans who never attack anyone just had to fight back here because big bad Obama was being mean to them. And CNN thinks we're supposed to take anything this clown says seriously. I'm surprised Stein didn't just come straight out and call the President "uppity" because he came pretty close here.

BLITZER: Let's bring in Donna Brazile and Ben Stein, because I want them to weigh in. First to you, Ben. This whole issue of costs, premiums going up, a trillion dollars in extra cost to US taxpayers. Some of it might be offset by some cuts in projected Medicare spending. Where do you come down on this?

STEIN: Well, the 57 percent who are going to get subsidies, where is that money going to come from? That money is going to come from taxpayers. That money is not going to just magically appear. So the costs for everyone is going to go up.

Obviously, the insurance companies are going to cover more people, cover people with preexisting conditions, cover people who have very expensive treatment options involved, without having to charge more to somebody. So, somebody's going to be paying more.

I'm also sort of floored by the whole thing that's going on here, where the president is calling the senators by their first names, as if they were kids in a third grade class. And they're all calling him Mr. President.

But I'm most floored of all by the fact that we've got a very serious jolt about the economy today, and somehow they're talking about rearranging the deck chairs on the Titanic when it looks seriously as if the economy is now heading for a double dip in the recession. The whole thing just has a kind of surrealistic quality.

BLITZER: What was the jolt on the economic numbers that you're referring to?

STEIN: The jobless -- the first-time jobless claims came in considerably higher than was forecast, high enough to make people think that the recovery is faltering. They were expecting 455,000, came in roughly 495,000, very roughly, very roughly. That's a very bad piece of news. Housing sales declined very sharply in the last month, from the month before. This recovery is not getting the traction that it needs. And for us to be fixating on economic issues about health care that are going to be happening in 2016 when the economy is floundering right now puzzles me.

BLITZER: Ben Stein, first to you. The president, you know, he's fighting right back in the face of some strong Republican comments.

STEIN: Well, I think he's been fighting from the first moment this thing started. I think the idea that it was a bipartisan kumbaya feel-good moment was thrown out right away, as soon as he started and as soon as Senator Reid started and as soon as Speaker Pelosi started, they started with a series of attacks. And the Republicans have come right back with a series of their own attacks.

I will say, however, that I am sometimes moved to tears that in the fact that this great, great country, the greatest country in the world, people do by in large get along quite civilly. But if I may respectfully say so, I think the president could lose some of his condescension towards the people who are not agreeing with him, and nobody would be harmed.

Conrad Says HC Bill Is Dead Unless House Acts First

U.S. Sen. Kent Conrad, the chairman of the Budget Committee, dealt a blow to the prospects for health care legislation just a day before a White House summit, arguing that the process would be "dead" if the House doesn't act first to pass the Senate bill.
The statement is sure to enflame members of the House, who are reluctant to take a leap of faith and pass the Senate bill without knowing that it will be changed through reconciliation in the Senate.
Talking Points Memo's Brian Beutler reports:

"The only way this works is for the House to pass the Senate bill and then, depending on what the package is, the reconciliation provision that moves first through the House and then comes here," said Sen. Kent Conrad (D-ND) outside the upper chamber this morning. "That's the only way that works."

I pointed out that House leadership, including Speaker Nancy Pelosi, has repeatedly insisted they won't take a flier on a reconciliation package--that they will only pass the Senate billafter the smaller side-car reconciliation bill has been all wrapped up.

"Fine, then it's dead," Conrad said.

Conrad added that he wouldn't personally make any promises or symbolic gestures to House members to assure them that the Senate can or will take any action in a reconciliation bill to address House concerns.

"I don't sign any blank check," Conrad said.

As I detailed yesterday, health care already faces a tough road in the House, even assuming that some changes can be made by the Senate. Statements such as this one from Conrad (who as chairman of the Budget Committee would play a key role in any reconciliation strategy) will only fuel more animosity between House and Senate Democrats, and create a dilemma in which neither side wants to act first.

Dems Lose Summit on Substance, Scramble for Nuclear Option?

It is hard to see how the Democrats are doing themselves anything but harm with the health-care summit.

Beyond particular observations about individual exchanges or moments I would say the morning’s session suggests three broad points. First, the Democrats appear to have no particular purpose in mind for this event. They’re not driving anywhere, or making a clear individual case, while Republicans clearly want to get across the point that we should scrap the current bills and start over in pursuit of a few incremental steps. The Democrats may have thought that simply putting the spotlight on Republicans when the subject is health care would make the GOP look bad. But Republicans so far seem prepared enough and focused enough to avoid that, and to make the Democrats look rather aimless by comparison.

Second, the Democrats are going to great lengths to argue that their bill incorporates some Republican ideas—by which they mean that it includes insurance exchanges and the like—suggesting that this means they are moving in the direction of Republicans and toward some middle ground. They fail to see (or to acknowledge) that while some similar mechanisms may be proposed by wonks on both sides, Republicans and Democrats in fact want to move in nearly opposite directions from our current health-care arrangements: Republicans toward a genuine individual market and Democrats toward a greater socialization of costs. That makes a great deal of what Obama and the Democrats said this morning basically meaningless. (This is a point I tried to argue more fully in this space a while back.)

Third, an important part of the Democrats’ problem is that Obama himself is their only star, and this format is not working for him. He certainly seems engaged and well informed (even given a few misstatements of fact, at least one of which John Kyl made very clear.) But he doesn’t seem like the President of the United States—more like a slightly cranky committee chairman or a patronizing professor who thinks that saying something is “a legitimate argument” is a way to avoid having an argument. He is diminished by the circumstances, he’s cranky and prickly when challenged, and he’s got no one to help him. The other Democrats around the table have been worse than unimpressive. The Republicans seem genuinely well-prepared, seem to have thought through the question of who should speak about what rather carefully, and several of them have done quite a good job making their case against the Democrats’ approach. If we were to judge by debating points, Republicans certainly won the morning handily.

It’s easy to dismiss all this by saying no one is watching anyway, but that’s not quite true. The purpose of this spectacle is not so much to move the public as to move Democratic members of Congress—to create some momentum that might last long enough to help wavering Democrats cast a very painful vote. That audience very likely is watching, and they are seeing their leadership fail to make a straightforward case for the Democratic approach to health care, or to respond to the most basic Republican objections about high costs, excessive spending, overregulation, and the effect of this plan on American families. They are managing to lose an argument about health care to Republican members of Congress—no mean feat.

Charles Krauthammer said, “In the last few minutes after 7-hours that the whole summit was a show to justify reconciliation, which is what they wanted to do all along!!”

Please keep up the good fight. The president intimated that his would be the final chapter on this Bill and HC Reform, at least for now. Let us make it is the final chapter of ObamaCare type of reform and that it doesn't pass. Right now they don't have the votes!!!

Accurate quote should be: It’s Not a HealthCare Bill… It’s a Power Grab Bill, America!!

I’m sure there will be many moments from today’s health-care summit that will be worthy of clipping and saving, but this one from our new colleague Greg Hengler may be the strangest one of all. In arguing for the current version of ObamaCare, whatever that is at the moment, Nancy Pelosi claims that it will create four million jobs — or nearly half of all the jobs lost over the last two years:

Let’s put this in perspective. The health-care sector already employs 14.3 million people. The Bureau of Labor Statistics projects that this sector will add 3.2 million more people in the next eight years, thanks to an aging population. It can do that now because it doesn’t operate under price controls that will come as part of the ObamaCare bill. If Congress passes a bill that forces smaller payments to doctors and hospitals, that will actually impede hiring to meet the demand — and that is exactly what “bending the cost curve downward” means.

Pelosi also claims that passing the House version of ObamaCare would add 400,000 new jobs immediately. Where? Well, those would be the people that the government would have to hire to run their exchanges, manage the federal public option, and enforce individual mandates, among other ObamaCare initiatives. It’s a bureaucratic expansion, the kind of “jobs bill” that will further burden the private sector.

The last 5-minutes of the Summit said it all… Obama intimated that they would do whatever it takes (Saul Alinsky all the way) to get this bill passed without real bipartisan input or compromise and in the end that means reconciliation even if the American people don’t want this bill. The only problem is that right now… Congress doesn’t even have the votes for that. So stay committed and keep up the pressure.
